Dass davon ausnahmsweise abgewichen wurde, lag laut Böhlen vorwiegend an der arten- und naturschutzrechtlichen Vorgabe, Rodungen bis spätestens Ende Februar vorzunehmen. Zwei Gerichtsurteile – des Verwaltungsgerichts Freiburg sowie des Verwaltungsgerichtshofs Mannheim – bestätigten die Entscheidung der Naturschutzbehörde.

In einem anderen Fall konnte der Ausschuss zum Bedauern der Vorsitzenden Böhlen keine Abhilfe schaffen. Ein 30-Jähriger aus Gambia kam während seiner Ausbildung zum Altenpflegehelfer in Abschiebehaft. Die Petition sei zeitgleich zur bereits eingeleiteten Abschiebemaßnahme eingegangen, erläuterte Böhlen. „Das Ansinnen wurde zu spät an uns herangetragen, um eine Aussetzung des Vollzugs gemäß des sogenannten Stillhalteabkommens zu bewirken.“ Eine Vertreterin des Innenministeriums habe in der Sitzung erläutert, dass selbst die Einstufung der Altenpflegehelferausbildung als „qualifizierte Ausbildung“ im Rahmen der baden-württembergischen 3+2-Regelung keine aufschiebende Wirkung entfaltet hätte.

Am 19. und 26. Februar 2018 stellte der Bürgerbeauftragte den Studierenden des Fachbereichs Kommunalverwaltung und staatliche allgemeine Verwaltung (KSAV) an der Thüringer Verwaltungsfachhochschule in Gotha seine Arbeit sowie die Rechtsgrundlagen seiner Tätigkeit vor. Er erörterte mit den angehenden Verwaltungsmitarbeitern des gehobenen Dienstes mögliche Kommunikationsstörungen im Prozess des „Bürger-Staat-Dialogs“. Um die Studierenden möglichst frühzeitig auf die Arbeit des Bürgerbeauftragten und auf die Herausforderungen in ihren späteren Tätigkeiten hinzuweisen, wurden die Bildungseinheiten erstmals neben dem Abschlussjahrgang bereits im 2. Studienjahr (Hauptstudium) absolviert. Ihnen soll damit die Möglichkeit gegeben werden, die in den Praktika gesammelten Erfahrungen im Umgang mit den Bürgern zu reflektieren und im weiteren Verlauf der Ausbildung mögliche Probleme im Bürger-Staat-Dialog zu erkennen.

An konkreten Beispielen aus seiner täglichen Arbeit machte Dr. Herzberg deutlich, welche Interessen die Bürger und die Verwaltung haben und wie störanfällig dieser Kommunikationsprozess in der Realität tatsächlich sein kann. Die Studierenden berichteten, dass sie in ihrer praktischen Arbeit bereits ähnliche Erfahrungen gemacht haben. Insofern schätzten sie die Unterrichtseinheit durch den Bürgerbeauftragten positiv ein. Dr. Herzberg betonte zudem, dass die Reflexion der Probleme, mit denen er im Rahmen seiner Tätigkeit konfrontiert wird, der Verwaltung helfen könne, selbst noch besser zu werden. Er warb bei den Studierenden dafür, zukünftig die eigene Arbeit kritisch zu hinterfragen und auch einmal die Sichtweise der Bürger einzunehmen, um wahrzunehmen, inwieweit Verwaltungsvorgänge für alle Betroffenen transparent und verständlich sind.
