Kräuter: „Pflegekräfte und Gesundheitspersonal werden dringend gebraucht!“

Wie nun bekannt wurde, will der Wiener Krankenanstaltenverbund offenbar 20 Mitarbeiterinnen und Mitarbeiter in Frühpension schicken – darunter eine Fachärztin, Allgemeinärzte, Psychologen, Krankenpfleger, Oberschwestern, Pflegehelfer und Sozialarbeiter. Grund dafür sei die Schließung des Pflegezentrums beim Otto-Wagner-Spital in Wien-Penzing. Der KAV sehe für diese 20 Mitarbeiter „keine weitere Verwendungsmöglichkeit“ mehr, wie es in einem Schreiben der Magistratsdirektion heißt, das „der Standard“ zitiert.

Aus Sicht von Volksanwalt Günther Kräuter ist dies völlig unverständlich: „Im Gesundheits- und Pflegebereich herrscht eklatanter Personalmangel. Die Stadt Wien braucht diese Fachkräfte“. Nicht nachvollziehbar sei für Kräuter auch die angeblich aufwendige Umschulung der Mitarbeiter, die laut KAV nicht zielführend sei. „Immerhin handelt es sich um hochqualifiziertes Personal, das sofort einsatzbereit ist.“

„Die Volksanwaltschaft wird die geplante Frühpensionierung der 20 Mitarbeiter im KAV nun von Amts wegen prüfen“, kündigt Kräuter an. „Ich verlange rasche Aufklärung.“
 

In view of the serious events that occurred on Sunday, October 1st, with flagrant transgression of human rights, as well as the current context and the political and social situation in Catalonia, the Catalan Ombudsman reiterates its strong position in favour of dialogue without conditions, at a time when the fulfilment human rights in Spain are at risk, including the most basic rights.

Article 4 of Law 24/2009 sets out that one of the functions of the Catalan Ombudsman is promoting conciliation and carrying out, if necessary and within its sphere of action, mediation or dispute resolution.

The Law establishes that, in exercising the functions of mediation, "the Ombudsman shall organize the exchange of views between the parties involved, encouraging that they reach an agreement and formulating proposals of conflict resolution, without binding character, so that those affected can freely decide on the basis of these proposals".

For all of this, and within the framework of its powers, the Catalan Ombudsman offers the institution of the Ombudsman of Catalonia in its mediating role to public authorities, in order to organize –in the areas of Catalonia, Spain and the international community– a table of understanding and agreement, from institutional responsibility and full respect for human rights by all branches of government to the highest levels of the three branches of separation of powers (legislative, executive and judicial), and – specifically the Spanish Prime Minister and the Prime Minister of the Government of Catalonia– the Spanish Parliament and the Parliament of Catalonia, and the other powers of the State, as well as the Ombudsman.

The Catalan Ombudsman proposes to agree, as a common starting point between all those concerned, to set the tramline to zero for agreement and understanding.

The Catalan Ombudsman reminds that the United Nations High Commissioner for Human Rights states that the current situation must be resolved through political dialogue, with full respect for democratic freedoms, and has called for an independent and impartial investigation into the facts.

The Catalan Ombudsman has also exposed the numerous signs of support and condemnation of the facts that the institution has received at the international level.
 

El Síndic de Greuges ha enviado puntualmente información al Comisario sobre el contexto social y político en España y en Cataluña

Nils Muižnieks  ha hecho pública la carta que envió el 4 de octubre al ministro del Interior español

También ha hecho pública la respuesta del ministro, que desestima el requerimiento y defiende la actuación de las fuerzas de seguridad

“Os insto a que aseguréis, con la colaboración de otros organismos responsables de la seguridad, que se lleven a cabo, de forma ágil, independiente y efectiva,  investigaciones sobre las acusaciones contra los cuerpos policiales de hacer un uso desproporcionado de la fuerza el pasado 1 de octubre en Cataluña”. Este es el requerimiento que el Comisario Europeo de Derechos Humanos ha enviado recientemente (4 de octubre) al ministro del Interior, Juan Ignacio Zoido. El Síndic de Greuges ha enviado puntualmente al Comisario informaciones acerca del contexto social y político en España y Cataluña; en concreto, le había trasladado información sobre la actuación de las fuerzas de seguridad del Estado durante el 1 de octubre y la voluntad de la institución de dilucidar responsabilidades judiciales y policiales.

A pesar de la contundencia de Nils Muižnieks, el ministro ha desestimado la recomendación en una carta en la cual manifiesta que “las Fuerzas y Cuerpos de Seguridad del Estado, siguiendo instrucciones del Poder Judicial, actuaron prudente, apropiada y proporcionalmente”.

El Síndic, que sigue adelante con sus investigaciones y que ya ha recibido cerca de 200 escritos sobre esta situación, considera que es preciso llegar hasta el fondo de la cuestión y garantizar que no se vuelva a repetir.

Rafael Ribó también trasladó la gravedad de los hechos, además de al comisario europeo de Derechos Humanos, a la defensora del pueblo europeo, al Alto Comisionado de la ONU por los Derechos Humanos, al presidente del Instituto Internacional del Ombudsman y a los defensores autonómicos.

Entre los organismos internacionales de defensa de derechos que hasta ahora se han pronunciado en contra de la violencia ejercida por las fuerzas de seguridad destacan el Congreso de Poderes Locales y Regionales Europeo, la Asamblea Parlamentaria del Consejo de Europa, la Organización para la Seguridad y la Cooperación en Europa, así como el alto comisionado de las Naciones Unidas por los derechos humanos y del Relator Especial para la libertad de expresión y opinión.

El síndic también ha tenido conocimiento de que Amnistía internacional concluye, en un informe elaborado por observadores, que ha existido un uso excesivo e innecesario de la fuerza por parte de la policía sobre personas indefensas y el uso de proyectiles de goma, así como que Human Rights Watch también está elaborando un informe.
