Notice concerning the matter of residential facilities providing social care services without authorisation

In the past quarter, the Defender exercised her power under the Public Defender of Rights Act and approached the Government with the findings she obtained in systematic visits of nine facilities providing their clients, aside from accommodation and meals, with services identical in terms of content to social care services, without having obtained the necessary authorisation under Section 78 et seq. of Act No. 108/2006 Coll., on social services, as amended. The Defender found ill-treatment and violations of fundamental rights and freedoms, respectively, of the accommodated persons in all the visited unregistered residential social services facilities. Some of the findings were so alarming that the Defender reported them to the prosecuting bodies.

This is a systemic problem which may only be addressed by the Ministry of Labour and Social Affairs in close co-operation with other Ministries as well as the regional and municipal authorities. In the Defender’s opinion, the solution must not consist solely in repression against the unregistered residential social services facilities. Systemic steps need to be taken to ensure sufficient supply on the part of the registered social care services, increasing their availability.

In the document, the Defender suggested that the Government task the Minister of Labour and Social Affairs with preparing a plan of measures to deal with the availability of social care services (for which the unregistered facilities substitute) and, further, to co-operate with regional and municipal authorities to prepare a plan of measures to actively search for and help persons who receive services from unregistered facilities, or who may receive them in the future. The Minister of Labour and Social Affairs is to incorporate both documents into the planned National Strategy for Development of Social Services in 2016–2020, which is to be submitted for the Government’s approval by 31 December 2015.

The submitted document was discussed by the Government on 5 October 2015; the Government accepted the Defender’s recommendations.

El Justicia pide que se garantice una adecuada prestación del servicio de autobús urbano en Zaragoza y se amplien los servicios mínimos

El Justicia de Aragón, Fernando García Vicente, ha hecho público hoy un Informe en relación con el conflicto laboral que enfrenta al Comité de Empresa de Autobuses Urbanos de Zaragoza (AUZSA) con la empresa adjudicataria de este servicio público urbano de transporte de viajeros y con la huelga convocada por el Comité el pasado día 10 de diciembre.

El Justicia valora de forma muy positiva las actuaciones de mediación que está llevando a cabo el Gobierno municipal y la implicación personal del alcalde de Zaragoza, Pedro Santisteve, con el fin de buscar un pacto que garantice el respecto de todos los intereses implicados.

No obstante, dada la duración del conflicto, que hoy cumple 44 días, y los perjuicios al interés general y al bien común, la Institución ha emitido una serie de consideraciones referidas, por un lado, a la adecuada prestación del servicio y al respeto al derecho de seguridad e higiene de sus empleados, en respuesta a la queja que el Comité planteó el día pasado 30 de diciembre, y por otro lado, a los servicios mínimos fijados legítimamente por el Ayuntamiento.

Entiende el Justicia, que debido a la duración del conflicto y a los perjuicios que se están ocasionando a la ciudadanía, estos servicios podrían exceder el límite de la proporcionalidad razonable entre el derecho a la huelga de los trabajadores y el de los usuarios a tener un servicio público que satisfaga sus necesidades básicas, por lo que pide al Consistorio que valore la posibilidad de ampliarlos.
