Relocating unaccompanied children from Greece: what works and what does not

FRA provides practical suggestions to the EU and its Member States on the relocation process. At the same time, FRA urges Member States to agree on a simple and practical workflow as soon as possible to avoid lack of clarity and delays in the relocation process.

FRA’s practical suggestions to relocate unaccompanied children from Greece builds on lessons learned from previous mandatory and voluntary relocation schemes.

The suggestions concern all stages of the relocation process:

  • Identifying children for relocation
  • Appointing a guardian
  • Assessing the child’s best interests and providing information
  • Preparing the departure and transfer
  • Funding relocation of unaccompanied children

The practical suggestions are based on desk research and almost 50 interviews with national authorities and civil society organisations.

FRA conducted the interviews between November 2019 and March 2020 in 10 EU Member States: Belgium, Finland, France, Germany, Greece, Ireland, Italy, Malta, the Netherlands and Portugal.

In May 2020, the agency will publish a full report on the relocation of unaccompanied children.

It will explore the challenges and good practices gathered in the implementation of different relocation programmes since 2015.

The report will support national authorities to take measures, which fully comply with children’s fundamental rights and are practically feasible.

Following the recommendations made by the Seimas Ombudsman, Vilnius Street in Vilnius city will be safer both for pedestrians and cyclists

Milda Vainiute, Seimas Ombudsman of the Republic of Lithuania, investigated a complaint of Vilnius resident regarding lack of traffic safety on Vilnius Street. During investigation concerns were raised by information obtained from the policethat 6 traffic accidents involving pedestrians and cyclists were registered on this street between 09.09.2016 and 01.01.2018.

The Seimas Ombudsman established that Vilnius City Municipality unreasonably had not referred the applicant's request to the Municipal Traffic Safety Commission (Further on - Commission) for examination under its competence and stated that the establishment of a cycling team in the Municipality does not eliminate the competence of the Commission in matters of road safety established by the Law on Road Traffic Safety of the Republic of Lithuania. 

Moreover, during the investigation, Vilnius City Municipality did not explain what specific additional traffic safety measures were applied to the traffic of the bicycle riders on Vilnius Street, especially to the general bicycle and pedestrian traffic on this street, and did not provide the applicant with a final answer/information regarding specific safety measures on Vilnius Street that were taken or if none of the measures were taken, for what reason.

Only after the recommendations made by the Seimas Ombudsman, the Administration of Vilnius City Municipality, following the established procedure and competence, submitted the problem raised by the applicant regarding the provision of traffic safety on Vilnius Street to the Commission for consideration. The question regarding the safety of pedestrian-bicycle path on Vilnius Street (between Labdarių St. and Gediminas Ave.) was discussed in the Commission meeting of 19 December 2019.

After the discussion, the Commission approved "the elimination of bicycle lanes on Vilnius Street (between Labdarių St. and Gediminas Ave.) and instructed the municipal structural units to “develop recommended parameters for pedestrian-bicycle passage in cafe areas”, “organise mapping of outdoor cafes”, and to take other necessary measures in order pedestrians and cyclists feel safer.

Istituti penitenziari e comunità per minori, l’attività di monitoraggio non si ferma

Il Garante dei diritti, Andrea Nobili, rende noto che gli uffici continuano a mantenere attivi tutti i servizi attraverso la modalità dello smart working. Colloqui a distanza, via Skype, con i detenuti ed i referenti dei presidi sanitari carcerari. Contatti con le strutture che ospitano i minori

“I nostri uffici continuano a garantire tutti i servizi attraverso la modalità dello smart working, a cui sono stati chiamati i dipendenti in relazione all’emergenza Coronavirus”. Lo rende noto il Garante dei diritti, Andrea Nobili, che si accinge ad attivare colloqui a distanza, via Skype, con i detenuti degli istituti penitenziari marchigiani e con i referenti dei presidi sanitari carcerari.
“L’azione di monitoraggio è costante – prosegue Nobili – soprattutto per quanto riguarda l’aspetto strettamente sanitario, di per sé già complesso negli stessi istituti. Non posso che rinnovare l’appello ai detenuti, invitandoli ad un grande senso di responsabilità per la tutela della loro salute e di quanti operano nelle strutture”.
Il Garante ha anche avviato contatti con le comunità educative per minori presenti sul territorio marchigiano per verificare che sia messa in atto la massima tutela nei confronti dei ragazzi.
“Il momento è difficile – sottolinea – ma dobbiamo mettere in campo tutte le energie possibili per contribuire, attraverso il compito che ci è stato affidato e le possibilità che abbiamo, al raggiungimento di una soluzione positiva. Rinnoviamo la nostra fiducia nell’encomiabile lavoro portato avanti da tutto il personale sanitario e rivolgiamo ai cittadini l’invito a rispettare le regole, nella consapevolezza che i diritti si rafforzano e si alimentano anche non venendo meno ai doveri”.
