The Ombudsman for Future Generations to initiate the amendment of the Act on Environmental Protection Product Charges in connection with solar cells

Acting within his statutory competence, Ombudsman for Future Generations Marcel Szabó is going to initiate the amendment of Schedule № 1 to Act LXXXV of 2011 on Environmental Protection Product Charges (hereinafter the "EPPC Act") in order to have all electric and electronic equipment utilizing renewable energy exempted from such product charges.

The Preamble of the EPPC Act specifies the objectives of introducing such product charges as follows: to contribute to the prevention and mitigation of environmental pollution and to facilitate activities for the pursuit of the practical and prudent management of natural resources. By virtue of the aforementioned Schedule to the amended EPPC Act, effective as of 1 January 2015, all solar cells (photovoltaic cells and panels) and all generators and control units used in wind power plants are subject to such product charges. They are subject to EP product charges irrespective of the fact that these equipment prominently contribute to the realization of the objectives declared by the Act at every stage of the process (from mining and transporting fuels through generating, transforming and transmitting electricity), to the practical and prudent management of fossil fuels as finite and increasingly scarce natural resources, and to combating climate change. Article P of the Fundamental Law of Hungary places all natural resources, our nation's common heritage, under constitutional protection.

The National Energy Strategy of Hungary and the Renewable Energy Action Plan based thereon envisage, among others and in accordance with our EU commitments, the utilization of geothermal and solar energy, the rational spreading of wind power plants. To this end, the Action Plan sets forward, combined with regulatory incentives, the application of such assistance instruments as production support, direct incentives, investment aid and green financing. Subjecting renewable energy equipment to the product charge is definitely in conflict with those objectives and diminishes the effectiveness of various support measures and incentives.

In view of the foregoing, the Ombudsman for Future Generations is going to propose the amendment of the relevant act in order to have all equipment designed for the utilization of solar and wind energy exempted from environmental protection product charges.

The Parliamentary and Health Service Ombudsman Service is today calling on past, present and future service users and the organisations it investigates to provide feedback on its service to help develop its service charter.

This is the start of a comprehensive listening exercise centring on what people can expect from the Ombudsman’s investigations and service.

The service charter will be a set of promises to individuals and bodies in jurisdiction, designed to create a modern and responsive service.

The new service charter will give people a clear understanding about what they can expect from the Ombudsman Service and what will be involved in an investigation, with a focus on better communication throughout the service user journey.

The Parliamentary and Health Service Ombudsman investigates complaints from individuals about UK government departments, and other public organisations, and the NHS in England. It carries out adjudications independently, without taking sides, providing a final chance for people’s complaints to be looked at.

In 2012 the Ombudsman Service, responding to feedback from the public, moved from doing hundreds to thousands of investigations every year. It has halved the average time it takes to complete a case whilst still maintaining satisfaction levels giving many more people justice than before.

The Ombudsman Service investigates 4,000 cases a year and upholds around 42 per cent. The biggest driver of satisfaction with any Ombudsman Service is whether the complaint is upheld or not.

The Ombudsman Service is now focused on listening and learning from people’s experience of its service so it can better understand what people and service providers expect from the organisation. In summer 2014 the Ombudsman announced it would conduct a public consultation to develop a service charter as part of the next phase in the organisation’s modernisation agenda.

Parliamentary and Health Service Ombudsman Julie Mellor said:

“We would welcome people’s views on what they want and expect from us. We will use people’s responses to develop a service charter - a set of promises so service users, the public and service providers know what they can expect from us.”
The engagement exercise will take place between January and March 2015 and the Office for Public Management (OPM), an independent research organisation, has been commissioned by the Ombudsman Service to design and deliver the project.

OPM will recruit past, current and potential future users of the Ombudsman’s service to take part in workshops in February, in London, Manchester and Birmingham, to offer their views on what the service charter should include.

There will be two consultation panels, which will play a critical role in developing the charter. A panel of advocacy organisations and a users’ panel - made up of complainants. The panels will comment on findings and themes from the research and advise on the development of the service charter.

A website has been set up to capture views and opinions through an online survey. The site will also provide regular updates with all the developments surrounding the service charter visit: www.ombudsmanservicecharter.org.uk to get involved.

A draft service charter will be consulted on in the spring and finalised in the autumn.

Volksanwaltschaft präsentiert Prüfbericht an den Landtag Steiermark

Kontrolle der öffentlichen Verwaltung: Beschwerden um fünf Prozent zugenommen

Am 13. Jänner präsentierten Volksanwältin Gertrude Brinek, Volksanwalt Günther Kräuter und Volksanwalt Peter Fichtenbauer im Zuge einer Pressekonferenz den Prüfbericht an den Landtag Steiermark. Rund 4.000 Menschen in der Steiermark wandten sich in den Jahren 2012/2013 mit einer Beschwerde an die Volksanwaltschaft. In 722 Fällen leitete die Volksanwaltschaft ein Prüfverfahren über die Steiermärkische Landes- und Gemeindeverwaltung ein. Damit ist das Beschwerdeaufkommen betreffend die Steiermärkische Landesregierung gegenüber den Jahren 2010/2011 um fünf Prozent gestiegen. Fast ein Viertel mehr Beschwerden gab es in Bezug auf die Mindestsicherung und die Jugendwohlfahrt. Weitere zahlreiche Beschwerden betrafen Angelegenheiten der Raumordnung und des Baurechts.

Präventiver Schutz der Menschenrechte: Bisher rund 110 Kontrollen in der Steiermark

Seit Juli 2012 nimmt die Volksanwaltschaft ihr verfassungsgesetzliches Mandat zum Schutz und zur Förderung der Menschenrechte wahr und führt mit ihren Kommissionen Kontroll-besuche in Einrichtungen, in denen es zu Freiheitsentzug kommt oder kommen kann, durch. Bisher fanden in der Steiermark rund 110 meist unangekündigte Kontrollen und begleitende Beobachtungen statt. Davon 14 in Polizeieinrichtungen, 14 in Justizanstalten, 22 in Einrichtungen der Jugendwohlfahrt, 14 in Einrichtungen für Menschen mit Behinderung, 28 in Alten- und Pflegeheimen sowie 12 in Psychiatrien und Krankenanstalten. Die Kommission beobachtete außerdem sechs Demonstrationen.

Ausweitung der Prüfkompetenz gefordert

Die Volksanwaltschaft hat nach wie vor kein Mandat für eine Prüftätigkeit ausgegliederter Rechtsträger. Dadurch ist die Kontrolle über die kommunale Daseinsvorsorge wie die Gas- oder Elektrizitätsversorgung stark eingeschränkt und in vielen Fällen kein effektiver Rechtsschutz für Bürgerinnen und Bürger möglich. Die Volksanwaltschaft fordert daher eine Ausweitung ihrer Prüfkompetenz. So wie der Rechnungshof sollte auch sie neben öffentlichen Einrichtungen alle privaten Rechtsträger, an denen Bund, Länder oder Gemeinden mit zumindest 50 Prozent beteiligt sind, prüfen können.
