The Ombudsman is a senior public official, charged with monitoring the public administration through the examination and investigation of complaints from members of the public who believe they have been adversely affected by the administrative actions of a public body. The remit of the Ombudsman covers all Government Ministries, Portfolios, Departments and Sections, Statutory Authorities and Government Companies

The Ombudsman has responsibility for investigating and resolving complaints of maladministration, public complaints against the police and dealing with freedom of information appeals. In the future the post holder will be responsible for overseeing whistleblower and data protection legislation.

The person appointed should be recognized, either publicly or within their own professional area, as an individual of proven integrity and independence. S/he will have the gravitas and charisma to champion the rights of the citizen and/or groups of society in their dealings with the machinery of Government administration. S/he will lead a high profile office through a period of expansion and change. S/he will possess a broad understanding and knowledge of public administration including the political and legal systems, and the governance of public bodies.

 

The person will have proven track  record of significant and high level professional achievements and be capable of presenting as the public face of the Office of the Ombudsman with credibility and authority.

 

The post holder must possess a university degree or a similar tertiary qualification or equivalent preferably in Law or Public Administration.  In addition a Master’s Degree in Public Administration or Law or a senior practitioner in law or a similar field would be highly desirable.

 

The post holder must be a seasoned individual who will possess no less than 10 years’ post graduate experience at a senior management level in the public service, or in a legal/judicial institution.

 

Broad experience in, and an in-depth working knowledge of government structures and functions (including budget and financial control, and human resource management, change management and mediation) would be a distinct advantage.

European ombudsmen’s symposium on impact of populism on human rights

More than 40 ombudsmen from all over Europe participated at the symposium on the impact of populism on human rights, organised on April 3-4 in Barcelona by the Catalan Ombudsman Rafel Ribó, the IOI Europe’s Regional President. In his key note speech the Commissioner for Human Rights of the Council of Europe Nils Muižnieks assessed that the last year was marked by the surge of populism while emphasising the vital role that ombudsmen’s institution might have in protection of citizens against arbitrariness.

Ombudswoman and the Chair of the European National Human Rights Institutions’ Network (ENNHRI) Lora Vidović outlined that the populism often means a denial of the universality of human rights and damages the citizens’ trust in institutions which was additionally enhanced by the great inequalities and state of poverty in societies. She made a strong point on the role ENNHRI members have as human rights’ promoters especially in advocating sustainable and systemic solutions, deriving from the international laws and standards.

This is making many turn their back on human rights, stressed Michael O'Flaherty, EU Fundamental Rights Agency (FRA) Director. He therefore stated that FRA will continue to provide relevant timely data that decision makers need to make informed policies.

Symposium was concluded by the adoption of “Barcelona Declaration” in which the European members of IOI call the states to fully adhere to the international obligations concerning human rights, especially in the context of the security threats and maintaining public order.

Los ombudsman europeos apelan a los estados a defender los derechos de las personas y a acoger a migrantes y refugiados

La valedora do pobo asistió el pasado día 4 en Barcelona al segundo seminario internacional de la sección europea del Instituto Internacional de Ombudsman (IOI) del que forma parte la institución. Como conclusión de las reflexiones escuchadas en el Parlament de Cataluña, los defensores europeos suscribieron la Declaración de Barcelona para instar a los gobiernos a cumplir con los acuerdos internacionales de derechos humanos y cooperar en red para hacer frente a los retos comunes que presenta la defensa de los derechos y libertades.

Los días 3 y 4 de abril representantes de la sección europea del IOI, incluida la institución del Valedor do Pobo, participaron en Barcelona en su segundo seminario internacional en el que se abordaron los retos de los derechos humanos en Europa. El evento congregó a una cuarentena de ombudsman (defensores) de toda Europa y culminó con una declaración aprobada por todos, en la que se denuncian las restricciones a los derechos humanos y las libertades fundamentales que se producen en algunos países europeos basadas en amenazas a la seguridad y al orden público.

En el documento, los defensores se comprometen a promover y defender los derechos humanos y las libertades fundamentales, tanto en el contexto económico como social, civil y político. Se pide a los estados de la Unión Europea que cumplan plenamente sus deberes internacionales en materia de derechos humanos y supriman los estados de excepción. Se les indica además la necesidad de acogimiento de las personas migrantes y refugiadas, en cumplimiento de la propuesta de la Comisión Europea de septiembre de 2015, de acuerdo con los tratados internacionales y europeos de derechos humanos, con una atención especial al interés superior de los menores.

En la segunda jornada del seminario participó la valedora do pobo, Milagros Otero Parga, como moderadora de la cuarta sesión: “Buenas prácticas, derechos humanos, redes y modelos de Ombudsman” en la que tomaron la palabra: Petri Jääskeläinen, ombudsman de Finlandia; Anna Šabatová, ombudsman de la República Checa; Reinier Van Zutphen, ombudsman de  Países Bajos
y Rafael Ribó, síndic de greuges de Cataluña y organizador del evento como presidente del IOI Europa.

Doppelte Bestrafung nach dem Pyrotechnikgesetz

Ein steirischer Fußballfan wollte im Oktober 2015 an einer Sportveranstaltung der Fußballklubs Rapid Wien gegen Sturm Graz im Ernst Happel Stadion teilnehmen. Am Hauptbahnhof in Wien angekommen, fanden Polizeibeamte bei ihm verbotene pyrotechnische Gegenstände. Eine Anzeige war die Folge. Personen, die wiederholt gegen das Pyrotechnikgesetz bei Sportveranstaltungen verstoßen haben, können von der Behörde zur Belehrung über das rechtskonforme Verhalten vorgeladen werden. Um die Voraussetzungen einer solchen Vorladung prüfen zu können, setzte die LPD Wien die LPD Stmk von der Anzeige in Kenntnis.

Die von der LPD Stmk in der Folge an den Herrn übermittelte Strafverfügung nach dem Pyrotechnikgesetz über 200 Euro bezahlte er umgehend ein. Umso überraschter war der Fußballfan, als ihm im Februar 2016 wegen desselben Tatbestandes eine weitere Strafverfügung - diesmal jedoch von der LPD Wien - über 70 Euro zugestellt wurde. Auf seine Anfrage in der PI Leoben habe ihm ein Beamter mitgeteilt, dass es sich um einen Fehler handle. Ihm wurde geraten, gegen die Strafverfügung der LPD Wien ein Rechtsmittel zu erheben.

Nach Einleitung eines Prüfverfahrens durch die Volksanwaltschaft hob die PI Leoben die Strafverfügung auf und stellte das Strafverfahren ein. Begründet wurde die Aufhebung der Strafverfügung damit, dass auf Grund des Tatortes die LPD Wien die örtlich zuständige Behörde für die Durchführung des Verwaltungsstrafverfahrens gewesen sei. Die zu Unrecht verhängte Geldstrafe in der Höhe von 200 Euro wurde an Herrn N.N. zurücküberwiesen.
