El Ayuntamiento de Bilbao reconoce el empadronamiento de un ciudadano con la antigüedad necesaria para solicitar prestaciones

Un ciudadano que había sido solicitante de protección internacional y que había estado inscrito en el padrón municipal acudió al Ararteko por su situación padronal en Bilbao. En octubre de 2019 el Ministerio de Interior le denegó la solicitud de protección internacional y un mes más tarde presentó en la Embajada de la República Democrática del Congo la solicitud de expedición de pasaporte.

En junio de 2020 solicitó un cambio de domicilio en el Registro del Ayuntamiento de Bilbao y le informaron de que debía presentar el pasaporte como documento identificativo en la solicitud de inscripción padronal.

Alegó que desde la denegación de la solicitud de protección internacional había llevado a cabo todos los esfuerzos necesarios para la expedición de su pasaporte por parte de la República Democrática del Congo. La declaración del estado de alarma derivada de la pandemia interrumpió la atención presencial por parte de la Embajada, que informó a la Comunidad Congoleña de España de que la recopilación de los datos biométricos para la concesión de los pasaportes estaría suspendida hasta nueva orden.

El Ayuntamiento de Bilbao le denegó la solicitud de inscripción en el padrón municipal, por no aportar documentación identificativa suficiente y en vigor. Acudió de nuevo a pedirla inscripción en el padrón, adjuntando el certificado de haber pedido el pasaporte en la Embajada en España de la República Democrática del Congo.

En aquel momento le informaron de que estaba de baja en la inscripción en el padrón, y remitió un correo al ayuntamiento, adjuntando determinada documentación y solicitando que se incorporara al expediente y que se revisara la baja en la inscripción en el padrón municipal. La documentación consistía en un escrito en el que explicaba su situación, la autorización del empadronamiento, el certificado de pasaporte y la comunicación de la Embajada.

En febrero del 2021 obtuvo su pasaporte y se inscribió en el padrón del municipio en el que actualmente reside. No obstante, el hecho de que haya un hueco en el padrón municipal de un año le está causando dificultades, ya que la normativa que regula el acceso a determinados servicios y prestaciones exige acreditar un periodo previo continuado de empadronamiento.

El Ararteko considera que no cabía la denegación de la solicitud de cambio de domicilio en la inscripción en el padrón municipal y recomendó al Ayuntamiento de Bilbao que la revisara.

El ayuntamiento nos ha informado que registrará el cambio de domicilio y reconoce el empadronamiento desde octubre de 2018. Esto permitirá al ciudadano disponer de la antigüedad necesaria en el padrón y acreditar la residencia efectiva para solicitar las prestaciones.

This year, FRA renews its cooperation with this human world 2021, an international human rights film festival.

It will present two films. ‘Instructions for Survival‘ is a documentary that explores the challenges facing a young transgender man and his girlfriend in Georgian society as they dream of a better future in the EU. It runs from 7 to 9 December at 18:00. FRA will host and moderate a panel debate around the film on 12 December at 19:15.

'Shadow Game' is a documentary that follows teenagers fleeing their war-torn homelands to seek refuge in the EU, only to be met by more violence at the borders. It runs from 8 to 10 December at 18:00. FRA will host and moderate a panel debate about the issues in the film on 8 December at 19:35.

The festival opens on 6 December.

FRA will join a webinar on the rise of Human Rights Cities in the EU on 3 December.

The Cologne Human Rights City Initiative(link is external) organises the event(link is external). It is a bottom-up initiative aiming at mobilising Cologne to become a human rights city. FRA will present the new framework for Human Rights Cities in the EU and how this framework fits into EU policy developments. FRA will also lay down concrete ways for cities, such as Cologne and other local governments, to use the framework in their local context. A representative from Utrecht will illustrate what it means to be a Human Rights City and its positive impact on the work of the municipality, and on people more broadly in the city. He will also highlight new opportunities for cooperation and development of Human Rights Cities in the EU, building on the new framework. The event aims to bring together local politicians, city officials, employees of municipal organisations, academic experts and civil society from Cologne and other cities in Germany and abroad, as well as interested individuals from the public. This webinar is the second of a series of five webinars that will be organised until Spring 2022 by the Cologne Human Rights City Initiative.

Judgment in Case C-3/20 LR Ģenerālprokuratūra

Where a criminal authority finds that the conduct investigated by it of a governor of a central bank of a Member State was manifestly not committed by that governor in his or her official capacity, proceedings against him or her may be continued since immunity from legal proceedings does not apply

Acts of fraud, corruption or money laundering are thus not carried out by such a governor in his or her official capacity

In June 2018, the Latvian Public Prosecutor charged the Governor of the Central Bank of Latvia (‘AB’) for various offences of corruption before the Rīgas rajona tiesa (Riga District Court, Latvia). Specifically, AB is accused of having accepted two bribes in connection with a procedure relating to prudential supervision of a Latvian bank and for having laundered the money from one of those bribes.

As Governor of the Central Bank of Latvia, AB, whose last term of office as governor ended in December 2019, was also a member of the General Council and the Governing Council of the European Central Bank (ECB).

Petri Jääskeläinen continues as Ombudsman

Doctor of Laws Petri Jääskeläinen has been re-elected to serve as Parliamentary Ombudsman for a term of four years. 

His term will begin on 1.1.2022 and end on 31.12.2025. The election of Dr. Jääskeläinen was confirmed at the plenary session on 30.11.2021. Dr. Jääskeläinen was the only person who had submitted his candidature for the post. 

Dr. Jääskeläinen has already acted as Parliamentary Ombudsman two four-year terms, during 2018-2021, 2014–2017 and 2010–2013. Before his tenure as Ombudsman, he served two terms as Deputy-Ombudsman between 2002 and 2009. 

Parliament elects the Ombudsman and Deputy-Ombudsmen for terms of four years at a time. Before the election, the Constitutional Law Committee assesses those who have submitted their candidatures. The Ombudsman is elected by secret ballot.
