Barriere architettoniche a scuola: presentare ricorso al Difensore Civico

Nel sito web di Cittadinanzattiva si evidenziano le azioni per far rispettare le norme che garantiscano l’accessibilità agli edifici scolastici, prendendo in considerazione il D.P.R. 503/1996 e la Legge n.104 del 5 febbraio 1992. 

 

Il D.P.R. 503/1996 stabilisce che agli edifici o spazi pubblici esistenti, devono essere apportati tutti gli accorgimenti finalizzati all'abbattimento barriere architettoniche al fine di garantire la completa fruibilità dello spazio anche da parte di persone con ridotta o impedita capacità motoria o sensoriale.

Mentre la Legge n.104 del 5 febbraio 1992 (legge quadro sull'handicap) sancisce che le persone con disabilità in nessun caso possono essere escluse dal godimento di servizi, prestazioni e opportunità ordinariamente goduti da ogni cittadino. In particolare la legge 104/92 prevede:

- che il rilascio delle concessioni edilizie sia vincolato al rispetto della normativa in materia di barriere;

- siano dichiarate inagibili e inabitabili (e sanzionati i responsabili) le opere realizzate in edifici pubblici o aperti al pubblico in modo tale da compromettere l'accessibilità ai disabili;

- sia riservata una quota di fondi per opere nell'edilizia residenziale pubblica;

- che siano adeguati i regolamenti edilizi comunali alle norme vigenti.

Ma cosa possono fare i cittadini nel caso in cui non siano rispettate tali norme? Senz’altro le azioni che è possibile mettere in campo sono diverse, tra cui: iniziative di pressione diretta nei confronti della Pubblica Amministrazione, di denuncia mediatica, di sensibilizzazione dell'opinione pubblica, e la possibilità di adire direttamente in sede giudiziale.

Inoltre è possibile presentare ricorso al Difensore Civico, che ha la possibilità di accedere agli atti interni e individuare le inadempienze compiute.

Seimas Ombudsmen‘s Office and UN Refugee Agency agree: the right to liberty of asylum-seekers and detention conditions in Lithuania is in need of increasing attention

20150330-GM8R5873On Monday 30 March, the conference “Is detention the only option? The issues and challenges of the detention of asylum-seekers and other foreigners in Lithuania” was held at the Parliament in Lithuania.

Jointly organized by The Seimas (Parliament) Human Rights Committee, the Seimas Ombudsmen’s Office, and the United Nations Refugee Agency (UNHCR) in Lithuania, the conference focused on the right to liberty, legitimate restrictions of that right, detention monitoring, and the launch of the UNHCR’s Global Strategy “Beyond detention.’’

The conference was attended by more than 60 participants from the Ministry of Internal Affairs, different relevant state institutions and representatives of academia, the courts and civil society. Participants discussed further developments in the field of detention that are needed in order to bring the national practice fully in line with international and European standards.   

The Seimas Ombudsmen’s Office reported on the results of monitoring visits to the Foreigners’ Registration Centre and border units in 2014. The Lithuanian Red Cross Society presented border monitoring experience and shared its openness to assist the state in detention monitoring activities. 

“We constantly monitor and evaluate detention conditions of aliens in Lithuania and undertake the detention monitoring. After written reply on implementation of our recommendations is received, we often visit a place again to be sure that Seimas Ombudsman’s recommendations are implemented and if the recommendations are implemented properly”, said Seimas Ombudsman Augustinas Normantas.

Professor Marija Ausrine Pavilioniene, Member of Seimas Committee of Human Rights began by noting that asylum-seekers are a particularly vulnerable group in society and require special protection. "These people have often experienced the horrors of war, and physical, mental or sexual violence in their country of origin, thus ensuring the dignity of the human behavior upon their arrival after crossing the border always shows the maturity of the democratic state," she said. The member of the Committee emphasized the fact that the detention is an extreme measure, which applies only if no other alternatives are available.

Professor Lyra Jakulevičienė of Mykolas Romeris University outlined international standards applicable to detention and stressed strict regulation of restrictions to the right to liberty by EU law. She also mentioned several issues to be considered in light of the upcoming amendments to the Aliens Law, such as conditions for the application of alternative measures to detention, in particular as it relates to establishing of identity, availability of more alternatives to detention, application of detention to vulnerable persons and other.

In 2014 406 people claimed asylum in Lithuania. International protection was granted and resident permits were issued to 91 applicants, mainly from Afghanistan, Russian Federation and Ukraine.

The Law on the Seimas Ombudsmen allows the Seimas Ombudsmen to enter any social care or custodial institution at any time of the day in Lithuania. The Seimas Ombudsmen started implementing national prevention of torture in Lithuania in the beginning of 2014 when the Parliament of the Republic of Lithuania adopted the Optional Protocol (OPCAT) to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

Bürgerbeauftragter Dieter Burgard berichtet aus dem Petitionsausschuss

Dieter Burgard erwirkt die Aussetzung einer Haftstrafe zur Bewährung und ermöglicht eine erfolgreiche Resozialisation eines Familienvaters

Ein Vater von zwei kleinen Kindern, war unter Bewährung zu einer Haftstrafe verurteilt worden. Aufgrund gesundheitlicher Probleme wurde er in der Bewährungszeit arbeitslos, sodass er die Geldauflage in Höhe von 1.000 € nicht in voller Höhe zahlen konnte. Daher wurde die Bewährung widerrufen. Er hätte im November 2014 seine Freiheitsstrafe antreten müssen. Ein Gnadengesuch lehnte die Staatsanwaltschaft ab.

Zwischenzeitlich hatte der Betroffene eine vom Job-Center geförderte Umschulung begonnen. Diese eröffnet ihm neue berufliche Perspektiven, damit er und seine Familie nicht mehr von Sozialleistungen abhängig sind. Mit einem Haftantritt hätte er seinen lang ersehnten Platz in der Umschulungsmaßnahme, genauso wie seinen inzwischen angetretenen neuen Arbeitsplatz in einem Krankenhaus, verloren.

Bürgerbeauftragter Dieter Burgard erreichte nun, dass die Haftstrafe erneut zur Bewährung ausgesetzt wurde. Der Petent ist damit in der Lage, die erfolgreich begonnene Umschulung fortzuführen, um sein Leben und das seiner Familie in geordnete Bahnen führen zu können. Auch die noch offenen 250 € aus der Bewährungsauflage konnte der Petent bereits zahlen.

Hintergrund: Bürgerbeauftragter Dieter Burgard hat in der 32. Sitzung des Petitionsausschusses des Landtags Rheinland-Pfalz am 17. März 2015 über mehr als 340 Fälle berichtet, in denen er die Bürger bei Problemen unterstützte. In 80 Fällen, in denen der Bürgerbeauftragte keine einvernehmliche Lösung herbeiführen konnte, teilte der Petitionsausschuss diese Einschätzung. Sieben Anliegen wurden zu weiteren Ermittlungen zurückgestellt, um möglicherweise doch noch eine Lösung im Sinne der betroffenen Bürger zu finden.

Problems with issuing a university absolutorium - the Ombudsman asks for a lawful procedure

The absolutorium is but a certificate attesting to the completion of  the study program of a higher education institution, it is not the equivalent of a higher education degree. In order to get their degree, students having already received their absolutorium have to pass the necessary final examinations. A former student of the Corvinus University of Budapest submitted a complaint voicing displeasure at the University's Study and Examination Code setting the minimum grade point average necessary for getting an absolutorium at 3.00.

The University allows those with a lower GPA to improve their grades; however, it results in the extension of the period of studies irrespective of the fact that the students concerned have already passed all their exams.  According to the complainant requesting anonymity there are cases when the University allows students to improve their grades in a given subject only after skipping a semester.

Concluding his investigation, László Székely has pointed out that issuing the absolutorium is subject to meeting the statutory requirements which do not include any qualitative criteria, i.e., reaching a certain grade point average. The act authorizes the Government to determine the number of credits required to the successful completion of studies; however, this provision does not stipulate any conditions regarding evaluation through grading. Notwithstanding, the Government has issued a decree compelling higher education institutions to set the minimum (weighted) grade point average. Based on the above, the Commissioner has established that the Government Decree has overstepped its statutory authorization and, as a result, the provision prescribing the achievement of a minimum GPA as a precondition of issuing the absolutorium has infringed the requirement of legal certainty, leading to an impropriety.

By way of derogation from the criteria stipulated in the provisions concerning higher education, through setting additional requirements, this regulation and practice compel students to retake exams they have already passed, increasing the time spent on studies and delaying the graduates' entry on the labor market.

In order to eliminate fundamental rights-related improprieties, the Commissioner has turned to the Government and requested the Minister of Human Resources to take the necessary measures aimed at eliminating the improper regulation and practice, letting students meeting the relevant statutory requirements get their absolutorium. He has also requested the Minister to initiate a comprehensive investigation into the practices of issuing the absolutorium in all higher education institutions. Furthermore, if necessary, the Minister should draw the attention of the heads of higher education institutions to the lawful practice and, as the supervisory authority of the Corvinus University of Budapest, conduct an investigation, going back to 2005, in order to find out how many students have been adversely affected by the University's practice.
