After holding consultation days in Vorarlberg and Tyrol Ombudsman Guenther Kraeuter followed an invitation from the South Tyrol Ombudsman this week. As part of a public event in Bolzano Kraeuter presented the Austrian institution and explained the main tasks of the International Ombudsman Institute (IOI).
Of special interest was the Austrian OPCAT mandate of the Ombudsman to both the event participants and media representatives. Issues such as human rights protection on the run or the situation of ombudsmen under political pressure were discussed in the presence of some members of the South Tyrolean federal state parliament.
Kraeuter: "The cooperation and networking of ombudsmen is of decisive importance for important cross-border protection of human rights and the protection and the development of democratic principles." The South Tyrolean Ombudsman is also a member of the IOI since of 2009.

Nach den Sprechtagen in Vorarlberg und Tirol nahm Volksanwalt Günther Kräuter diese Woche eine Einladung der Südtiroler Volksanwaltschaft wahr. Im Rahmen einer öffentlichen Veranstaltung in Bozen stellte Kräuter die österreichische Institution vor und erläuterte die Hauptaufgaben des International Ombudsman Institute.
Besonderes Interesse fand das österreichische OPCAT-Mandat der Volksanwaltschaft, sowohl bei den Veranstaltungsteilnehmern als auch den anwesenden Medienvertretern.
Themen wie Menschenrechtsschutz auf der Flucht oder auch die Situation von Ombudseinrichtungen unter politischem Druck wurden unter Anwesenheit von einigen Abgeordneten des Südtiroler Landtages intensiv diskutiert.
Kräuter: "Die Zusammenarbeit und Netzwerkbildung der Ombudseinrichtungen ist von entscheidend wichtiger Bedeutung zum grenzüberschreitenden Schutz von Menschenrechten und der Bewahrung sowie dem Ausbau demokratischer Grundsätze."

After visiting social care institutions in Klaipėda and Šiauliai districts, the Seimas Ombudsman Augustinas Normantas came to a conclusion that a lack of privacy in elderly homes is the most significant problem.
“There are still many walking straight into residents' rooms without knocking and they are not allowed locking the doors from inside. Moreover, there is not enough private space in the residents' rooms and there are no lockers for personal belongings. Sadly, medical check-ups are undertaken in front of strangers and without using folding screens to provide temporary privacy,” the Seimas Ombudsman A. Normantas highlighted in his report.
There is limited attention paid towards promotion of healthy ageing of elderly. Self-management is not encouraged either: “Residents are not encouraged to use cutlery. Also, a focus on regaining physical ability is poor.”
The employees of the Human Rights Division of the Seimas Ombudsmen's Office's have established that the non-qualified personnel dispense medicines in social care institutions. What is more, there are numerous establishments where nurses are absent on weekends and holidays and during that time their functions are fulfilled by the non-qualified personnel.
Further, the Seimas Ombudsman noted, that medical records on health progress of residents are poorly or improperly managed in some entities: “Many institutions still use drugs after their expiration date.”
Another significant problem is non–existence of individual social care plans. In several nursing homes, they are drawn up for residents without an assessment of their needs or are developed even in absence of the residents. Further, the progress of health status of elderly people is poorly recorded in individual social care plans.
“These plans should be developed following specific needs of residents by devoting more time talking to them,” the Seimas Ombudsman remarked in his report.
The Seimas Ombudsman has also placed emphasis on the importance of an appropriate health data management, including data collection and storage. Among provided recommendations, the need to encourage individuals living in social care facilities to use crockery and cutlery and prepare meal for themselves was highlighted.
In the opinion of the Seimas Ombudsman, the managers of institutions should seek to make the environment of residential rooms similar to that at home.
“Residents also should have a possibility to individualise their quarters and keep personal belongings safe there. Moreover, privacy in hygiene premises is a must,” noted A. Normantas.
In the course of the visits to social care institutions, several human rights violations concerning safeguarding privacy were established. The Seimas Ombudsman recommended the Department of Supervision of Social Services to prepare guidelines for the managers on assurance of privacy by imposing the duties on personnel to safeguard privacy of the residents.

Se ha dirigido a los ayuntamientos afectados, a la empresa concesionaria y a la ACA para conocer las actuaciones llevadas a cabo para garantizar el suministro de agua bebible
También ha solicitado información sobre la posible compensación a las personas afectadas
El Síndic de Greuges de Cataluña ha abierto una actuación de oficio a raíz de las informaciones publicadas según las cuales 12.000 vecinos de La Bisbal d'Empordà y Forallac no pueden beber agua del grifo ni utilizarla para cocinar desde el 7 de agosto a consecuencia de un exceso de herbicidas.
En un control de calidad de finales de julio la empresa gestora del suministro, SOREA, detectó una concentración de productos fitosanitarios en la red de abastecimiento público de agua por encima de la concentración máxima permitida. El pasado 7 de agosto el alcalde de La Bisbal d'Empordà hizo público un bando en el que se comunicaba a la población que el agua no era apta para beber ni cocinar.
Mientras dura esta situación, el Ayuntamiento de la Bisbal d'Empordà ha establecido unos puntos de abastecimiento de agua bebible a los cuales se suma la ayuda de un camión cisterna a partir del 16 de agosto.
Este episodio de contaminación del agua afecta también al Ayuntamiento de Forallac.
Dado que el acceso a agua bebible es un derecho humano esencial para el pleno disfrute de la vida y un servicio básico, el Síndic ha abierto una actuación de oficio para analizar la situación, la actuación de las administraciones implicadas y de las empresas competentes.
En este sentido, desde la perspectiva medioambiental, el Síndic solicitará información sobre las causas y el origen de la contaminación del agua y, desde la perspectiva del consumo, sobre las actuaciones llevadas a cabo por los ayuntamientos, la empresa concesionaria y la Agencia Catalana del Agua (ACA) para garantizar el suministro de agua bebible a los vecinos, ya sea de manera transitoria o permanente, una vez resuelto el episodio de contaminación. También se pedirá información sobre si se prevé la posibilidad de compensar a las personas afectadas por un servicio del que no han podido disfrutar plenamente.
