El Justicia, Fernando García Vicente, ha informado al Alcalde de la capital aragonesa, Pedro Santisteve, de las principales quejas e inquietudes que las personas que viven en Zaragoza trasladan a la Institución y le ha manifestado su deseo de mantener una cauce de comunicación estable y fluido con el fin de resolver lo antes posible los problemas que se detectan en la ciudad.

Por su parte, Santisteve se ha comprometido a colaborar con la Institución y, en este sentido, a dar respuesta a todas las solicitudes de información del Justicia.

Algunos de los temas tratados en la reunión, a la que también han asistido los Consejeros municipales, Luisa Broto y Pablo Híjar, han sido la insuficiente oferta de plazas en las guarderías municipales o la necesidad de espacios deportivos gratuitos en los barrios; respecto al transporte urbano, ambos representantes institucionales han hablado sobre la mejora de las frecuencias del tranvía los fines de semana y festivos, o las condiciones para la bonificación del billete a determinadas personas y colectivos; también se han abordado asuntos de carácter social como la situación de las personas que viven en la calle, y asuntos de carácter medioambiental, con especial hincapié, en los problemas de convivencia vecinal generados por el ruido procedente de establecimientos de ocio.

Tanto el Justicia como el nuevo Alcalde de la capital aragonesa han calificado el encuentro, que se ha prolongado alrededor de una hora, como positivo y muy provechoso. 

A instancias del Justicia de Aragón, el Ayuntamiento de Fraga ha revisado la red municipal de agua de la calle Obradores y adyacentes y ha realizado las obras necesarias para evitar filtraciones que puedan afectar a viviendas particulares.

En respuesta a una queja de vecinal sobre filtraciones y humedades en una propiedad particular de la calle Santa Maria, y tras la tramitación del correspondiente expediente, el Justicia de Aragón sugirió al Ayuntamiento fragatino que realizase una revisión general de las redes municipales de abastecimiento de agua y de alcantarillado en la calle Santa María, con el fin de localizar y reparar posibles fugas de agua bien procedentes de redes municipales, o como consecuencia de la ejecución de unas obras municipales anteriores, en Calle Obradores.

El completo informe del arquitecto municipal remitido a la Institución, confirma que se han realizado las actuaciones necesarias para dar cumplimiento a la Sugerencia y solucionar el problema lo que, en opinión del Justicia, Fernando García Vicente, muestra las ventajas que la colaboración institucional tiene para las personas.  

North East Lincolnshire Council has been heavily criticised by the Ombudsman after social workers arbitrarily removed a young baby from her mother’s care and handed the child over to her father.

The mother complained to the Local Government Ombudsman (LGO) that social workers removed her baby and in the process threatened to remove her other two children if she did not comply.

The mother was suffering from post-natal depression and a number of other conditions when she contacted social services for help. She threatened suicide when social workers visited. But despite the urgency of the situation, social workers left her alone with the baby for several hours.

At the mother’s suggestion, the baby was taken to live with her father, and the mother and her two other children went to live with the children’s grandmother for support. The mother also attended a number of support sessions during this time.

The council had taken the management decision that the baby should live with the father. However, this was not communicated to the mother and throughout the next few weeks the mother was led to believe that the baby could return to her and the grandmother’s care as long as she was not alone with the child.

Following a doctor’s appointment where both parents and the baby were present, the mother took the child home with her. Social workers then came to the house and removed the baby, warning that they would remove the other children into care if she did not co-operate. At no point had social workers told the mother the baby could not be returned to her care.

Social workers’ grounds for removing the baby included that the mother had driven the baby home without a child seat, and that the grandmother had left the baby in her mother’s care for a few minutes while she bought some nappies.

They also said the grandmother had left the baby with the mother on the day of the original call, despite the council also having left the baby in a vulnerable position for a number of hours after social workers visited on that day.

The LGO’s investigation found that the council’s one-sided actions in supporting the father having custody meant the women did not know whether the baby would be able to live with them at least part-time until a court reached a decision about her residence. This was a full nine months after she was sent to live with her father.

Dr Jane Martin, Local Government Ombudsman, said:

“While I acknowledge the difficult task faced by councils in matters of child protection, in this case social workers fell so far short of what is acceptable that it is in the public interest for me to issue this report.

“The actions of North East Lincolnshire Council’s children’s services department were disproportionate, arbitrary and misleading and led to months of uncertainty and the mother to feel aggrieved because the council’s support for the father having custody was one-sided.

“Any decision to remove a child from their family is difficult and likely to cause significant distress to all involved. This is why it is all the more important that parents can see they were treated fairly, the process was followed properly, and the outcome was in proportion to the events that necessitated it.”

To remedy the situation, the council has been asked to apologise to the family and to prevent a recurrence, review its policies and arrange training for relevant staff.

The council has also been asked to pay the mother £6,000 to reflect the severe avoidable distress, anxiety, justifiable outrage and loss of opportunity she suffered as a result of the council’s one-sided handling of the case and its disproportionate actions in removing the baby without following proper procedures.

To remedy the grandmother’s injustice, the council should pay her £1,000 to reflect the significant distress and justifiable outrage its removal of the baby caused her over the same period of nine months.

The council has agreed to carry out these recommendations.

El pasado 22 de junio, se ha celebrado la última reunión de la Comisión Técnica de seguimiento de la guía de intervención en procesos de jurisdicción civil relativos a personas con discapacidad derivadas de distintos tipos de problemas psíquicos. Esta comisión se viene reuniendo desde que en 2007 la Institución creara un grupo de trabajo, en el que participaron las Administraciones, entidades y profesionales judiciales, con el objetivo de realizar un seguimiento y analizar las dificultades para acceder a los dispositivos especializados que encuentran las personas con este tipo de discapacidad.

Fruto de ese trabajo fue una propuesta de coordinación en los procesos de incapacitación relativos a personas con discapacidades psíquicas mediante la elaboración de una Guía de Intervención entre los profesionales protagonistas, que se presentó en sendas jornadas de trabajo en Jaén y Sevilla.

Los asuntos que afectan a las personas con problemas de salud mental, en general, demandan de esta Defensoría un abordaje en común capaz de poner de relieve los déficits detectados en la atención que las distintas administraciones públicas les dispensan, así como de incidir en aquellas propuestas de mejora que permitan alcanzar el efectivo disfrute de sus derechos.

Como adjunto general, deberá asistir al síndic en el ejercicio del su cargo y asumir las funciones que le delegue, incluidas las relativas al gobierno de la institución.

También ha estado vinculado al Síndic desde el año 2010 en calidad de miembro del Equipo de Trabajo y coordinador del Consejo Asesor de la antigua Autoridad Catalana de Prevención de la Tortura (actualmente, Mecanismo Catalán).

La Comisión del Síndic también ha ratificado el nombramiento de Olga Casado para ocupar el liberado en el Equipo de Trabajo del Mecanismo Catalán para la Prevención de la Tortura.

Médico de familia desde 2005, Olga Casado es presidenta de la Comisión para la erradicación de la violencia de género de Mutua Terrassa. También es miembro de la Comisión de seguimiento del Protocolo para el abordaje integral de la violencia machista del Ayuntamiento de Terrassa y de la asociación Memoria contra la Tortura.
