Riparte da Montacuto la serie di visite del Garante dei diritti negli istituti penitenziari regionali. Questa volta Nobili ha esteso l’invito anche ai nuovi parlamentari delle Marche, affinchè abbiano una visione più diretta della situazione esistente sul versante carcerario. Al primo incontro in calendario hanno partecipato Paolo Giuliodori e Martina Parisse eletti alla Camera per il Movimento 5 Stelle ed in rappresentanza della Lega Nord il capogruppo in Consiglio regionale, Sandro Zaffiri. Nell’ultimo anno quello di Montacuto è stato l’istituto che ha palesato, più di altri, diverse criticità, rappresentate dal Garante  anche nella “lettera invito” fatta pervenire agli stessi parlamentari.

Attualmente nell’istituto sono presenti 310 detenuti (158 con condanna definitiva e 152 in attesa di giudizio)  su una capienza regolamentare di 257 posti; gli agenti di polizia penitenziaria sono 176, di cui 150 assegnati e 117 effettivamente in servizio; quattro gli educatori (sei in pianta organica) e due gli psicologi.

Tra i maggiori problemi riscontrati, come ricorda Nobili,  il sovraffollamento, che viene confermato e che ultimamente ha determinato la necessità di inserire una quinta branda nelle camere di pernottamento; patologie di carattere psichiatrico e infettivo (prevale l’epatite C) tra i detenuti; carenze d’organico per la polizia penitenziaria e per l’area educativo – trattamentale e psicologia; situazione complessiva del Provveditorato regionale dell’amministrazione penitenziaria delle Marche,  accorpato all’Emilia Romagna e oggetto di interrogazioni parlamentari.

Councils cannot cap personal budgets under Care Act, Ombudsman warns

Councils cannot set maximum budget levels when calculating the cost of people’s care, the Local Government and Social Care Ombudsman has said.

The Ombudsman has issued the advice after an investigation found Wiltshire Council had a policy of placing people into bands, and paying in line with those banding levels, regardless of need. This is contrary to the Care Act.

The Ombudsman became aware of the council’s system after a woman, whose adult son had substantial and complex health problems and disabilities, had her support cut significantly.

The Ombudsman’s investigation found the council at fault for using an outdated matrix tool to calculate the amount of support offered to the family, and for reducing the support offered immediately, rather than as a staged reduction as the matrix tool said it should. It was also at fault for the way in which it reduced their funding for transport.

Michael King, Local Government and Social Care Ombudsman, said:

“Councils cannot put a cap on people’s budgets: the Care Act says eligible needs must be met, regardless of the cost.

“The reduction in support, and the haste by which those changes were introduced, has had a significant impact on the mother.

“Having to care for both her husband and her son has left this woman exhausted. She said she has been treated by her doctor and reported being frequently distressed, tearful and unsettled by the changes.

“I am pleased the council has accepted the formula it used to calculate people’s budgets was not in accordance with current guidance and has now agreed to stop using it.”

The mother, who is also a carer for her husband, complained to the Ombudsman that her support had been cut when she moved home, despite having reassurances from social workers that her support would remain the same.

Her son, who has severe learning disabilities and epilepsy, lives at home with his parents. He uses a day care centre every week day, and had been receiving respite care 104 nights a year.

The council carried out a fresh assessment of the son’s care needs after the family moved home. Despite the son’s care needs remaining unchanged, the new assessment reduced his number of respite nights to 68 a year. The council said this reduction would be introduced gradually, but instead it was done immediately.

The assessment also reduced the son’s transport funding, which left the council asking the mother to drive the son to daycare twice a week. The mother said she could not do this, but again these transport changes were introduced immediately.

The Local Government and Social Care Ombudsman’s role is to remedy injustice and share learning from investigations to help improve public, and adult social care, services.

In this case the council has agreed to apologise to the mother and restore the previous level of respite care, pending a re-assessment compliant with the Care Act 2014. It has also confirmed it will offer her 24 days respite care in recognition of that which was wrongly withdrawn.

The council has also agreed to repay the mother the £747.50 she paid the council for transport, and pay a further £500 in recognition of her distress and time and trouble.

The Ombudsman has the power to make recommendations to improve a council’s processes for the wider public. In this case the council has agreed to review its policy and procedure on respite care to ensure it is compliant with the Care Act 2014.

It has also agreed to review files for evidence of use of the outdated matrix tool, and anyone whose transport was cut. It will write promptly to anyone similarly affected by the issues in this report and review their cases.

Le Défenseur des droits soutient le Duoday

Ce jeudi 26 avril se déroule le Duoday 2018, une journée durant laquelle des personnes en situation de handicap peuvent découvrir, en duo avec des travailleurs volontaires, le métier ou l’activité qu’ils souhaitent.

C’est Patrick Gohet, adjoint du Défenseur des droits en charge de la lutte contre les discriminations et de la promotion de l'égalité, qui participe tout particulièrement à cette édition 2018 du Duoday, en partageant sa journée de travail avec un jeune homme en situation de handicap. Accueilli ce matin par Jacques Toubon, le Défenseur des droits, le jeune homme assiste tout au long de la journée aux nombreux rendez-vous de M. Gohet et va ainsi découvrir différentes facettes de l’institution et ses enjeux.

Alors que l’emploi des personnes en situation de handicap reste trop peu développé en France, le Défenseur des droits soutient et participe au Duoday, car l’institution est convaincue que ce sont des initiatives comme celles-ci qui permettent de lutter efficacement et concrètement contre les préjugés et opérer des changements dans les pratiques des entreprises, administrations ou encore associations.

Dans le cadre de sa mission de lutte contre les discriminations et de promotion de l’égalité, le Défenseur des droits a publié en décembre 2017 un afin d’accompagner les employeurs et contribuer ainsi à lutter contre les discriminations dont sont victimes les personnes handicapées.

Pour une meilleure inclusion des personnes handicapées dans le monde du travail

Créé en 2008 en Irlande, le Duoday est un concept désormais présent dans de nombreux pays européens. En France, les deux premières éditions se sont déroulées en 2016 et 2017 dans le Lot-et-Garonne. Cette année, le Duoday, coordonné par le Secrétariat d’Etat chargé des Personnes handicapées, se déploie au niveau national.

Cette initiative se traduit concrètement par l’accueil d’un ou d’une stagiaire en situation de handicap, tout au long d’une journée, dans une entreprise ou une organisation. Cette personne forme un binôme avec un salarié de l’entreprise et l’accompagne dans ses activités.  Au service d’une meilleure inclusion des personnes en situation de handicap dans le monde du travail, le Duoday mise sur l’expérience vécue afin de créer des ponts entre employeurs, responsables d’associations ou institutions, personnes handicapées et acteurs de l’accompagnement. Cette action permet aux personnes en situation de handicap de découvrir, en conditions réelles, un milieu professionnel. Elles peuvent ainsi préciser leur projet professionnel et faire valoir leurs compétences auprès des employeurs.

Enfin, le Duoday permet aux professionnels de l’insertion d’avoir une vision plus précise des difficultés que peuvent rencontrer les entreprises dans l’intégration des travailleurs handicapés.
