Elderly man with Alzheimer’s disease died when agency failed to provide night care

An elderly man with Alzheimer’s disease died following a fall from bed when an agency night carer failed to attend his home. A Parliamentary and Health Service Ombudsman investigation found service failings by the nursing agency and made recommendations to ensure that these were not repeated. 

For several months Mr Robert Adamson had been receiving essential night care at his home from Chester-based nursing agency, Jane Lewis. Robert, who was in his early eighties, was unable to get out of bed without assistance or look after himself. The night carer’s role was to keep him safe and comfortable and provide respite for the family. 

On the night of the incident, the carer did not arrive at the usual time. The family made calls to the agency and were assured that a carer would come that evening. Robert’s wife went to bed on the understanding that her husband would receive the support and assistance he needed during the night.

The following morning Robert’s daughter, Rachel, found her father dead on the floor beside his bed. When the family complained, the agency did not appear to appreciate the level of distress caused and disagreed with the family about what had happened. 

Unsatisfied with the agency’s response, Rachel complained to the Ombudsman. The subsequent investigation identified that the agency’s poor communication and administrative errors left Robert without a carer on the night he died. Robert’s family received an apology from the agency, a payment that acknowledged the emotional impact and distress caused as a result of the service failings and the agency took steps to ensure that errors were not repeated. 

 

Parliamentary and Health Service Ombudsman, Rob Behrens, said: 

‘This case illustrates the significant impact on families when failings occur and the benefit of bringing unresolved complaints to the Ombudsman.  

While we recognise health care staff are under significant pressure and applaud the fantastic job they do, communication and reliability are key elements of their work and, when things go wrong, it is vital that this is recognised and steps are made to improve services.’ 

Mr Robert Adamson’s daughter, Ms Rachel Adamson said:

‘Night care enabled my father to continue to live safely at home with my mother. His death in the absence of a carer demonstrates how essential that support was. 

Our complaint to the Ombudsman led to the agency acknowledging its mistakes and apologising. Our family’s loss has helped ensure that the same thing does not happen again and others do not experience the distress that we did.’

Jornada del Síndic de Greuges sobre menores víctimas de violencia de género

El Síndic de Greuges de la Comunitat Valenciana celebró ayer 15 de noviembre su tradicional Jornada Conmemorativa del Día de la Infancia en la Universidad de Alicante. En esta ocasión, el tema principal fue la atención a menores víctimas de violencia de género.

Una materia que ha suscitado gran interés entre los agentes de igualdad, agentes de la policía, educadores sociales, profesionales de la psicología, psiquiatría, trabajadores sociales de la administración local y autonómica, así como profesionales de centros de menores y de puntos de encuentro familiar entre otros. En total, más de doscientas  personas inscritas y otras tantas que siguieron el evento en directo a través del canal streaming de la Universidad de Alicante.

El síndic, José Cholbi, junto con la vicerrectora de Responsabilidad Social, Inclusión Social e Igualdad de la Universidad de Alicante, María José Rodríguez, fueron los  encargados de inaugurar y presentar esta jornada, que consistió en dos ponencias y una mesa redonda.

La primera ponencia corrió a cargo Ana Rosser, profesora de Comunicación y Psicología Social de la UA que centró su intervención en los menores como víctimas invisibles de la violencia de género, un tema muy relacionado con la investigación que actualmente dirige sobre estrategias para intervenir con menores expuestos a violencia de género.

A continuación, Félix Loizaga, profesor de Psicología en la Universidad de Deusto profundizó durante su ponencia sobre los estilos de apego de menores víctimas de violencia de género.

Por último, los técnicos del Síndic de Greuges David Calatayud y Conrado Moya compartieron con todas las personas asistentes las conclusiones de las recientes Jornadas de Coordinación de Defensores del Pueblo, que se celebraron el pasado mes de octubre en Alicante y que versaron precisamente sobre la atención que reciben las mujeres y menores víctimas de violencia machista.

Ombudsman welcomes CMA report on care homes

The Local Government and Social Care Ombudsman has today welcomed the Competition and Market Authority’s (CMA) guidance to care homes.

Ombudsman Michael King, said:

“We welcome the CMA guidance and its call for providers to make sure their complaints handling processes are easy to find, easy to use, fair and effective. We cannot stress enough how important it is for care providers to use the learning from complaints to improve services, so we particularly welcome that this too is included in the guidance.

From our vast experience of investigating complaints about adult social care, we know just how important it is that people are given information about how and where to complain, including how to escalate a complaint to us, before they make crucial decisions about their care. Clarity and transparency about terms and conditions of contracts are also vital, so care users - and their families and representatives - can make informed choices. We have echoed this in a number of our focus reports and guidance over the past few years.
