Ombudsman: "Further steps to increase TTIP transparency necessary"

The European Ombudsman, Emily O'Reilly, while welcoming the real progress by the European Commission, has made a series of recommendations on how to further increase the transparency of the on-going Transatlantic Trade and Investment Partnership (TTIP) negotiations with the US. The recommendations relate to public access to consolidated negotiating texts, greater proactive disclosure of TTIP documents and increased transparency as regards meetings that Commission officials hold on TTIP with business organisations, lobby groups or NGOs.

Emily O'Reilly stated: "The Commission has made real efforts to make the TTIP negotiations more transparent. I am aware that the Commission at times needs to talk to the US confidentially to be able to negotiate effectively. However, US resistance to publishing certain TTIP documents is not in itself sufficient to keep them from the European public. The Commission has to ensure at all times that exceptions to the EU citizens' fundamental right to get access to documents are well-founded and fully justified."

Lobbying transparency also for Commission directors, heads of units, negotiators

The Ombudsman's investigation into the transparency of the TTIP negotiations, opened in July 2014, was triggered by concerns about key documents not being disclosed and about the alleged granting of privileged access to certain stakeholders.  She received more than 6000 emails in reply to her public consultation on this matter. Taking into account the Commission's first steps to increase TTIP transparency, as well as the contributions to her public consultation, the Ombudsman concluded that further steps are needed to increase the legitimacy of the negotiations in the eyes of the public. She, therefore, calls on the Commission to establish a comprehensive list of public and non-public TTIP documents and for greater proactivity concerning the publication of documents, including agendas and minutes of meetings with lobbyists.

The Ombudsman also calls on the Commission to extend the transparency obligations as regards meetings with stakeholders to the levels of Commission directors, heads of units, and negotiators. EU officials involved in the TTIP negotiations should only meet with interest representatives who are registered in the Transparency Register.

La Médiatrice demande des mesures supplémentaires pour accroître la transparence du TTIP

Bien que la Médiatrice européenne Emily O'Reilly salue un réel progrès de la Commission européenne, elle a soumis une série de recommandations sur la manière de continuer à accroître la transparence des négociations en cours sur le Partenariat transatlantique de commerce et d'investissement (TTIP en anglais) avec les États-Unis. Les recommandations concernent l'accès du public aux textes de négociations consolidés, une divulgation plus proactive des documents du TTIP et une transparence accrue concernant les réunions entre les fonctionnaires de la Commission  et des associations d'entreprises, des groupes de lobbys ou des ONGs.

Emily O'Reilly a déclaré: "La Commission a fait de réels efforts pour rendre les négociations sur le TTIP plus transparentes. Je suis consciente que la Commission doit parfois s'entretenir de manière confidentielle avec les États-Unis afin de pouvoir négocier efficacement. Toutefois, la réticence des États-Unis à publier certains documents du TTIP n'est pas en soi une raison suffisante pour évincer le public européen. La Commission doit, à tout moment, s'assurer que les exceptions au droit fondamental des citoyens européens à l'accès aux documents sont bien fondées et entièrement justifiées."

La transparence du lobbying aussi pour les directeurs de la Commission, les chefs d'unités et les négociateurs

L'enquête de la Médiatrice sur la transparence des négociations du TTIP, ouverte en juillet 2014, a été déclenchée par des inquiétudes sur la non-divulgation de documents clés et du fait qu'un accès privilégié aurait été donné à certaines parties prenantes. La Médiatrice a reçu plus de 6 000 courriels en réponse à sa consultation publique sur ce sujet. Le rapport de cette consultation est disponible ici.

Sur la base des premières mesures prises par la Commission pour accroître la transparence du TTIP,  et aussi des contributions à sa consultation publique, la Médiatrice a conclu que des mesures supplémentaires sont nécessaires pour renforcer la légitimité des négociations aux yeux du public. Par conséquent, elle appelle la Commission à établir une liste complète des documents publics et non-publics relatifs au TTIP ainsi qu'à une proactivité plus grande concernant la publication de documents, y compris les agendas et comptes-rendus des réunions avec les lobbyistes.

La Médiatrice demande aussi à la Commission d'étendre les obligations de transparence aux réunions avec les parties prenantes qui se tiennent aux niveaux des directeurs de la Commission, des chefs d'unité et des négociateurs. Les fonctionnaires de l'UE impliqués dans les négociations sur le TTIP ne devraient pas rencontrer des groupes d'intérêts non enregistrés dans le registre de transparence.

Gleichzeitig hat sie die Fortschritte begrüßt, die die Kommission bereits gemacht hat. Die Empfehlungen betreffen den Zugang zu konsolidierten Verhandlungstexten, mehr proaktive Veröffentlichungen von TTIP-Dokumenten und mehr Transparenz bei TTIP-Treffen zwischen Kommissionsbeamten und Wirtschaftsvertretern, NGOs und anderen Lobbyisten.

Emily O'Reilly erklärte: "Die Kommission hat echte Anstrengungen unternommen, um die TTIP-Verhandlungen transparenter zu machen. Mir ist klar, dass die Kommission bisweilen auf Vertraulichkeit angewiesen ist, um effektiv mit den USA zu verhandeln. Amerikanischer Einspruch gegen die Veröffentlichung bestimmter TTIP-Dokumente allein ist jedoch kein ausreichender Grund, sie der europäischen Öffentlichkeit vorzuenthalten. Die Kommission muss jederzeit sicherstellen, dass Ausnahmen zum Grundrecht der EU-Bürger auf Zugang zu Dokumenten gerechtfertigt und gut begründet sind."

Lobby-Transparenz auch für Kommissions-Direktoren, Abteilungsleiter, Verhandlungsführer

Die Untersuchung der Ombudsfrau zur Transparenz der TTIP-Verhandlungen wurde im Juli 2014 durch Kritik an der Verweigerung wichtiger Dokumente und daran, dass bestimmte Interessensgruppen angeblich privilegierten Zugang zu TTIP-Dokumenten erhalten, ausgelöst. Sie erhielt im Rahmen ihrer öffentlichen Konsultation zu dem Thema mehr als 6000 E-Mails. Der Bericht über diese Konsultation ist hier erhältlich.

Die Ombudsfrau hat die ersten Maßnahmen der Kommission zur Verbesserung der TTIP-Transparenz und die Beiträge zur öffentlichen Konsultation analysiert und ist zu dem Schluss gekommen, dass weitere Schritte nötig sind, um die Legitimität der Verhandlungen in der Bevölkerung weiter zu verbessern. Sie fordert die Kommission deshalb dazu auf, eine vollständige Liste über veröffentlichte und nicht-veröffentlichte TTIP-Dokumente zu erstellen. Außerdem müsse sie aus eigener Initiative mehr Dokumente veröffentlichen. Das gelte auch für Tagesordnungen und Protokolle über Treffen mit Lobbyisten.

Die Ombudsfrau ruft die Kommission auch dazu auf, die Transparenz-Verpflichtungen bei Treffen mit Interessensvertretern auf Kommissions-Direktoren, Abteilungsleiter und Verhandlungsführer auszuweiten. EU-Beamte, die an den TTIP-Verhandlungen beteiligt sind, sollten sich nur mit Interessensvertretern treffen, die im Transparenz-Register aufgeführt sind.

A teacher's freedom of speech was violated by the City of Tampere

A reprimand for the violation of a teacher's freedom of speech was issued to the headmaster of a school in Tampere by Parliamentary Ombudsman Petri Jääskeläinen.
Jääskeläinen also requests the City to consider how the violation of freedom of speech resulting from a written warning could be redressed and how the teacher could be compensated. 
In April 2013, the City had issued the teacher a written warning for having contributed to a discussion on mental health work at schools in the newspaper Aamulehti. His writing was regarded as having a negative impact on the school's working atmosphere and wellbeing at work.

The teacher asked the Parliamentary Ombudsman to investigate whether or not the warning was appropriate.

The Parliamentary Ombudsman finds that the issuing of the warning was a violation of the complainant's freedom of speech and thus also constituted a breach of the European Convention on Human Rights and the Finnish Constitution. According to Jääskeläinen, the teacher's employer had failed to find a balance between a public servant's freedom of speech and duty of loyalty.

The City was asked to report to the Parliamentary Ombudsman on the actions taken as a consequence of his proposal by 16 February 2015.

Warning issued for inappropriate action

In his writing sent to Aamulehti, the teacher had expressed concern over the manner in which professional educators who are unsuited for the profession exacerbate the problems experience by young people, without anyone's intervention in the problem.
 
The letter asked, "to what extent are the anxieties of a young person struggling with growing pains increased by a teacher or a guidance counsellor with a personality disorder who acts illogically and makes the students pay for his or her own mistakes?" The headmaster of the school felt that the teacher had publicly criticised the actions of his colleagues and undermined the trust between guardians and teachers. The other public servants of the City also put forward similar justifications for the issuing of the warning in information provided by them.

The teacher was entitled to publish his critical views

The Parliamentary Ombudsman considers that the teacher had a right to make public his concerns and critical views concerning problems in his branch of administration. The writing continued a discussion on children's welfare, to which the complainant contributed a new viewpoint.

- Children's welfare at school is a topic of high societal importance. The threshold  must be high when it comes to intervening in writings and articles that concern topics of important public interest, says Jääskeläinen.

No specific school, teacher or guidance counsellor was identified in the writing. Jääskeläinen finds that the criticism directed at a teacher and a guidance counsellor concerned them as public servants not as private persons. Using negative adjectives to describe them in the writing was unavoidable for the writer to get his message across. In the right context, even scathing words are permissible.

The Parliamentary Ombudsman considers that the statements about the teacher's employer also were criticisms bringing up problems that could not be used as a justification for issuing a warning. The writing did not cause significant damage to the school's reputation. Neither did the warning clearly question the writer's motives.

- The fact that a letter may be embarrassing to the employer and result in parents contacting the school alone is not sufficient grounds for interfering with the freedom of speech. Even when assessing the limits of public servants' freedom of speech, the aim must be at reinforcing fundamental rights.

"When a professional educator is the weakest link", a writing published in Aamulehti on 3 April 2013 and 8 April 2013

"The article published in the Näkökulma column was a brave and open description of a school psychologist's work (AL 29 March). Professionals of the mind have a significant role in supporting the students in the results-oriented and fast-paced world of the school, but there is one phenomenon that leaves even them powerless: professional educators who are unsuited for the profession.

To what extent are the anxieties of a young person struggling with growing pains increased by a teacher or a guidance counsellor with a personality disorder who acts illogically and makes the students pay for his or her own mistakes?

In practice, an unsuitable adult may hold a post at school for years without any intervention in the problem. The complaints of students and parents fall on deaf ears as the teacher's colleagues stay silent and superiors cover it all up, since the most important objective of the school is to preserve a clean and shiny façade and attract a steady influx of students. Not even the employer's lawyers have the courage to attack a public servant in the teaching sector if no clear official misconduct can be proven.

In case of a mentally unstable professional educator, the greatest sufferers are the same quiet youngsters who also fail to be noticed at home. When there is room for improvement in the school, the best student is a silent student.

As the academic years roll by, the stakes become higher, and in the worst case an anxious student in need of mental support is sent in a wrong direction in his or her further studies. It is immoral to claim that the best comprehensive school in the world did everything it could for that student."
