In the interest of security, the Prison and Probation Service may decide to monitor a telephone conversation between an intern and another person, pursuat to chapter 7, section 5 of the Imprisonment Act. A condition to monitor a telephone conversation is that the persons that are monitored are informed of such measures in advance. In the decision the Parliamentary Ombudsman states that it is of significance that the provision of chapter 7, section 5 of the Imprisonment Act is abided by, as all individuals hold the constitutional regulated right to be protected against confidential telephone monitoring. Moreover, the Parliamentary Ombudsman develops her view on how this type of information should be handed out and how the measure should be documented.
