Laut der Studie des Instituts für Pflegewissenschaft betreuen über 40.000 Kinder und Jugendliche in Österreich ein chronisch krankes Familienmitglied. Es gibt zurzeit kaum präventive Projekte und Beratungsstellen sind weit vom Wohnort der Kinder und Jugendlichen entfernt. Das Umfeld – wie Krankenhaus und Schule – ist wenig sensibilisiert. Demgegenüber werden immer mehr Menschen zu Hause gepflegt, was wiederum bedeutet, dass die Zahl der betroffenen Kinder und Jugendlichen steigt.

Die Volksanwaltschaft fordert mehr Information, um die Kinder und Jugendlichen über ihre Rechte und die betroffenen Familien über alternative Hilfe zu informieren. Volksanwältin Gertrude Brinek hat sich diesem Thema bereits engagiert angenommen. Sie hat eine altersgemäße Broschüre erarbeitet. „Junge Menschen und ihre Rechte“ informiert und stärkt das Bewusstsein von Kindern und Jugendlichen. Volksanwalt Günther Kräuter appelliert an Schulen, Sozialdienste und in Gesundheitsberufen Tätige die Lebensumstände von möglicherweise betroffenen Kindern und Jugendlichen verstärkt zu beobachten. Gegebenenfalls müsse umgehend Unterstützung sichergestellt werden.

Die negativen gesundheitlichen und sozialen Folgen für pflegende Kinder und Jugendliche sind fatal. Die körperlich anstrengende Pflege hinterlässt Spuren am kindlichen Körper und verhindert eine kindgerechte Entwicklung. Die eigene persönliche und berufliche Entwicklung wird massiv eingeschränkt. Auf selbstverständliche Dinge, wie mit Freunden weggehen oder eine Ausbildung zu machen, wird verzichtet. Die Betreuung des Familienmitglieds hat Priorität. Leider bekommt diese Situation von pflegenden Kindern und Jugendlichen derzeit noch wenig Aufmerksamkeit in der Öffentlichkeit.

The Seimas Ombudsman Mr Augustinas Normantas raisded doubts about how expediant the relaxation rooms in children socialisation centres are. However, if the decision is made that these rooms shall continue to be of use, he recommends the Minister of Sience and Education Mr. Dainius Pavalkis to take all measures to protect children rights when they are brought there.

In addition, the Seimas Ombudsman recommended minster to prevent the use of special means against children when they are put there.

After visiting children socialisation centres where the custody conditions in relaxation rooms and regulations of the placement of children in these rooms were assesed, the advisers of the Seimas Ombudsman identified that only two centers out of six do not have relaxation rooms.

A social worker and psychologist talk to a child when an uncotrolled outburst of emotions overtake him or her in Saulutė and Gruzdžiai children socialisation centres while in others children are carried directly to relaxation rooms.

One more problem was observed by the advisers of the Seimas Ombudsman. Children are brought by violating legal acts to relaxation rooms. Moreover, the use of special means such as handcuffs, tear-gas and rubber stick are used against children in Kaunas children socialisation centre.

The Seimas Ombudsman Mr. A. Normantas emphasized that according to legal acts positive conditions of socialisation, resocialisation as well as education should be ensured:

“A child may be brought to a relaxation room only when he or she poses a clear and present danger to himself or herself or others because of outburst of uncontrolled emotions. However, a placement of a child to a relaxation room is often applied as a punisment”.

Whether behaviour of a child poses a real and present threat to himself or others is not always assessed when a child is taken to a relaxation room.

What is more, the children in Vėliučionys, Vilnius as well as Kaunas children socialization centres are kept for extremely long time, sometimes even up to 24 hours, when isolation of the children should be as a last resort and its use be dicontinued as soon as possible.

The advisers of the Seimas Ombudsman learned that there are poor custody conditions in two relaxation rooms in Vėliučionys socialisation centre. Also, there is no posibility to use toilet facilities there.

“A child should never be subjected to torture or other cruel, inhuman or degrading treatment or punishment, healthy and save environment should be guaranteed for a child. The relaxation rooms should also fit these standards,” said Mr. A. Normantas.

UN Comittee against torture encouraged Lithuania to review the activity of children socialization centres where the juveniles are brought under conditions of administrative detention.

There are over 400 detention places in Lithuania, including correctional institutions, detention centers, psychiatric institutions and institutions of communicable diseases, care homes, border checkpoints, the Foreigners' Registration Centre and other places of deprivation of liberty in Lithuania.

The Law on the Seimas Ombudsmen allows the Seimas Ombudsmen to enter any social care or custodial institution at any time of the day in Lithuania. The Seimas Ombudsmen started implementing national prevention of torture in Lithuania in the beginning of 2014 when the Parliament of the Republic of Lithuania adopted the Optional Protocol (OPCAT) to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

Le Défenseur des droits, Jacques Toubon, clot l'appel à témoiganges lancé le 5 décembre dernier en direction des étudiants rencontrant des difficultés avec leurs mutuelles.

Des centaines de témoignages ont ainsi pu être recueillis entre le 5 décembre 2014 et le 5 février 2015. Ils permettront au Défenseur des droits de mieux connaître la nature des difficultés que les étudiants rencontrent avec leurs mutuelles et d’intervenir, le cas échéant, soit auprès de ces organismes, soit auprès des pouvoirs publics dans le cadre de son pouvoir de proposition de réforme.

La Defensora del Pueblo, Soledad Becerril, ha enviado un escrito al buzón abierto por la familia de Joseba Pagazaurtundua para recordar al sargento de la policía municipal de Andoain asesinado por ETA en 2003. Soledad Becerril espera que “el “Buzón de Joseba” se quede pequeño para recordar a quienes tanto debemos”.

“El recuerdo de ayer hacia Joseba Pagazaurtundua, días atrás hacia Gregorio Ordóñez, en San Sebastián, o hacia Alberto Jiménez Becerril y Ascensión García Ortiz, en Sevilla, todos asesinados por ETA, me hace pensar que estos recuerdos han sido casos excepcionales porque para la inmensa mayoría de víctimas apenas los hay. Han sido tantas las víctimas que nos hemos olvidado muchos de sus nombres, de quiénes eran o de dónde estaban. Tantas han sido, que sus breves biografías ocupan más de mil páginas en el libro denominado “Vidas Rotas”.

Aunque ahora no sea el terrorismo, en España, la primera preocupación para los ciudadanos, no deberíamos olvidar que quienes cumplen condena por los atentados cometidos ni se han arrepentido, ni han pedido perdón. Y muchos están en la calle, porque la piadosa legislación europea les ha acortado el cumplimiento de sus condenas.

Yo, que escuché a un fiscal decir a los acusados que “habían procurado hacer el mayor daño posible”, me cuento entre quienes nunca podrán olvidar. Y espero que el Buzón de Joseba se quede pequeño para recordar a quienes tanto debemos y, como decía Fernando Savater, no acabemos todos desmemoriados”.
