Soziale Fragen und Konfliktthema Ferienwohnen 2014 vorne – Mehr Bürger suchten Unterstützung des Bürgerbeauftragten

Einen ersten Überblick über seine Arbeit im Jahr 2014 gab heute der Bürgerbeauftragte Matthias Crone. Die Zahl der Anfragen an den Bürgerbeauftragten nahm im letzten Jahr im Vergleich zum Vorjahr weiter zu. Insgesamt gingen 1637 neue Petitionen und Anfragen ein – das sind 86 mehr als 2013. Davon sind 68% mündlich, d. h. telefonisch oder persönlich an den Bürgerbeauftragten herangetragen worden. Rund 53 % betrafen soziale Angelegenheiten.

Eingaben zu Belangen der Menschen mit Behinderungen haben 2014 stark zugenommen. Der Bürgerbeauftragte führt dies auf ein wachsendes Bewusstsein für die Teilhabe von Menschen mit Behinderungen zurück, aber auch auf bleibende oder wachsende Probleme: „Sehr oft geht es um Betreuungssituationen in Einrichtungen, Schulen und Heimen. Klar ist: Ohne vernünftige Betreuungsschlüssel, etwa in den Wohnheimen, geht es nicht. Hier müssen alte Regeln angepasst werden. Das gilt auch bei Pflegeheimen, die mit knappen Entgeltsätzen kämpfen.“

Maßnahmen gegen die Nutzung von Ferienwohnungen im Landkreis Rostock haben zu einer Welle von Beschwerden auch beim Bürgerbeauftragten geführt. Die Ostseegemeinden versuchen nun, durch Bauleitplanung die Situation für das Ferienwohnen zu ordnen. Dazu Crone: „Das ist der richtige Weg. Dabei darf der Landkreis aber nicht durch überzogene Aufsichtsmaßnahmen in den Planungsprozess grätschen. Mir fehlt die Rücksicht auf die planenden Gemeinden. Mir fehlt die Unterscheidung im Einzelfall. Ich vermisse Lösungsbereitschaft. Was ich aber finde, ist Blockierung und Unbeweglichkeit.“ Er werde daher jetzt von seinem gesetzlichen Empfehlungsrecht Gebrauch machen. „Ich bin zuversichtlich, dass mich die oberste Bauaufsicht in diesen Fällen unterstützen wird“, so Crone.

Auch Eingaben zur Vollverpflegung in Kitas erreichten zum Jahresende den Bürgerbeauftragten. Crone: „Der ‚Benutzungszwang‘ für die Kita-Vollverpflegung mit der von einigen Trägern geplanten Pauschalabrechnung stieß auf Protest. Hier sollten alle Beteiligten aber gesprächsbereit sein.“ Es sei nicht richtig, kritischen Eltern mit Kündigung der Betreuungsverträge zu drohen. „Es bleibt in der Situation nur, Verbesserungen im Detail zu suchen.“

FRA speaks on cooperation with Council of Europe in the wake of Paris attacks

The terrorists killed 17 people, they attacked the free press and basic human rights. They increased fear in the Jewish and their own Muslim community and injected anxiety into the general population. In light of this attack the continued collaboration between FRA, the Council of Europe and other human rights actors is particularly important.”

FRA Director Morten Kjaerum spoke at a meeting of the Council of Europe’s Committee of Ministers’ rapporteur group on external relations. He pointed out that FRA will be conducting the fieldwork for its second large-scale survey of ethnic minorities in the EU this year, allowing the Agency to identify trends over a longer period. This is crucial for formulating targeted policy to combat xenophobia, hate crime, discrimination and social exclusion. The findings will feed into many aspects of the Council of Europe’s work.

With security issues at the fore of political and popular debate in the wake of the Paris attacks, FRA’s Director said that new strategies were needed to prevent radicalisation and extremism. At the same time, “we cannot defend human rights against terrorists by restricting freedoms or justice, or by allowing discrimination and racism against certain religions or minorities to persist or even increase. We therefore need longer-term and sustainable cohesion policies that can help to overcome the barriers and often increasing alienation in our societies.

The issue of social exclusion was also mentioned, with the economic crisis in Europe resulting in falling pensions, increasing homelessness and higher unemployment, threatening Europeans’ social and economic rights. Greater poverty has contributed to the current crisis of trust in democratic institutions, as well as proving fertile ground for populist movements.

Speaking at the same meeting, FRA Management Board Chairperson Maija Sakslin emphasised that cooperation between FRA and the Council of Europe “is more vital than ever to combat the ongoing, and in some places worsening, fundamental rights violations in the EU and beyond.

Council of Europe representatives present agreed that cooperation with FRA was excellent and should be enhanced further. The necessity of combating hate crime, antisemitism and Islamophobia was discussed, as well as the need for a critical examination of migrant integration measures and areas in which efforts should be stepped up.

FRA recently launched a new project on the social and political inclusion of migrants and their descendants. This aims to develop indicators for monitoring inclusion and democratic participation, an issue that is presently of special relevance.

The Commissioner for Education, Professor Charles Farrugia met the Malta College of Arts, Science and Technology (MCAST) newly elected students’ council to discuss ways of collaboration between the Council and his office.

During the meeting, the students’ representatives mentioned a number of ideas and issues that they would like to discuss further with the Commissioner. The Commissioner extended his commitment to assist them and to ensure that students who wish to submit complaints can do so in an easy and straightforward manner.

The Parliamentary Ombudsman, Chief Justice Emeritus Joseph Said Pullicino together with the Commissioner for Environment and Planning, Perit David Pace met the Malta Environment and Planning Authority (MEPA) Chairman Perit Vincent Cassar and CEO Mr Johann Buttigieg.

During the meeting both sides discussed the procedures governing investigations and how the relationship between the Parliamentary Ombudsman and MEPA can be strengthened.

The Commissioner for Environment and Planning will continue to follow up the matters discussed during his regular meeting with MEPA.
