Diritti. Informazione amministrativa, Gardini: “Ancora non pienamente realizzata”

“In Italia, il diritto all'informazione amministrativa ha richiesto molto tempo per essere riconosciuto, e anche oggi, nonostante l’introduzione dell’accesso civico generalizzato e l’approvazione del cosiddetto Codice della trasparenza, non può considerarsi pienamente realizzato”. Gianluca Gardini, Difensore civico regionale, ha così aperto il suo intervento al convegno “Accesso civico, riservatezza e Organi di garanzia”, in programma oggi a palazzo Giustiniani a Roma.

“Il punto centrale è l’ambiguità della legge: nel nostro ordinamento non è chiaro se l’accesso civico generalizzato si configura come diritto dell’individuo o come strumento di lotta alla corruzione. Da qui derivano, a cascata, una serie di problemi interpretativi sull’estensione del diritto di accesso civico: se lo si considera un diritto dell’individuo all’informazione amministrativa, la richiesta non può essere respinta dall’amministrazione anche se viene presentata per finalità egoistiche, al limite anche per fini lucrativi. Se invece lo si configura come strumento di trasparenza, dovranno essere soddisfatte solo le richieste di accesso volte a esercitare un controllo diffuso sull’amministrazione. Per fare un esempio concreto, se si segue la prima tesi, l’istanza di accesso di un’agenzia immobiliare che chiede di conoscere tutte le Scia o titoli edilizi rilasciati in una certa zona della città dovrà essere accolta, se si segue la seconda tesi invece la stessa istanza dovrà respinta perché animata da finalità commerciali. In entrambi i casi, ovviamente, l’amministrazione dovrà valutare se la richiesta incontra uno dei limiti esplicitamente previsti dalla legge, a tutela di altri interessi individuali o collettivi, ma la differenza di fronte a richieste di accesso presentate per finalità commerciali, egoistiche e strettamente individuali è evidente.  Un altro fattore che ostacola la completa affermazione del diritto all’informazione amministrativa nel nostro paese è rappresentato dalla mancata previsione di organi indipendenti, monocratici o collegiali, incaricati di garantire la corretta applicazione della disciplina in tema di accesso civico”. Ha spiegato Gardini all’incontro romano.

Oltre a Gardini, all’incontro romano hanno partecipato anche Paolo Pietrangelo, direttore generale della Conferenza dei presidenti delle Assemblee legislative delle Regioni e delle Province autonome, Giovanni Guerra, avvocato e componente della Commissione per l’adeguamento della normativa italiana al regolamento UE 679/2016, e Benedetto Ponti, professore di diritto amministrativo dell’Università degli studi di Perugia.

Statement regarding the suspension from public office of six MPs of the Parliament of Catalonia

On July 10th, 2018, the judge's ruling of the Spanish Supreme Court in special cause 20907/2017 was issued, ordering the suspension from public office of six MPs of the Parliament of Catalonia in application of article 384 bis of the Spanish Law of criminal prosecution (LeCrim).

With regard to this decision, the Catalan Ombudsman states the following:

1. As indicated in the statement issued on June 29th, an interpretation of article 384 bis in accordance with the doctrine of the Spanish Constitutional Court (STC 199/1987) would make inapplicable the automatic suspension of office or public function of the people indicted and imprisoned for alleged crimes linked to the Catalan process, since in this case the use of weapons or explosives has not occurred at any time, as the Spanish Supreme Court itself acknowledges in its ruling June 26th, 2018. For this reason, the Catalan Ombudsman believes that the MPs affected by the suspension measure, in exercise of their right of participation and representation, may appeal against the decision to the competent jurisdictional bodies, including the constitutional one.

2. The suspension of public office or public function of article 384 bis of LeCrim may have a direct effect on the majorities of the Parliament of Catalonia and may distort the result of the elections of December 21, 2017. In this regard, it should be noted that, by means of a judicial decision of a merely precautionary nature and not on the grounds of the case under trial, several MPs could be deprived of exercising their functions for an indefinite period. Therefore, there would be a violation of the fundamental right of participation of the MP as an individual in the Parliament and, above all, of the collective right of participation of Catalan voters in the formation of political majorities through elections every four years. This decision, at the present stage of the procedure, would contradict the case law of the ECtHR, for whom "the role of the judicial bodies cannot change the expression of the people in any case" (Kerimova against Azerbaijan, September 30th, 2010).

3. The alternative provided by the judge's ruling, according to which the Parliament of Catalonia could agree to replace the suspended MPs by other members of the corresponding candidates, is not provided for in the legal system, supposes an overruling of the judicial functions for invasion of the legislative power, represents an interference with parliamentary autonomy and raises for all these reasons serious difficulties of effective application. In particular, the delivery of acts of provisional MPs, that would correspond to the Electoral Board and that cannot be sustained in the Organic Law of General Electoral Regime (LOREG). Therefore, all the risks of distortion of the electoral results of the last elections to the Parliament of Catalonia indicated in the previous point subsist for the time being.

4. Finally, the Catalan Ombudsman again emphasizes, as he has shown in his recent report of June 2017, on the violation of fundamental rights and freedoms arising from the criminal justice reaction to October 1st, that the accusations of rebellion, sedition and criminal organization that are being substantiated by the Spanish Supreme Court, the Spanish National Court and other courts of instruction are clearly disproportionate to the events that occurred in Catalonia, particularly between September and October 2017. More specifically, regarding the rebellion, the references made by the Spanish Constitutional Court (STC 199/1987) to the use of war and explosive weapons to justify the suspension of public office of people prosecuted and imprisoned by rebellion clearly denote that none of the facts that are investigated in special cause 20907/2017 incur in this criminal type. This ruling is a step in the opposite direction to the necessary dialogue to resolve the political conflict in Catalonia.

This statement is brought to the attention of the European Commissioner for Human Rights and the Parliamentary Assembly of the Council of Europe to their knowledge and consideration.

„Bauliche Barrierefreiheit braucht auch rechtliche Grundlagen“

In den ersten sechs Monaten erreichten den Bürgerbeauftragte des Landes Mecklenburg-Vorpommern wieder über 800 Eingaben, Bitten und Beschwerden. Inhaltlich haben soziale Fragen wieder dominiert. Auch die Tendenz der Vorjahre, dass Fragen der Jugendhilfe einen wachsenden Schwerpunkt darstellen, bestätigte sich.

„Beschwerden bezogen sich des öfteren auf unzureichend und spät gewährte Eingliederungshilfen für Kinder mit seelischen Behinderungen. Gerade hier ist schnelle Unterstützung aber besonders notwendig“, so Crone. Das Bild setze sich aus einzelnen Petitionen, aber auch aus zusammenfassenden Berichten von Vertretern der Betroffenen zusammen. So seien bei einer Reihe von Schülern mit einer Autismus-Spektrum-Störung (ASS) erst durch Gerichte Integrationshelfer für die Teilnahme am Schulunterricht bewilligt worden. Crone: „Kinder mit einer ASS können mit Hilfestellung in der Regel gut am Schulunterricht teilnehmen. Hilfe muss aber schnell sein. Sonst haben wir Exklusion statt Inklusion. Manchmal wäre es besser, vorläufig Hilfen zu gewähren, statt auf das dritte Gutachten zu warten.“

Der Bürgerbeauftragte machte auch auf Lücken in der Barrierefreiheit touristischer Angebote aufmerksam. Dies betreffe sowohl die Mobilität als auch die Struktur. So gebe es im Prinzip keine Reisebusse, in denen man Rollstühle bzw. Rollstuhlfahrer befördern könne. Für Hotelneubauten fehlt es in Mecklenburg-Vorpommern an einer klaren Regelung, dass und wie viele Gästezimmer barrierefrei sein müssen. Matthias Crone mahnte an: „Andere Bundesländer haben das längst nach einer Musterverordnung geregelt. Bei uns sollte das nun auch zügig erledigt werden.“ Crone kritisierte auch, dass Ermäßigungen bei der Kurabgabe für Menschen mit Behinderungen in einem prominenten Seebad gestrichen wurden: „Obwohl bei Weitem nicht alle Kurangebote für diesen Personenkreis nutzbar sind, wird dieser Nachteil nicht mehr ausgeglichen. Das ist unfair und unklug.“

Zunehmend Sorge bereiten dem Bürgerbeauftragten auch die Fälle, in denen Bürger Schäden, die sie durch Kommunen erlitten haben, nicht ersetzt erhalten. Diese Fälle werden dem Kommunalen Schadensausgleich (einer länderübergreifenden Vereinigung) zu Regulierung übergeben. „Selbst in Fällen, in denen die Verwaltung ihre Verantwortung einräumt, wird die Regulierung abgelehnt oder einfach gekürzt. Ich fordere die Verwaltungen auf, den Bürgern in solchen Fällen zur Seite zu stehen und sich nicht zurückzuziehen“, appellierte Crone in Schwerin. Sonst bleibe immer nur der Gang zum Gericht, zumal sich die Einrichtung dem Petitionsrecht völlig entziehe.
