Chamber of Deputies of the Czech Republic elected Mr. Stanislav Křeček as the new Public Defender of Rights for the term of six years. Mr. Křeček succeeded Ms. Anna Šabatová and took his office on 19 February 2020.

Stanislav Křeček served as the Deputy of Ombudsman until December 2019. Therefore, he entered the office with the widespread experience.

JUDr. Stanislav Křeček was born on May 20, 1938 in Prague. He graduated from the Industrial School of Geology, the School of Creative Arts and the Faculty of Law of Charles University. After the graduation he became a trainee judge at the Municipal Court in Prague. After being forced to leave his judicial profession due to political reasons in the 1970s, he made his living as an artist, geologist, miner, worker, etc. Since 1990 he has devoted himself to advocacy.

After the change of political regime, he continued with his political activities: as the member of the Czechoslovak Socialist Party, following the removal of the ‘Iron Curtain’, he was co-opted as the Member of the Czech National Council in 1990. Since 1993, he was a member of the Czech Social Democratic Party (ČSSD) and from 1998 to 2013 he served under its auspices as a MP in the Chamber of Deputies. He also held the position of a member of the Municipal Assembly of Prague 2 City Ward in 2006 – 2010.

Within the framework of the parliamentary mandate, he was, inter alia, Vice-Chairman of the Committee on Constitutional and Legal Affairs of the Chamber of Deputies, a member of the Mandate and Immunity Committee, Committee on Petitions, Electoral Committee, Subcommittee on Human Rights etc.

After being elected as the Deputy Ombudsman on 3 April 2013, he resigned from his parliamentary function and discharged the office for six years. During this time, he placed particular emphasis on issues related to construction procedure, State administration of courts, consumer protection, land-use law and activities of the Land Registry Office, as well as problems related to roads, right to information, misdemeanors and other linked issues. 

Also, during his whole career, he has long been involved in the issues of lease relations – in 1991 he became the co-founder and the chairman of the Czech Association of Tenants.

Volksanwaltschaft war mit „Frauen am Zug“

Anlässlich des internationalen Weltfrauentags organisierte die Weltkultur-Region Semmering Rax zusammen mit dem Frauenberatungsverein Wendepunkt sowie mit Unterstützung der ÖBB eine fahrende Messe von und für Frauen. Der Zug fuhr von Wiener Neustadt nach Mürzzuschlag und zurück. Viele Organisationen, Beratungsstellen und Unternehmen boten in diesem Zug Informationen über ihre Arbeit und ihre Unterstützungsangebote sowie Gespräche an, so auch die Volksanwaltschaft.

Die Volksanwaltschaft hat das erklärte Ziel, vermehrt Frauen anzusprechen. Diese Veranstaltung anlässlich des internationalen Weltfrauentags eignete sich dafür sehr gut, da die im Zug anwesenden Frauen hervorragende Multiplikatorinnen sind, um die Informationen an ihre Organisationen weiterzutragen und somit helfen zu können, noch mehr Frauen zu erreichen. Selbstverständlich konnten die Vertreterinnen der Volksanwaltschaft auch mit individuell interessierten Frauen sprechen, ihnen die Arbeit der Volksanwaltschaft näher bringen und aufklären, in welchen Bereichen die Volksanwaltschaft in konkreten Fällen helfen kann.

Der Austausch während der Zugfahrt und im Südbahnmuseum in Mürzzuschlag, das der Bürgermeister von Mürzzuschlag den Teilnehmerinnen präsentierte, war auch deshalb überaus wertvoll, um Vertreterinnen anderer Organisationen kennenzulernen, an welche die Volksanwaltschaft Menschen verweisen kann, wenn sie nicht selbst unmittelbare Unterstützung anbieten kann. Je dichter das Netzwerk ist, desto mehr und besser kann Menschen geholfen werden.

“Frustration And Suspicion” At Lost Records: Ombudsman Report

Service users and their families are being left feeling frustrated and suspicious by health and social care providers losing their medical records, a special Ombudsman report has revealed.

The Public Services Ombudsman for Wales highlighted a sample of cases in his latest thematic report, Justice Mislaid: Lost Records and Lost Opportunities, that he has considered where health and social care records have been mislaid or lost.

He warned that in some cases complainants were left with additional distress at a time when a loved one has passed away.

Examples included:

  • Consultants mistakenly discussing another patient’s medical records in a meeting with a grieving daughter following her father’s death.
  • A Health Board not having any record of a woman giving birth to her newborn child at a hospital apart from a copy of a prescription held at its pharmacy.
  • A patient who was already concerned about the security of his treatment records being repeatedly sent records relating to a different patient.

The Ombudsman called for effective records management policies and processes, robust training and clear and detailed search and reporting procedure for use when records are misplaced or lost.

Commenting on the report, Nick Bennett, Public Services Ombudsman for Wales, said:

“I urge all public services to consider Justice Mislaid: Lost Records And Lost Opportunities and ensure best practice is a good traveller across Wales.

“The detrimental effect of the lost records on complainants is evident as they are left feeling frustrated and suspicious as their concerns are left unanswered. Tragically, in some cases, relatives have been left feeling that they cannot grieve properly because of a health board’s lack of full investigation.

“At the same time, organisations are missing out on an invaluable learning opportunity if complaints cannot reach their conclusion.”

Este lunes, 9 de marzo, el Síndic de Greuges de Cataluña, Rafael Ribó, acompañado del adjunto general, Jaume Saura, y otros miembros del equipo, ha comparecido en el Parlamento de Cataluña para el debate en la Comisión del Síndic de Greuges de su Informe anual del Mecanismo Catalán de Prevención de la Tortura y el informe El derecho de manifestación y el papel de los cuerpos policiales en las movilizaciones posteriores a la Sentencia del Tribunal Supremo 459/2019.

El informe del Mecanismo Catalán de Prevención de la Tortura

El Informe anual del Mecanismo Catalán de Prevención de la Tortura recopila las conclusiones y las recomendaciones más destacadas incluidas en el Informe anual correspondiente al año 2019. Durante 2019 el Equipo de Trabajo del Mecanismo visitó 42 centros con personas privadas de libertad, siguiendo el protocolo pautado, es decir: sin aviso previo y con pleno acceso, en privado, a estas personas.

En este ámbito, el Síndic recuerda que el Protocolo de Estambul pauta la vista médica en privado como derecho de la persona detenida y recomienda una mayor interacción entre el sistema penitenciario y el de atención a la gente mayor, en cuanto a la cobertura de las necesidades de este colectivo vulnerable. Además, insta a la revisión de los protocolos de actuación de los diferentes cuerpos policiales en el circuito de detención y subraya la importancia para garantizar la igualdad efectiva entre hombres y mujeres en los centros penitenciarios.

Informe Derecho de manifestación y papel de los cuerpos policiales en las movilizaciones posteriores a la Sentencia 459/2019

Este informe analiza la actuación de los dispositivos policiales desplegados desde el 13 al 27 de octubre y los posibles derechos vulnerados en el contexto de las movilizaciones ciudadanas.

La institución concluye que la mayoría de manifestaciones, las más multitudinarias, se desarrollaron en un clima pacífico y tranquilo; en cambio, algunas manifestaciones minoritarias tuvieron un carácter violento que hicieron necesaria la intervención de las fuerzas de seguridad. En opinión del Síndic, las alegaciones de exceso de fuerza y de vulneración de derechos, una vez investigadas, se deben sancionar adecuadamente en caso de que hayan existido infracciones.
