The foster family was carrying for a group of five siblings for three years. They had very strong ties both to the foster parents and to their wider family. According to the Public Authority for Social and Legal Protection for Children (OSPOD), the foster parents were looking after the siblings well and there were no problems in their care so far. Unfortunately, the oldest of the siblings tragically died and the circumstances of his death were unclear at that time. Subsequently, the siblings were removed from the foster family on the basis of a provisional family measure. Children were separated and lost contact with the foster parents and with each other. The Ombudsman's inquiry showed that such a serious interference with the family life of children was not necessary.

As the circumstances of the tragedy were unclear and police was carrying out the criminal investigation the precaution taken by the public authorities was understandable. However, public authorities did not consider the option of asking the wider family of the foster parents for help although they were prepared to offer it. Children could have stayed together within the wider family until the situation calmed down and the criminal investigation was closed.

As a result, children lost contacts with the foster parents and with each other (the four siblings were separated into two couples who stayed together in two different foster families). According to the Ombudsman, public authorities failed to ensure the contacts of the children with the foster parents and with each other and did not sufficiently examine all possibilities of care for the children which would be less intrusive and would not violate their right to grow up together.

The Parliamentary Ombudsman, Mr Anthony C. Mifsud met Mr Victor Zaharia, UN Expert of the Sub-committee on Prevention of Torture.

The aim of the visit was to discuss the recommendations of a country report issued by the Sub-committee on Prevention of Torture. The meeting was also attended by Mr Paul Borg, Director General, Office of the Ombudsman.

Gli incontri  in programma già a partire dalla prossima settimana. Primo appuntamento con la cooperativa “Pars” di Corridonia. Nobili: “Ci sono situazioni che destano preoccupazione, richiedono di essere conosciute in previsione di adeguati interventi di rete sociale”.

Un percorso conoscitivo che andrà ad interessare le Comunità di accoglienza, ma anche realtà territoriali delle Marche particolarmente disagiate. E’ quello che sarà attivato fin dalla prossima settimana dal Garante dei diritti che, insieme alla direttrice dell’ Ussm  (Ufficio di servizio sociale per i minorenni) Patrizia Giunto, visiterà alcune strutture regionali con l’obiettivo di verificare la situazione per quanto riguarda l’ospitalità prevista per i minori sottoposti a procedimento penale e  più in generale per avere un quadro di riferimento dettagliato sull’adolescenza a rischio.
“Le Comunità – sottolinea Nobili – rappresentano un elemento di fondamentale importanza per il recupero sociale dei minori italiani e stranieri che hanno commesso reati e che per questo sono sottoposti a misura penale”.
Già sul finire del 2016 il Garante aveva presentato un report sulle comunità marchigiane, frutto di visite e confronti a diversi livelli, in grado di fornire un primo quadro di riferimento anche alla luce di mutamenti sociali e nuove emergenze, come quella dei minori stranieri non accompagnati, che nel corso del tempo hanno assunto aspetti di tipo strutturale.
“Oltre alle comunità –  conclude il Garante – oggi intendiamo allargare il nostro percorso conoscitivo anche ad alcune realtà che sono ormai da anni, e costantemente, sotto la luce dei riflettori. Ritengo che anche nel nostro territorio sussistano situazioni di disagio giovanile che destano preoccupazione, richiedono di essere conosciute in previsione di adeguati interventi di rete sociale”.
Il primo appuntamento sarà con la Pars di Corridonia, cooperativa nata nel 1990 e che attualmemte opera a diversi livelli nel campo delle problematiche educative e giovanili.
