El Justicia insta al Ayuntamiento a actuar para dar uso a solares vacíos

Die Volksanwaltschaft stellte nicht nur eine monatelange Untätigkeit der MA 35 fest, sondern teilweise auch jahrelange Verfahrensstillstände. Selbst in Verfahren, in denen alle Erteilungsvoraussetzungen schon mit der Antragsstellung erfüllt waren, setzte die MA 35 monatelang keine Schritte. In manchen Fällen dauert es von der Einbringung des Antrags bis zum allerersten Verfahrensschritt ein Dreivierteljahr. Aber auch danach kommt es zu gravierenden Verfahrensverzögerungen von bis zu mehr als zwei Jahren, in denen die MA 35 keinerlei Tätigkeiten entfaltet. Dies führt oft dazu, dass die Betroffenen erforderliche Unterlagen, wie Einkommensnachweise, mehrfach vorlegen müssen, weil diese nicht mehr aktuell sind.

Die Behörde führt als Grund für die Verzögerungen regelmäßig das hohe Kundenaufkommen und überdurchschnittliche Verfahrenszahlen an. Diese Begründungen können nicht überzeugen.

Neben der schleppenden Verfahrensabwicklung kritisiert Volksanwalt Dr. Peter Fichtenbauer auch organisatorische Mängel. So wurden trotz Zahlung der Gebühren die Aufenthaltskarten zum vereinbarten Termin nicht ausgefolgt, da die Einzahlung noch nicht im Computersystem erfasst war. Überraschend ist auch, dass die Beschwerden über Aufenthaltstitel für EU-Bürgerinnen und EU-Bürger trotz Einrichtung einer eigenen Anlaufstelle vor geraumer Zeit stark angestiegen sind. Zwar wurden in den vergangenen Jahren in der MA 35 bereits interne Evaluierungsmaßnahmen durchgeführt und Optimierungsmaßnahmen gesetzt, „die vielen berechtigten Beschwerden im Bereich der MA 35 zeigen aber eindeutig, dass weitere Anstrengungen für ein geordnetes Zuwanderungswesen in Wien unerlässlich sind“, schließt Volksanwalt Fichtenbauer.

Based on agreement with the Police President, the Defender prepared a training programme for police officers responsible for guarding persons placed in police cells. The training was aimed at fostering the prevention of maltreatment, especially in those areas where shortcomings are regularly found on the part of the Police of the Czech Republic during our systematic visits

Lectures were delivered on individual rights of persons placed in cells and the corresponding duties of police officers. Specifically, advice was provided on the rights of persons placed in cells; exercise of the right to legal assistance; notifying a third party of such placement; exercise of the right to receive medical treatment from a physician of choice; serving meals three times a day at reasonable intervals; removal of medical devices; lodging of complaints. The second part of the training provided a general introduction to fundamental rights and freedoms; international treaties on fundamental rights and their protection; the status and activities of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment, including the standards issued by the Committee; and activities and powers of the European Court of Human Rights and the binding effect of its rulings on the Czech Republic. The principles governing the possibility to bind persons in cells to a fixed piece of furniture and the use of restrictive/coercive measures in the safe environment of cells were explained using specific examples from the case-law of the European Court of Human Rights, including the legal case of Kummer v. the Czech Republic.

El Valedor do Pobo apela a la colaboración ciudadana para configurar la mayor base de datos sobre la huella audiovisual de la Ribeira Sacra a lo largo de la historia. Estas referencias de colecciones personales o particulares, tanto en vídeo como fotografía, se incorporarán al documento técnico que coordina la institución como base de la candidatura de la región a ser declarada Patrimonio de la Humanidad por parte de la Unesco. Los interesados sólo tienen que dirigir un correo electrónico la biblioteca@valedordopobo.com donde se le darán las instrucciones para poder incorporar sus referencias y las características de las colecciones a la base de datos en elaboración.

El alto comisionado parlamentario ya dirigió su respectivo escrito a los directores de la Televisión de Galicia y de la Televisión Española para poder incorporar la esa base de datos imágenes históricas sobre los primeros testimonios gráficos y audiovisuales existentes. La convocatoria está abierta a particulares, fotoperiodistas, a los principales diarios de la comunidad, ayuntamientos e incluso entidades de carácter personal.

El Valedor do Pobo firmó, el 18 de julio de 2014, un convenio de colaboración con la Deputación Provincial de Lugo y la Deputación Provincial de Ourense para la consecución del reconocimiento de la Ribeira Sacra como Patrimonio Mundial. En este convenio manifiesta su compromiso de elaborar un informe técnico de puesta en valor de la ribera en Ourense y Lugo, de la mano de un grupo multidisciplinar de expertos, y asume los deberes de coordinar y dirigir los trabajos técnicos que permitirán configurar la candidatura ante la Unesco. De acuerdo con las especificaciones técnicas de la Unesco, hace falta generar una base de datos de la huella audiovisual de la Ribeira Sacra desde sus primeros testimonios  audiovisuales, trabajo que supondrá un extraordinario interés a estos efectos.

El propósito principal consiste en documentar los registros audiovisuales de valor existentes referidos al patrimonio natural, patrimonio artístico, patrimonio cultural y agricultura. No se precisa copia de los archivos audiovisuales sino sólo su descripción y referencias acerca de las fechas, ubicación física o, en su caso, la dirección web donde esté alojado el contenido, en el caso de fuentes accesibles.
