Plus de trois ans après avoir été introduit parmi les motifs de discriminations prohibés par la loi, le critère de « particulière vulnérabilité résultant de la situation économique » reste peu mobilisé par les victimes. Bien que reconnues comme un facteur d’injustice, les situations de discrimination engendrées par la précarité sont difficiles à mesurer et reste peu documentées.

En 2019, moins de 2 % des réclamations, adressées au Défenseur des droits soulevant une discrimination concernaient ce critère. Pourtant, leurs instructions ont pu mettre en évidence l’existence de processus d’exclusion ou de discriminations fondées sur ce motif en particulier dans l’accès au logement social, à l’éducation, à la cantine pour les enfants issus de familles défavorisées, ou encore à la santé...
