“Charting the progress made towards the full enjoyment of sexual and reproductive health and rights in Europe paints a mixed picture. We can rejoice at notable achievements, but pervasive challenges and deficits as well as new retrogressive developments point to the need for member states to take robust action and remain vigilant and committed”, said today the Council of Europe Commissioner for Human Rights, Dunja Mijatović, while releasing a report on this topic.

The report entitled ‘Sexual and Reproductive Health and Rights in Europe: Progress and Challenges’ takes stock of the important multisectoral steps taken since 2017 that have increased access to contraception and abortion care, improved the quality of obstetric care and advanced the provision of comprehensive sexuality education in schools.

It also outlines the negative trends and setbacks in the sphere of sexual and reproductive health and rights and points to the retrogression that has taken place in a few states. It shows how multiple and intersectional discrimination continues to impede the full realisation of sexual and reproductive health and rights of marginalised groups and addresses the considerable challenges human rights defenders working to advance sexual and reproductive health and rights still face in parts of the region.

For each area of concern addressed, the report presents developments in international human rights standards and public health guidelines. It also highlights the COVID-19 pandemic, the full-scale invasion of Ukraine by the Russian Federation since 2022 and the related cost-of-living crisis as important factors that impacted the developments in the field of sexual and reproductive health and rights.

“Universal access to quality sexual and reproductive health care and the ability to exercise sexual and reproductive autonomy and decision making are integral components of human rights and gender equality”, said the Commissioner while stressing that European states have international human rights obligations to respect, protect and fulfil these rights.

In this framework, the Commissioner presents a series of recommendations, setting out a roadmap aimed at assisting states in ensuring the realisation of sexual and reproductive health and rights in Europe, in compliance with international human rights law and standards.

These include:

• Guaranteeing the provision of comprehensive sexuality education;
• Ensuring availability and accessibility of affordable contraceptive services and evidence-based information on contraception;
• Eliminating remaining barriers and restrictions to guarantee access to quality abortion care including evidence-based information on abortion;
• Ensuring dignified and respectful gynaecological and obstetric care, free from discrimination and violence;
• Establishing effective measures to tackle intersecting forms of discrimination that limit the equal enjoyment of sexual and reproductive health and rights, in particular for women and girls with disabilities, Roma women and girls, older women, refugees, asylum seeking and migrant women, LGBTI people and sex workers;
• Preventing retrogression in the protection of sexual and reproductive health and rights and enabling the work of human rights defenders acting to advance sexual and reproductive health and rights.

The recommendations complement those from the 2017 Issue Paper on ‘Women’s sexual and reproductive health and rights in Europe’ that this report is following-up on.

ÁNGEL GABILONDO PRESIDE LA REUNIÓN DEL CONSEJO ASESOR DEL MECANISMO NACIONAL DE PREVENCIÓN DE LA TORTURA

El Defensor del Pueblo, Ángel Gabilondo, ha presidido este jueves la reunión del Consejo Asesor del Mecanismo Nacional de Prevención de la Tortura (MNP), órgano de cooperación técnica y jurídica formado por profesionales especializados en la defensa de los derechos de las personas privadas de libertad, representantes de organizaciones de la sociedad civil y de colegios profesionales de abogados, médicos y psicólogos.

En el transcurso del encuentro, celebrado en la sede de la institución, se ha analizado la actividad que realiza el MNP, centrada en la inspección y supervisión de los lugares de privación de libertad de todo el territorio nacional.

Actualmente, componen el Consejo Asesor del MNP: la adjunta primera del Defensor del Pueblo, Teresa Jiménez-Becerril; la adjunta segunda, Patricia Bárcena; Ester Pascual, abogada; Luis Andrés Cucarella, catedrático de Derecho Procesal en la Universidad de Valencia; Luis F. Nieto, abogado; Mª José García-Galán, magistrada; Maite Parejo, abogada; María Castellano, catedrática emérita de Medicina Legal y Forense; María del Toro, psicóloga social, y Vicenta Esteve, psicóloga clínica.

Al Consejo Asesor también asistieron el director del MNP, Fernando Herrero; Ana González-Páramo, asesora del Gabinete Técnico del Defensor del Pueblo, y el secretario general del Defensor del Pueblo, José Manuel Sánchez Saudinós, que actuó como secretario del Consejo.

In August 2023, a pressing concern was brought to light regarding the health risks associated with vehicle idling on Gozo ferries. This issue, initially highlighted by a concerned passenger, prompted an investigation by the Office of the Ombudsman, leading to a set of recommendations aimed at enhancing passenger safety and ensuring compliance with established regulations.

In response to concerns raised about vehicle idling on Gozo ferries, steps have been taken to enhance safety and ensure adherence to established regulations. Following an investigation and subsequent recommendations by the Office of the Ombudsman, Gozo Channel has implemented a series of measures aimed at mitigating the health risks associated with this issue.

Implementation of Safety Measures:

No access to enclosed decks: In alignment with Gozo Channel’s Shipboard Operating Procedures, passengers are now prohibited from accessing enclosed decks while the vessel is in motion. This policy is enforced by the vessel’s master or a designated officer, ensuring that all passengers are aware of and comply with this rule.

Crew responsibilities: The crew members are tasked with ensuring that no passengers remain in their vehicles once the vessel is ready to depart. This involves a thorough check of the vehicle deck and directing passengers to the upper decks. Compliance is further ensured through PA system announcements informing passengers of the necessity to vacate the car deck.

Informational monitors at marshalling areas: Monitors are being installed at Cirkewwa and Mgarr to improve communication and awareness. These displays will continuously remind passengers of the policy against remaining in their vehicles and the requirement to turn off car alarms during the crossing.

Public awareness campaign: A press release has been issued to inform the public about the dangers of staying in the vehicle deck during crossings, emphasising the potential risks in emergency situations, such as a vehicle fire.

The Office of the Ombudsman welcomes the implementation of these recommendations, which is a critical step in ensuring a safer travel environment for all passengers and crew aboard the Gozo ferries.

Stuttgart. Mit mehreren Eingaben zum Opferentschädigungsgesetz hat sich der Petitionsausschuss in seiner Sitzung am Donnerstag, 29. Februar 2024, befasst. Das hat der Vorsitzende, Thomas Marwein (Grüne), mitgeteilt. „Eine Abhilfe war nicht möglich, da wir uns im Bundesrecht bewegen“, so Marwein. Dennoch habe es im Gremium Vorschläge gegeben, die die Situation von Betroffenen verbessern könnten. „Letztlich wurden die Petitionen als Material an die Regierung überwiesen“, fasste Marwein zusammen.

Die Petenten hätten in ihren Eingaben etwa die Einrichtung einer unabhängigen Monitoringstelle zur Überprüfung der Verfahren nach dem Opferentschädigungsgesetz sowie eine unabhängige Beschwerdestelle für Gewaltopfer gefordert. Insbesondere sei unter Bezugnahme auf eine Veröffentlichung des Weißen Rings in seiner Zeitschrift „Forum Opferhilfe“ zur bundesweiten Situation ein langwieriges, hochbürokratisches und nicht kundenfreundliches Antragsverfahren bemängelt worden. Dieses führe dazu, dass Gewaltopfer Anträge aus Selbstschutz zurücknehmen würden.

Der Bund habe unter dem Eindruck der schweren Folgen des Terroranschlags am Berliner Breitscheidplatz 2016 die erhöhte Dringlichkeit und die Bedeutung von schnellen psychologischen Hilfen und medizinischen Behandlungsmöglichkeiten sowie einer umfassenden Nachversorgung der Gewaltopfer erkannt. Aus diesem Grund sei das Soziale Entschädigungsrecht umfassend reformiert worden, gab Marwein die Ausführungen des Sozialministeriums wieder. Die Belange von Gewaltopfern stünden nunmehr im Fokus des SGB XIV – Soziale Entschädigung, das das Opferentschädigungsgesetz am 1.1.2024 abgelöst hat. Als neue, niederschwellige Angebote seien etwa Schnelle Hilfen eingeführt worden, das seien Leistungen in Traumaambulanzen und Leistungen des Fallmanagements. Hierdurch sollte erreicht werden, dass mehr Betroffene die Leistungen der Sozialen Entschädigung in Anspruch nehmen und besser unterstützt werden. Darüber hinaus stünden im Land verschiedene Einrichtungen und Institutionen für Informationen und Hilfen zur Verfügung. 2020 sei von der Landesregierung ein ehrenamtlicher Opferbeauftragter ernannt und eine zentrale Anlaufstelle für Opfer und Betroffene von Terroranschlägen, Amokläufen und Großschadensereignissen sowie deren Angehörigen beim Justizministerium eingerichtet worden.

Der Petitionsausschuss hatte einen Vertreter des Weißen Rings in die Sitzung eingeladen, um mit ihm über Erfahrungen im Umgang mit Opfern von Gewalttaten zu sprechen. Im Gespräch sei deutlich geworden, so Marwein, dass das Soziale Entschädigungsrecht weniger als einem Viertel der Bevölkerung bekannt sei. Nur 9,5 Prozent der Betroffenen würden einen Antrag stellen. Überdies seien die Erfolgsaussichten abhängig vom Bundesland, in dem der Antrag gestellt werde.

„Eine Verbesserung für Opfer wäre es, wenn in den Strafverfahren der Adhäsionsantrag gestellt wird“, so Thomas Marwein. Im Adhäsionsverfahren könnten im deutschen Prozessrecht zivilrechtliche Ansprüche, die aus einer Straftat erwachsen, statt in einem eigenen zivilgerichtlichen Verfahren unmittelbar im Strafprozess geltend gemacht werden, sofern der Streitgegenstand noch nicht anderweitig gerichtlich anhängig gemacht worden sei. „Aus Opfersicht macht das viel Sinn und führt letztlich auch zu einer Entlastung der Gerichte“, erläuterte der Vorsitzende. Außerdem habe sich der Petitionsausschuss Gedanken über Opferlotsen gemacht und über speziell geschulte Staatsanwälte und Richter. Auch das Sozialressort habe der Ausschuss in den Blick genommen. Marwein: „Schulungen für Sachbearbeitende in den Versorgungsämtern sind ein guter Weg zu einem empathischeren Umgang mit Opfern.“ In der Regel würden Opfer von Retraumatisierung sprechen, wenn sie im Verwaltungsverfahren direkt mit der Tat konfrontiert würden. „Das Sozialministerium könnte diese Schulungen anbieten oder für die Teilnahme an Schulungen anderer Anbieter werben“, legte Thomas Marwein dar.
