After a visit to Alytus Correction House, the Seimas Ombudsman criticised its authority

 MG 7266There is not enough space for inmates in wheelchairs to move freely within the cells. The bathrooms are too narrow, and the stairs leading to a canteen and library as well as the odontologist, family doctor and psychologist are not adjusted for the use of people with disabilities. The Seimas Ombudsman Augustinas Normantas released these findings after a visit to Alytus Correction House.

Having assessed the human rights situation in Alytus Correction House, the Seimas Ombudsman Mr. A. Normantas noted that there was a noticeable shortage of wheelchairs and other movement-compensation equipment for people with disabilities. Moreover, there were no bathroom safety rails in showers to facilitate the mobility of individuals with disabilities so they could perform their hygiene procedures independently.

The employees of the Human Rights Division of the Seimas Ombudsmen's Office have also established that there was a lack of seats in prison yards for inmates with disabilities. Therefore, prisoners who had mobility challenges and had to move with walkers or walking sticks or crutches did not have a place to sit down and have rest.

Furthermore, Mr. A. Normantas drew attention to the fact that privacy in the hygiene facilities for inmates with disabilities was not ensured in Alytus Correction House.

“The cleanliness and adequate ventilation were not sufficient in lavatories and shower-baths. Moreover, water taps, shower mixers, their handles and toilet flush mechanisms did not operate or were damaged,” noted the Seimas Ombudsman.

The president of the Association “Lithuanian Disability Forum,” Mrs. Dovilė Juodkaitė, who conducted the inspection in cooperation with the employees of the Seimas Ombudsmen's Office as an independent expert, highlighted another important and unresolved problem in imprisonment institutions:

“The Health Service Department may not be able to provide all health care services to the imprisoned people because of the vacant or partially occupied positions of medical professionals in Alytus Correction House.”

Furthermore, the employees of the Human Rights Division of the Seimas Ombudsmen's Office noted that health care services were planned to be provided in violation of legal acts regulating the provision of such services.

“First of all, Alytus Correction House does not have a license to provide services of a family doctor and psychiatrist. Secondly, a therapeutist provides medical services that are not established in his

license. Thirdly, the health care services must be provided in compliance with legal acts regulating such services,” the Seimas Ombudsmen noted in his recommendations.

The Seimas Ombudsman has also placed emphasis on the need to adjust the physical environment of imprisonment facilities to the needs of inmates with disabilities.

Finally, the Seimas Ombudsman recommended to the head of the Prison Department to ensure that the number of health service employees in Alytus Correction House meets the number specified in the Health Care Services Standards.

Ombudsman meets with Local Authority executives to highlight complaints

Irish Ombudsman Peter Tyndall met with the representative body of the Chief Executives of local authorities in Ireland (the County and City Managers Association) on Tuesday 30 August. At the meeting the Ombudsman shared his experience of dealing with complaints in the local authority sector. The Ombudsman also discussed the development of a single complaints portal to make it easier for the public to make complaints about the local authority sector and all public service providers. At the meeting the Ombudsman distributed copies of a Model Complaints Policy developed by his office and a special edition of The Ombudsman's Casebook containing summaries of local authority cases examined by the Ombudsman.

El Defensor del Pueblo pide mayor flexibilidad para que los artistas y creadores puedan seguir creando y cobrar la jubilación

La institución ha iniciado actuaciones tras recibir un caso particular y la Administración de la Seguridad Social respondió indicando que la actividad de creación se considera incompatible con la percepción de la pensión cuando genera ingresos anuales superiores al Salario Mínimo Interprofesional (SMI). Cuando se detecta esta situación se inicia un expediente sancionador con requerimiento del pago de la cotizaciones al régimen de autónomos (RETA).

La Plataforma “Seguir Creando” se dirigió también a la Institución poniendo de manifiesto las serias consecuencias de esta situación para el futuro de la creación.

El Defensor del Pueblo considera que esta incompatibilidad constituye un desincentivo a la labor creadora y se compagina mal con la previsión del artículo 20 de la Constitución, que reconoce y protege los derechos a la producción y a la creación literaria, artística, científica y técnica.

Para la Institución “la labor de creación … no sólo constituye un bien particular del creador, sino que también supone una contribución al conjunto de la sociedad y a su desarrollo cultural”. Por ello, considera que existe un interés en facilitar su continuidad y en no poner en peligro la aportación a la cultura de personas que estén en edad de jubilación y perciban una prestación de ese carácter.

El criterio mantenido por la Administración hace que los creadores tengan que elegir entre seguir con su actividad o percibir la pensión de jubilación, lo que no resulta razonable. Por eso la institución aboga porque, mientras no se flexibilice la plena compatibilidad, se haga una interpretación de las normas que asegure que los interesados no queden por el hecho de continuar su actividad creadora en una situación económica más desfavorable que si tuvieran dicha actividad pero no generara ingresos superiores al límite del SMI.

El Defensor del Pueblo apunta varias posibles opciones para mejorar la actual situación: detraer las cotizaciones sociales del límite a partir del cual se declara la incompatibilidad, establecer una cantidad mínima de garantía que evite la retirada de la pensión completa, admitir la posibilidad de regularizar la situación a posteriori.

En resumen, mayor flexibilidad para cobrar la pensión y trabajar, pues la actual regulación hace muy difícil poder acogerse a ella. Esto último no debería limitarse a creadores, sino tener un alcance más general.

A ottobre riparte la formazione della Rete contro le discriminazioni nelle Marche

Facendo seguito alle numerose richieste in tal senso, il Centre for Applied Transcultural Research at University of Urbino ad ottobre organizzerà (per conto del Garante Regionale) dei percorsi formativi sui temi della discriminazione per formare nuovi Nodi e per arricchire l'esperienza di quelli già esistenti. Siamo interessati anche alla formazione di operatori di sindacati e patronati, per allargare la Rete Regionale in quella direzione.
