Autistic boy denied parking bay by Tower Hamlets

A young boy with autism, and his family, were denied a parking bay outside their house by London Borough of Tower Hamlets, despite him receiving the highest rate of Disability Living Allowance for his mobility, the Local Government and Social Care Ombudsman has found.

After the Ombudsman found the council applied too rigid an approach when considering the family’s application, the council has agreed to create the bay for the family, review its parking bay policy for how it should take hidden disabilities into account and contact those refused a parking bay over the past year and tell them about the changes to its policy.

The boy, who is of primary school age, has a number of physical conditions and severe behavioural problems which mean that, although he is physically capable of walking, he sometimes refuses to walk and uses a wheelchair to get around.

When assessed for a blue badge parking permit, an assessor felt the boy’s needs were among the highest she had seen. Although he did not meet the physical criteria, the council awarded the family a blue badge on appeal.

The family told the council they needed a parking bay outside their house because of his medical conditions. He was unaware of dangers and would run out into the road. His behaviour meant he would have meltdowns and refuse to walk if he could not see the front door of his house when in the car or have a straight route to the car from his house. They also needed to be able to transport his special needs pushchair.

Despite this, the council did not properly consider the boy’s significant additional needs when it decided the family did not meet its criteria for a parking bay.

The Ombudsman’s investigation found the council at fault for not giving the family clear reasons when it initially denied the family a Blue Badge, or why it changed its decision. Had the council done so, the family could have used that information to support their parking bay application.

The Ombudsman also found the council did not consider properly whether to treat the family’s application as one of the exceptions allowed under its parking bay policy or whether it was right to apply the policy rigidly given the family’s circumstances.

Michael King, Local Government and Social Care Ombudsman, said:

“While the council needs to set criteria for considering whether someone is eligible for a parking bay, they should not be applied so rigidly as to deny a space to families such as this who have a very obvious and significant need.

“London Borough of Tower Hamlets has now agreed to create a parking bay for this family, but also amend its policy and write to other people who have been refused a parking bay to tell them of the changes.

“I hope this, and the other actions I have recommended, will ensure people’s applications will be considered more holistically in future.”

The Local Government and Social Care Ombudsman’s role is to remedy injustice and share learning from investigations to help improve public, and adult social care, services. In this case the council has agreed to install a parking bay outside the family’s home, and pay them £1,000 to reflect the significant distress caused by the delay in making this happen.

The Ombudsman has the power to make recommendations to improve processes for the wider public. In this case, the council has agreed to ensure officers are aware of the implications of an award of higher rate mobility Disability Living Allowance and that decisions relating to parking bay applications take into account both the exceptions in its policy and the council’s general discretion. It will also ensure decision letters on both Blue Badge and parking bay applications contain sufficient information to enable the applicant to clearly understand the reasons for that decision.

The council will also review its parking bay policy, having regard to how it should take into account hidden disabilities. It will then write to those applicants who have been refused a parking bay over the past year and tell them about the changes to its policy.

Local governments to allocate funds to improve the position of LGBTI persons

Local governments should explicitly include LGBTI people in their action plans, prescribe measures to improve their position and allocate appropriate budget funds for those activities, Deputy Protector of Citizens for Gender Equality Ms. Jelena Stojanović said.

At the outset of the first out of five planned trainings on the inclusion of LGBTI people in local action plans, held in Ražanj on Wednesday 28 October 2020, Ms. Stojanović accentuated that the Protector of Citizens’ surveys and practice indicated that LGBTI people, i.e. people with different sexual orientation and different sexual orientation and gender identity, often faced discrimination and other forms of human rights violations.

Ms. Stojanović said that they often faced hate speech and hate crimes because of the prejudices and stereotypes that existed in our society and that was why taking measures to protect and improve the position of LGBT people in their local community was vital.

Five trainings on the inclusion of LGBTI people in local action plans are jointly implemented by the Protector of Citizens and the Association Duga from Šabac, within the Council of Europe project "Promotion of Diversity and Equality", with the support of the European Union.

According to the plan, from 28 October to 11 November 2020, five one-day trainings will be held for representatives of a total of 15 local self-government units on measures to improve the position of LGBTI people in local communities.

The hosts of the trainings are Ražanj, Valjevo, Pančevo, Novi Sad and Kragujevac, and representatives of local self-government bodies from Kruševac, Boljevac, Mionica, Užice, Zrenjanin, Požarevac, Sombor, Senta, Babušnica and Vlasotince will also take part in the trainings.

Fixkostenzuschusses nur mit Steuerberater oder Steuerberaterin?

Als Unterstützung für Unternehmer und Unternehmerinnen, die aufgrund der Covid Situation Hilfe vom Staat in Anspruch nehmen müssen, stellt die COFAG, die Finanzierungsagentur des Bundes, Fixkostenzuschüsse bereit. Die Anträge dazu kann man auf FinanzOnline stellen. Dem Ein-Personen-Unternehmer Herrn W. aus dem Mühlviertel wurde ein solcher Fixkosten-Zuschuss genehmigt und dieser wurde ihm auch bereits zur Hälfte ausbezahlt. Herr W. meinte, die erste Phase sei sehr übersichtlich aufgebaut und einfach zu befüllen gewesen. Ihm wurde sehr rasch und unbürokratisch die komplette Summe genehmigt und die erste Tranche auch problemlos ausbezahlt. Für Phase 2 benötigte der oberösterreichische Unternehmer jedoch plötzlich einen Steuerberater, da der Menüpunkt für die Auszahlung in FinanzOnline nicht mehr vorhanden und nur mehr über einen Steuerberater abrufbar war. Ursprünglich gab es jedoch keine Steuerberaterpflicht bis zu einem Schwellenwert von 12.000 Euro, was offenbar geändert wurde. Der Steuerberater, den er für die Auszahlung der zweiten, bereits genehmigten Tranche brauche, würde den Unternehmer aber in etwa jene Summe kosten, die ihm der Staat als Unterstützung auszahlen würde. Volksanwalt Werner Amon fordert daher eine einfachere Lösung.

Der Sprecher des Finanzministeriums betonte, dass es das Ziel sei, den Unternehmern und Unternehmerinnen rasch und unbürokratisch zu helfen. Man müsse aber darauf achten Fördermissbrauch zu verhindern, weshalb die Auszahlung mithilfe eines Steuerberaters erfolgen müsse. Volksanwalt Amon unterstützt zwar das Vorhaben, die Hilfe rasch und unbürokratisch bei den Unternehmern und Unternehmerinnen ankommen zu lassen, kritisiert aber, dass man während des Prozederes die Richtlinien geändert habe. In der Sendung versprach das Finanzministerium, dass es sich der Sache annehmen und erneut prüfen werde, wie man dieses Problem gegebenenfalls verbessern könnte. Die Volksanwaltschaft bleibt in jedem Fall an der Sache dran.

Härtefallfonds – wie kommen ausländische 24-Stunden-Pflegekräfte an ihr Geld?

Die Abhängigkeit des heimischen Pflegesystems von 24-Stunden-Betreuerinnen und -Betreuern aus dem zumeist europäischen Ausland ist in der Corona-Krise einmal mehr deutlich geworden. Trotz hoher Verdienstrückgänge wegen geschlossener Grenzen bekommen viele von ihnen aber keine Unterstützung aus dem Härtefallfonds, unter anderem weil sie kein inländisches Bankkonto besitzen. Inländische und Konten im europäischen Ausland sind gleich zu behandeln, stellt Volksanwalt Amon klar. Er sieht dringenden Änderungsbedarf in den Förderbedingungen.

Das Bundesministerium für Finanzen argumentiert die Notwendigkeit eines inländischen Kontos mit der Begründung, Missbrauch vermeiden zu wollen. Zahlungen aus dem Härtefallfonds würden zudem einer Besteuerung im Heimatland der Pflegerinnen unterliegen und man wolle das verhindern. Dem widersprach Volksanwalt Amon deutlich und kritisierte die Vorgehensweise des Finanzministeriums, da es hier um Personen gehe, die in Österreich arbeiten, einen österreichischen Arbeitgeber haben und hier in Österreich ihre Abgaben zahlen: „Es ist ein Faktum, dass es eine Verordnung der Europäischen Union gibt, die sogenannte SEPA (Single Euro Payments Area) Verordnung“, stellte Amon klar – das heißt jedes Konto im EU Ausland ist genauso gut wie ein österreichisches Konto. Die Volksanwaltschaft verstehe nicht, welchen Missbrauch das Finanzministerium hier befürchte, unterstrich Amon seine Kritik.

„Wir möchten die Pflegekräfte ja weiterhin motivieren, auch in Zukunft nach Österreich zu kommen“, weshalb es nicht sein könne, dass das Geld bei den Pflegekräften gar nicht ankomme. Es müsse eine rasche Lösung her, so Amon. Das Finanzministerium bot in der Sendung den Pflegerinnen  und Pflegern abschließend an, sich direkt an das Bundesministerium für Finanzen zu wenden, wenn es Probleme mit einem österreichischen Bankkonto gäbe, und versucht auch in anderen Fällen eine Lösung zu finden. Auch hier wird die Volksanwaltschaft an der Sache dranbleiben, damit die betroffenen Pflegekräfte an das Geld aus dem Härtefallfonds kommen können.

(FRA) UN cooperation with European regional human rights offices

The United Nations Office of the High Commissioner for Human Rights (OHCHR) regularly consults regional offices responsible for promoting and protecting human rights on how to coordinate their work better.

FRA will take part in the virtual meeting of focal points of regional human rights mechanisms on 9 November.

FRA will present its European Union Fundamental Rights Information Tool (EFRIS). It will also debrief the group on the Fundamental Rights Report 2020, its recent report on NHRIs, and its work on the fundamental rights’ impact of COVID-19.

The workshop will bring together representatives from the Council of Europe, the Office for Democratic Institutions and Human Rights of the OSCE and other regional mechanisms.
