Zu einem Erfahrungsaustausch trafen sich die Thüringer Ministerin für Arbeit, Soziales, Gesundheit, Frauen und Familie Heike Werner und der Bürgerbeauftragte Dr. Kurt Herzberg im Thüringer Sozialministerium. Es wurden dabei grundsätzliche Fragen der Zusammenarbeit erörtert sowie Klärungen zu einigen Einzelanliegen herbeigeführt.

Como presidente del IOI Europa, ha solicitado información al Ombudsman de Turquía y le ha ofrecido su apoyo y colaboración

El síndic de greuges de Cataluña, Rafael Ribó, en calidad de presidente del capítulo europeo del Instituto Internacional del Ombudsman (IOI) se ha dirigido al Ombudsman de Turquía y le ha ofrecido su apoyo a la vista de la convulsa situación que vive su país.

Ribó considera muy grave la reciente derogación del Convenio europeo de derechos humanos en Turquía como consecuencia de la declaración del estado de emergencia por parte del Consejo de Ministros turco, el pasado 20 de julio. Consciente de que la función de los ombudsman es garantizar el respeto a los derechos humanos, el síndic cuestiona que un golpe de estado fallido constituya una “emergencia pública que amenace la pervivencia de la nación” en los términos del artículo 15 del Convenio europeo. Ha puesto como ejemplo el precedente establecido por la Comisión Europea de Derechos Humanos en su informe sobre el golpe de estado griego de 1967.

Así, ha preguntado a su homólogo turco si realmente las medidas adoptadas por el Gobierno del país, por las cuales se derogan sus obligaciones en lo que respecta al cumplimiento del Convenio, se están activando “sólo hasta el punto estricto en que lo requieran las exigencias de la situación”. También ha solicitado información sobre la veracidad de las noticias publicadas y si algunas de estas medidas, como la expulsión masiva de centenares de miembros de la judicatura, pueden ser desproporcionadas y coartar el derecho a un juicio justo. Así mismo, las limitaciones a la privacidad (art. 6), a la libertad de expresión y de información (art. 9 y 10) o a la libre circulación de personas (protocolo 4) se deberían adoptar de manera individual, y sólo en caso de estar estrictamente justificadas por las exigencias de la situación.

Finalmente, el Síndic ha pedido información sobre posibles vulneraciones de derechos que, de acuerdo con el Convenio, no se pueden derogar bajo ninguna circunstancia, como la prohibición de la tortura. En cuanto a las declaraciones del presidente Erdogan, que ha anunciado una posible reinstauración de la pena de muerte, Ribó destaca que sería una medida incompatible con los protocolos 6 y 13, que se incluyen entre aquellos que no se pueden derogar bajo circunstancia alguna.
 

As President of the IOI Europe, Ribó has requested information from the Turkish Ombudsman and has offered him his support and co-operation

The Catalan Ombudsman, Rafael Ribó, as President of the European chapter of the International Ombudsman Institute (IOI), has offered his support to the Turkish Ombudsman regarding the situation of unrest that the country is currently facing.

In Ribó's opinion, the recent suspension of the European Convention on Human Rights in Turkey as a result of the declaration of state of emergency by the Turkish Council of Ministers on 20 July is a very serious matter. Taking into account that the role of ombudsmen is to ensure that human rights are respected, the Catalan Ombudsman questions whether a failed coup d'état constitutes a "public emergency threatening the life of the nation" in terms of article 15 of the European Convention. He has given as an example the precedent established by the European Commission of Human Rights in its report on the Greek coup d'état of 1967.

Therefore, he has asked his Turkish counterpart if the measures taken by the Government, which derogate its obligations regarding the implementation of the Convention, are really being activated "to the extent strictly required by the exigencies of the situation". He has also asked about the veracity of the news that have been published and whether some of these measures, such as mass expulsion of hundreds of members of the Judiciary, may be disproportionate and restricting the right to a fair trial. Also, the limitations to privacy (art. 6), freedom of expression and information (art. 9 and 10) or freedom of movement (protocol 4) should be adopted individually and only if they are strictly justified by the exigencies of the situation.

Finally, the Catalan Ombudsman has requested information on possible violations of rights that, under the Convention, cannot be derogated under any circumstance, including the abolition of torture. As for the statements of President Erdogan, who has announced a possible reintroduction of the death penalty, Ribó highlights that this measure would be incompatible with protocols 6 and 13, included among those who cannot be derogated under any circumstance.
