Ante las deficiencias de coordinación y de comunicación detectadas, destaca que es necesario el compromiso firme de llevar a la práctica el protocolo

El síndic de greuges, Rafael Ribó, ha comunicado al Parlamento su voluntad de comparecer ante la Cámara para exponer la información y conclusiones extraidas de la investigación abierta sobre el caso de los abusos sexuales denunciados en la escuela Maristes. Según el síndic, dada la gravedad y la repercusión de los hechos es importante que estos sean abordados por el espectro político con el máximo rigor.

El síndic ha comparecido ante los medios de comunicación después de la segunda reunión convocada este jueves 31 de marzo en la sede de la institución con todas las partes que hace cerca de diez años firmaron el Protocolo Marco de actuaciones en casos de abusos sexuales y otros malos tratos graves a menores. Al encuentro han asistido los responsables de los departamentos de Enseñanza, de Trabajo, Asuntos Sociales y Familias, de Justicia, de Interior y de Salud. También han participado la Fiscalía, el Tribunal Superior de Justicia, y la Delegación del Gobierno en Cataluña. La primera reunión tuvo lugar el pasado día 17 de febrero.

El Síndic ha apelado de nuevo al compromiso firme y a la voluntad indiscutible de las administraciones e instituciones de llevar el protocolo a la práctica y aplicarlo cuando sea necesario. Sin esta voluntad decidida de nada sirven los esfuerzos para sistematizar los procesos de actuación de acuerdo con el interés superior del menor.

Los hechos acontecidos ponen de manifiesto la necesidad de desarrollar y aplicar el protocolo con la máxima celeridad posible, dado que actualmente se siguen constatando graves dificultades tanto para la detección de este tipo de malos tratos como para la coordinación de las diferentes entidades y administraciones para garantizar la protección de los niños que se puedan encontrar afectados.

Il “Garante dei diritti” sempre più vicino ai cittadini

Soprattutto “Garante dei diritti di adulti e bambini” e non solo Ombudsman. Andrea Nobili sceglie di rimodellare la definizione corrente della sua figura istituzionale, perché “essere più vicini ai cittadini – motiva così la decisione - vuol dire anche rapportarsi con loro usando termini di facile comprensione, semplici, immediati, capaci di trasmettere la poliedricità delle mansioni svolte nella loro vera essenza: il rispetto e la tutela dei diritti”.

L’annuncio arriva nel corso della conferenza stampa per la presentazione del lavoro svolto nel 2015 e della programmazione per il 2016.

Un ampio ventaglio di riflessioni e proposte, su cui si sofferma anche il Presidente del Consiglio, Antonio Mastrovincenzo, evidenziando come le Marche ed in Veneto siano le sole due Regioni che riconducono ad una sola autorità di garanzia i diversi ambiti d’intervento.

“Il ruolo del Garante – prosegue – va sempre più valorizzato, considerando anche che è in stretto contatto con i cittadini maggiormente in difficoltà e con quelli che devono essere più tutelati. Un obiettivo, questo, che deve essere perseguito da tutto il Consiglio regionale”.

Il Presidente ha anche ricordato alcune iniziative degli ultimi mesi, come il giro di visite negli istituti penitenziari marchigiani – al termine del quale è stata approvata dall’Assemblea legislativa una mozione inviata al competente Ministero - e la sottoscrizione del protocollo con l’Anci per la difesa civica nei Comuni.

Nel corso del 2015, anno del passaggio di consegne tra Italo Tanoni ed Andrea Nobili in carica dal 22 settembre, sono stati chiusi 176 casi (a fronte dei 175 portati a compimento dal 2011 al 2014), riguardanti in larga parte i settori della difesa civica, dell’infanzia e dei detenuti. Crescenti, rispetto agli anni precedenti, le richieste d’intervento per quanto riguarda il contrasto alla discriminazione nei confronti dei cittadini stranieri immigrati, dato che il Presidente Mastrovincenzo ha segnalato come “molto preoccupante” e meritevole di una doverosa riflessione.

Nel contesto generale, la maggior parte delle istanze sono arrivate dalla provincia di Ancona, seguita da quelle di Pesaro, Ascoli Piceno, Macerata, Fermo e da fuori regione. Per tutti i casi viene evidenziato un tasso di definizione sostanzialmente positivo.

Come positiva è la valutazione dei progetti portati avanti nei diversi settori, alcuni già chiusi, altri che verranno riproposti nel 2016, altri ancora che attendono una ridefinizione in base alle mutate esigenze del momento.

L’attenzione maggiore è ora rivolta al futuro, “tenendo conto – sottolinea Nobili – che la liquidità delle relazioni, l’incertezza che caratterizza le nostre vite, il multiculturalismo che connota piazze e scuole sono alcuni tra gli elementi costitutivi del presente e che animano il nostro orizzonte”.

Numerosi i progetti nei diversi settori di competenza, a partire dalla difesa civica, che vedrà concretizzarsi le finalità della Convenzione con Anci Marche, offrendo alle amministrazioni comunali la possibilità di avvalersi del supporto del Garante.

Come ha evidenziato lo stesso Nobili, inoltre, con la prossima, definitiva approvazione da parte del Senato della proposta di legge concernente “Disposizioni in materia di responsabilità professionale del personale sanitario”, l’attività della difesa civica sarà notevolmente incrementata in quanto il provvedimento legislativo attribuisce allo stesso Difensore civico regionale anche le funzioni di “garante per il diritto alla salute”.

Sul fronte di infanzia e adolescenza, cittadini stranieri e detenuti, in cantiere, convegni, indagini mirate, corsi di formazione, realizzazione di filmati, consolidamento dei progetti già in essere. Il tutto sorretto da una “campagna informativa” a largo raggio,anche attraverso i social network, che avrà come obiettivo quello di sensibilizzare i cittadini sulle competenze e sulle funzioni del Garante dei diritti.

Commissioner for Human Rights appeal to the Constitutional Tribunal on Media Law

Commissioner for Human Rights lodged on 24 March appeal to the Constitutional Tribunal against Media Law of 30 December 2015. In the opinion of the Commissioner for Human Rights the Act violates constitutional guarantees of freedom of speech and media freedom by subordinating the public service broadcasting directly to the government and restricts the constitutional role of National Broadcasting Council.

The Commissioner lodges its appeal after analyses carried out by Office of the Commissioner for Human Rights and in connection with the letter of National Broadcasting Council (which cannot lodge appeals to the Constitutional Tribunal on its own), in the spirit of authorities’ cooperation mentioned in the Preamble to the Constitution.

- Freedom of speech and related media freedom are constitutional principles – argues Commissioner for Human Rights. Public media should constitute an institutional guarantee of freedom of speech and pluralism of means of social communication. In order to fulfil this function, they must, however, be characterized with independence from both political and economic interests.

Constitutional Tribunal have already stated that preservation of internal pluralism of programs is possible only when maintaining palpable distance from the current political holder (Constitutional Tribunal resolution of 13 December 1995, file no. W 6/95).

Freedom of speech guarantee

As the Commissioner for Human Rights recalls, public service broadcasting was created in Poland as a result of governmental transformation of radio and television (Act of 29 December 1992). Earlier, during People's Republic of Poland period, public radio and television services were government agencies and they were politically and organizationally subordinated to the Council of Ministers.

In order to separate public media from the authorities, the Act on radio and television of year 1992 introduced three levels of making decisions on public radio and television: (1) the National Broadcasting Council and as part of companies of public radio and television services – (2) supervisory boards and (3) boards of these companies. They constituted, in a way, "buffers" between political authorities and editorial boards.

Meanwhile, Act of 30 December 2015 –­ an a appeal was lodged to replace this complicated procedure of appointing authorities of public service media with decision of government member – the Minister of the Treasury.

The role of National Broadcasting Council

The Act the appeal was lodged against ignores the National Broadcasting Council – body of state control and law protection, which, on the one hand, is a guardian of freedom of speech and media independence, and, on the other is responsible for the implementation of public service mission, which is related to "...radio and television public interest". The legislator ignored the fact that the National Broadcasting Council is based on Constitution in terms of participation of authorities in creation of media authorities. The Council was designed to be situated beyond the tripartition of power, "between the executive and the legislative power, with maintenance of palpable distance from the government" (Constitutional Tribunal decision of 23 March 2006, file no. IC 4/06).

When the government decides on the structure of media authorities...

By the virtue of the lodged against Act, government acquired a decisive and direct influence on the organization of public media and structure of their bodies. Thus, authorities of mass media companies operate under pressure to edit the content of programs so as to satisfy the government and avoid its dissatisfaction.

It may lead to avoiding or minimizing topics that present the authority in negative light.

Can a decision be made regarding an Act which shall cease to be valid in three months?

Commissioner for Human Rights submits its appeal during the period of validity of Act of 30 December 2015. It shall, however, lose its validity on 30 June 2016, thus at the time of issuing the decision by the Constitutional Tribunal it may no longer be valid.

However, in the opinion of the Commissioner for Human Rights, issuing a decision is possible even when the Act is no longer valid. Provisions of the lodged against Act refer, after all, to the rights and freedoms protected by the Constitution and effects of this Act shall persist even after the Act is no longer valid.

The legislator can neither freely suspend rights and freedoms, nor constitutional principles such as freedom of speech and media freedom constituting basis for principle of independence of public service media.

Neither permanent, nor temporary public service media dependency from the government can be introduced.

In the decision of 12 December 2005 on case file no. K 32/04 the Tribunal stated that "it is not sufficient for the applied measures to be in line with the intended objectives, facilitate their achievement or be convenient for authorities, which are to apply them in order to achieve these objectives. These measures should be worth the democratic state of rule of law".

However, at the same time, it should be remembered that these measures may be considered justified only to the extent they are aimed at protection of values of a democratic state of rule of law.

Austrian Ombudsman Kräuter at the International Forum and Training Workshop in Tokyo

The topic chosen for the international forum was „Administrative Grievance Resolution and The Ombudsman – Enhancing Transparency and responsiveness in public administration“. Professor Masahiro Horie from the National Graduate Institute for Policy Studies moderated this session. Key note speeches were delivered inter alia by IOI President and Namibian Ombudsman John R. Walters, IOI Secretary General and Austrian Ombudsman Günther Kräuter, as well as President of the Asian Ombudsman Association and IOI Regional President for the Asian Region, Federal Ombudsman of Pakistan Salman Faruqui.

All speakers presented good practice examples from their respective country or region and received many questions from the big audience, stimulating a lively discussion. Austrian Ombudsman Kräuter talked particularly about measures to enhance transparency and responsiveness in public administration and gave insights in the AOB’s activities and structures.

An international training workshop titled “Wachdogs Bark – Systematic Investigations for Ombudsman” added a useful possibility to exchange experiences and learning opportunity to the forum. The training was mainly conducted by André Marin, former Ontario Ombudsman, as well as Professor Hisao Tsukamoto (Waseda University), and Professor Kimiyoshi Toyama (Rikkyo University).

The gathering was also used to hold a separate Asian Ombudsman Association (AOA) Meeting, as well as an IOI Asian Regional Meeting, where representatives of the region were able to discuss current activities.
