In case-law of courts there were discrepancies relating to the reimbursement of costs concerning appointment of defence counsel of own choice. The Commissioner for Human Rights applied a legal question to the Supreme Court thereof. The court acknowledged the request of the Commissioner for Human Rights which states that expenditures related to claim include also expenditures incurred by the defendant for his counsel on own choice in the case of acquittal on the part of accused actions or partial cancellation of the proceedings.

Adoption of the budget of the Commissioner for Human Rights proposed by the government on 28 January 2016 shall not provide financial independence in the light of international standards which may threat Poland to reduce rating provided by the International Coordinating Committee [more]. The Commissioner for Human Rights issued a statement with regard to reduced budget, in which he indicated the impact of this decision on the community.

Kräuter betont: „Die heutige mediale Reaktion des Hauptverbandes, dass zwar ein Verteilungsproblem vorhanden sei, generell aber auf hohem Niveau gejammert werde, ist aus Sicht der Volksanwaltschaft keine adäquate Reaktion auf die offensichtliche kinderärztliche Unterversorgung. Wir werden daher den Hauptverband der Sozialversicherungsträger und das Gesundheitsressort zu dieser so wichtigen gesundheitspolitischen Frage unter die Lupe nehmen.“ Ziel des Prüfverfahrens sei eine Analyse der Defizite und Probleme und rasche Reformen im Interesse der Kinder und Jugendlichen.
Aus gesundheitspolitischer Sicht sei jedenfalls unabdingbar, dass flächendeckend genügend Kinderärzte sowohl wochentags als auch am Wochenende in Ordinationen erreichbar seien sowie ein kinderärztlicher Notdienst auch Hausbesuche mache.
Versorgungslücke Kinderpsychiatrie
Bereits im Vorjahr hatte die Volksanwaltschaft in ihrem Bericht an das Parlament auf die „eklatante Versorgungslücke“ mit Fachärzten für die Kinderpsychiatrie hingewiesen. „Wir müssen leider davon ausgehen, dass bis zu 200 000 Kinder und Jugendliche in Österreich von psychiatrischen Störungen betroffen sind, demgegenüber fehlen Hundertschaften an ausgebildete Fachärztinnen und Fachärzten,“ so Kräuter.
Die Volksanwaltschaft fordert eine Lockerung des 1:1 Ausbildungsschlüssels, damit ein ausreichendes Versorgungsangebot für dringend psychisch behandlungsbedürftige Kinder und Jugendliche sichergestellt werden könne.
