El Defensor pide la abolición de las sujeciones mecánicas en los centros de menores infractores

El Defensor del Pueblo (e.f.), Francisco Fernández Marugán, ha formulado recomendaciones al Ministerio de Justicia, a la Ciudad Autónoma de Melilla y a la Junta de Andalucía con el objetivo de abolir las sujeciones mecánicas en los centros de internamiento de menores infractores de todo el territorio nacional.

Fernández Marugán ha pedido al Ministerio de Justicia que derogue el apartado del reglamento de responsabilidad penal de los menores en el que se regulan las sujeciones mecánicas para acabar con estas prácticas como medio de contención en estos lugares.

En su opinión, “es necesaria una decisión rápida y radical, que termine definitivamente con las sujeciones mecánicas. Y esta decisión exige la reforma del Reglamento de la Ley Orgánica de Responsabilidad Penal de los Menores”.

Por otra parte, el Defensor ha reclamado a la Ciudad Autónoma de Melilla y a la Junta de Andalucía que suspenda la práctica de sujeciones mecánicas a las personas que se hayan bajo custodia en los centros de su jurisdicción, dictando a tal efecto las instrucciones oportunas.

Para Fernández Marugán, “la práctica de la sujeción mecánica  exige el uso de la fuerza, por lo que constituye siempre una situación de riesgo, estando en juego derechos tan fundamentales como el derecho a la vida y el derecho a la integridad física”.

Desde hace años, el Defensor del Pueblo viene actuando en relación a la práctica de sujeciones mecánicas a personas privadas de libertad. Así, en 2017, publicó una Guía de buenas prácticas en contenciones mecánicas en la que pedía que se evitaran las reducciones a través de acciones potencialmente lesivas para internos e internas y abogaba por realizar maniobras previas de diálogo o desescalada con personal entrenado y formado para ello. “Debe agotarse la vía del diálogo durante el tiempo suficiente como para considerar que no existe otra alternativa”, aseguraba.

Desde 2017 dos jóvenes han muerto (Melilla y Almería) tras ser sometidos a una contención mecánica. Fernández Marugán insiste en que “no puede volver a morir nadie en España en estas circunstancias”. Así, ha asegurado que “lo rechaza la conciencia, lo rechaza la justicia, lo rechaza el derecho de estos adolescentes a ser protegidos por el Estado para que puedan alcanzar una vida plena en la que superen, ya adultos, las dificultades que les llevaron a terminar en una privación de libertad antes de la  mayoría de edad”.

El Defensor apunta que existen alternativas a la sujeción para afrontar una situación de tensión o de violencia. En esta línea, aboga por “técnicas no invasivas, propias de una nación civilizada y del desarrollo del conocimiento científico, que permiten abordar con éxito situaciones límite sin poner en riesgo la vida ni la integridad física de quienes han de ser sometidos a ellas”.

Esta tesis coincide con lo expresado por el Comité de Prevención de la Tortura (CPT) que, en su informe emitido en 2017, tras la visita girada a España el año anterior, consideraba que “inmovilizar a menores en una cama o esposarlos a objetos fijos en una celda de aislamiento es un uso desproporcionado de la fuerza y una medida incompatible con la filosofía de un centro educativo que debería enfocarse en la educación y la reintegración social de los menores […]. En su lugar, deberían emplearse métodos alternativos en la gestión de incidentes violentos y otros medios de contención, tales como las técnicas verbales que impiden que aumente el conflicto y el control manual”.

Nueva visita a “Tierras de Oria”

Técnicos de la Institución inspeccionaron ayer de nuevo el centro “Tierras de Oria” en el que en julio de 2019 falleció un joven mientras se le aplicaba esta medida de contención. Esta es la segunda visita a este lugar. En marzo de 2018, el Defensor del Pueblo en su condición de Mecanismo Nacional de Prevención de la Tortura (MNP), ya encontró deficiencias relacionadas con la práctica de contenciones mecánicas, tales como una falta de adecuación de la habitación para la aplicación de este tipo de medidas coercitivas y la ausencia de un libro de registro en el que quedara apuntado el uso de la contención a los menores.

Por ello, tras esta inspección, la Institución sugirió a la Junta de Andalucía que adecuara una habitación de mayores dimensiones para la aplicación de las sujeciones mecánicas, con la cama articulada y anclada en el suelo en posición central, con interfono y sistema de videovigilancia con audio.

(EP) Petitions MEPs sound alarm over Japanese parental child abduction

The Petitions Committee is concerned over parental child abduction in Japan and the reluctance of the Japanese authorities to comply with international law.

In a draft motion for a resolution adopted on Tuesday with 33 votes in favour and none against, the Petitions Committee expresses concerns over children’s wellbeing as a result of parental child abduction in Japan and urges Japanese authorities to enforce international rules on child protection.

 

The resolution comes as a result of a high number of petitions from EU citizens addressing concerns over the lack of enforcement of court decisions in Japan to return children to their country of habitual residence, provided under the 1980 Hague Convention on the Civil Aspects of International Child Abduction. Petitions highlight the lack of provisions under Japanese law for shared custody and prevention of children to maintain meaningful contacts with non-Japanese parents, and the harmful effect this could have on the welfare of the child.

 

Enforcing international law

 

The Petitions Committee urges Japanese authorities to follow international recommendations and to introduce changes to their legal system by putting in place rules on shared custody, so that their domestic laws align with their international commitments, namely the UN Convention on the Rights of the Child (UNCRD). As a strategic partner, Japan should also enhance cooperation with the EU and improve the enforcement of domestic and foreign court decisions on the return of the child and on access and visiting rights granted to the left-behind parents.

 

MEPs underline that safeguarding the child’s best interest must be the primary concern of authorities and urge for the swift handling of abduction cases to avoid long-term adverse consequences for the child and the future relationship with the non-custodial parent.

 

Support for families

 

Due to the cross-border nature of these legal disputes, the Petition Committee insists that all child protection systems have transnational mechanisms in place. They propose the development of citizen-friendly European information support for parents in cross-border disputes and recommend member states make available reliable information on family law and children’s rights in third-countries like Japan.

Protecting the rights of persons with intellectual disabilities and mental health problems during the COVID-19 crisis

Measures taken during and after the pandemic must be adapted to the specific needs of people with intellectual disabilities, who are disproportionately affected by COVID-19.

In a draft motion for resolution adopted on Tuesday with 33 votes in favour and none against, the Committee on Petitions urges member states to ensure equal and non-discriminatory access to healthcare and social services to persons with intellectual disabilities, in compliance with the UN Convention on the Rights of Persons with Disabilities.

 

Impacts of confinement

 

The Committee on Petitions is deeply concerned over the disproportionate impact of COVID-19 on persons with intellectual disabilities and mental health problems and warn that strict confinement measure have caused additional isolation and harm to their mental health.

 

MEPs underline that all health communication related to the pandemic and confinement measures must be accessible for persons with disabilities in plain language and in several traditional and digital format, as well as in national sign language. Member states should also provide psychological support to people with intellectual disabilities to soften the impact of confinement measures and ensure they have access to legal recourse, with special attention given to proactively identifying those without legal capacity or access to a legal guardian to protect their rights.

 

Reinforcing support systems

 

The current situation around COVID-19 has exposed the persistent social segregation and discrimination of persons with disabilities, according to the draft report, as well as major flaws in support systems, healthcare and education. Barriers to access health services and hygiene must be removed, underline MEPs and call on the Commission to mobilise essential investments and resources to guarantee the continuity of care and support services.

 

MEPs also call for the prioritisation of investments towards a gradual transition from institutional care to community based services for persons with intellectual disabilities and the use of funds to support the provision of personalised support services. They also demand better use of digital technologies and applications for the promotion of independent living and distance learning.

 

Preparing for future risks and emergencies

 

The draft resolution calls on the Commission and member states to ensure common protocols for possible future humanitarian emergencies or health disasters, based on lessons learnt from the current crisis, taking into account the specific needs and circumstances of persons with disabilities. The adoption of any future measures should involve persons with disabilities from the outset, stress MEPs.

 

The Petitions Committee also calls on the Commission to put forward a comprehensive, ambitious and long-term post-2020 European Disability Strategy proposal, which takes into account lessons learnt from the COVID-19 crisis.

Background information

 

This draft motion for resolution comes after the examination of petition 0470/2020 on 19 May 2020 by the Committee on Petitions, related to the situation of people with intellectual disabilities and their families during the COVID-19 crisis and lockdown phase. The petitioner highlights the harmful effects of lockdown, such as the disruption of habitual health treatment, personal assistance and closing down of medical facilities and requests that measures taken during the health crisis and its aftermath are compatible with both the EU Charter of Fundamental Rights and the UN Convention on the Rights for Persons with Disabilities.

Prosegue l’azione di monitoraggio messa in atto dal Garante. Visita presso la Casa circondariale di Fermo, prevedendo i colloqui con i detenuti ed un confronto diretto con Direttore, Comandate della Polizia penitenziaria, dirigente medico e referente delle attività trattamentali. Prossimi appuntamenti a Marino del Tronto e Fossombrone

Nuovo appuntamento per il Garante Andrea Nobili nell’ambito dell’azione di monitoraggio degli istituti penitenziari, riavviata in presenza dopo il periodo di lockdown reso necessario dall’emergenza epidemiologica. Visita alla Casa circondariale di Fermo per i colloqui con i detenuti, ma anche per una visione complessiva della situazione. Come per le altre strutture regionali, infatti, Nobili ha ritenuto opportuno chiedere un incontro a Direttore, Comandate della Polizia penitenziaria, dirigente medico e responsabile delle attività trattamentali.
“Una scelta dettata dall’esigenza – come evidenziato dal Garante – di seguire da vicino le varie fasi del ritorno alla normalità, che nell’ambito carcerario merita ancor più attenzione e prudenza. Affrontando le diverse problematiche, è emerso che a Fermo non c’è più un referente effettivo per le attività trattamentali. Un aspetto che sarà oggetto di segnalazione, perché riteniamo che si tratti di una figura importante all’interno degli istituti”.
E nell’ambito di una riflessione più generale, Nobili non manca di sottolineare che “se finora il sistema carcerario nelle Marche ha retto all’uragano sanitario è anche merito della Polizia penitenziaria. Nel nostro territorio, per quello che ho potuto constatare, opera con serieta’ e attenzione, anche ai diritti dei detenuti. Un’attenzione che, spesso, contribuisce a rendere più umano il mondo del carcere”.
Con le stesse modalità degli incontri estesi a più componenti, nei prossimi giorni verranno effettuate le visite presso gli istituti di Marino del Tronto ad Ascoli Piceno e Fossombrone.
A completare l’azione di monitoraggio altri incontri attivati per approfondire gli interventi all’interno dei penitenziari. Nei giorni scorsi un confronto diretto, in via telematica, con i rappresentanti delle diverse realtà di volontariato. Un appuntamento ormai consolidato nell’agenda del Garante, al quale hanno anche partecipato il Provveditore dell’amministrazione penitenziaria di Emilia Romagna e Marche, Gloria Manzelli, e il dirigente dell’area detenuti e trattamento Prap, Marco Bonfiglioli.
