New Ombudsman report finds Flintshire County Council guilty of maladministration over unlawful planning development

Maladministration on the part of Flintshire County Council’s planning department as local planning authority (LPA), caused injustice to the complainant, an Ombudsman investigation has found.

The report finds that the development proposed by a Certificate of Lawfulness of Proposed Use or Development (a “s192 certificate” for an “annexe” containing primary living accommodation to be built in the garden of the next-door property) was not within a class for which planning permission was not required. It was thus not lawful development and the application should therefore not have been granted.

When a retrospective application was made to retain the development (which had not been built in accordance with the s192 certificate) the planning officer had been influenced by the existence of the wrongly granted s192 certificate and the Ombudsman found that it was unlikely that permission would have been granted in the absence of the s192 certificate.

There was maladministration, both in the grant of the s192 certificate and in the grant of the retrospective application. The Ombudsman upheld the complaint.

The LPA’s actions caused “significant injustice” to Ms N, who lives next door.

Commenting on the report, Public Services Ombudsman for Wales, Nick Bennett, said:

“As a whole, the failings which I have identified mean that Ms N has suffered a significant loss of privacy in both her home and garden, which has affected the enjoyment of her home.”

“In addition, the existence of what is in effect a new house built in the garden of the house next door to her property is likely to have diminished the character and value of her home. The situation caused her immense stress, which I can only conclude is a significant injustice to Ms N.”

The Ombudsman has made a number of recommendations including that the Council apologise to Ms N for the failings identified, and review whether the conditions attached to the retrospective permission had been complied with.  He also recommended that the Council instruct the District Valuer to assess the impact of the development on Ms N’s property and pay Ms N the difference in the value of her property before and after the development.

The Ombudsman is disappointed that the Council has not, to date, agreed to accept his recommendations. The ombudsman expects to hear from the Council by the 28th May in response to the report and recommendation.

Monitoraggio messo in atto dal Garante regionale Giancarlo Giulianelli. Conferma del focolaio a Villa Fastiggi di Pesaro, determinato da un nuovo ingresso. Attivati tutti i protocolli per il contenimento della diffusione del virus. Situazione sotto controllo nelle altre realtà carcerarie delle Marche, anche se viene evidenziata la necessità di non abbassare la guardia. Tra i problemi da affrontare quello delle vaccinazioni

Una ricognizione generale di quanto sta accadendo negli istituti penitenziari marchigiani in relazione all’emergenza Coronavirus. È quella effettuata in questi giorni dal Garante regionale, Giancarlo Giulianelli, con richieste d’informazioni ai direttori degli stessi istituti ed ai responsabili sanitari. “Abbiamo avuto conferme – evidenzia – sul focolaio registrato a Villa Fastiggi di Pesaro con 47 contagiati. La situazione è stata determinata dall’ingresso di un nuovo detenuto che, dopo aver presentato sintomi riconducibili al Coronavirus, è stato subito trasferito in ospedale. Le sue condizioni sarebbero attualmente in via di miglioramento. Larga parte degli stessi detenuti contagiati sarebbero risultati asintomatici ed alcuni si sarebbero già negativizzati”. Giulianelli fa anche presente che sono stati attivati prontamente tutti i protocolli per il contenimento della pandemia, anche attraverso il trasferimento delle sezioni interessate e una rivisitazione della logistica complessiva. “Teniamo conto – prosegue – che a Villa Fastiggi la situazione va attentamente monitorata, anche perché l’istituto deve fare i conti con un sovraffollamento ciclico, che al momento si attesta su una trentina di detenuti”.
Nelle altre realtà carcerarie presenti sul territorio regionale (Montacuto, Barcaglione, Fossombrone, Fermo e Marino del Tronto di Ascoli Piceno) la situazione sarebbe sotto controllo. “Ne abbiamo avuto conferma in questi giorni – specifica Giulianelli – dopo aver chiesto tutte le informazioni del caso. È ovvio che la guardia deve restare sempre alta e che contestualmente andranno affrontate, come ho avuto modo di ribadire in altre occasioni, diverse problematiche, a partire da quelle delle vaccinazioni di detenuti e Polizia penitenziaria, sulla base delle disposizioni nazionali e regionali”.

Ombudsman participates in the Science Week Conference organised by Riga Stradiņš University

On 25 March 2021 Ombudsman Juris Jansons participated in the scientific conference "PLACES" organized by Riga Stradiņš University.  The conference took place throughout the day in seven sections, covering areas such as political science, psychology, law, social anthropology, communication, economics, as well as sociology.

The conference dealt with various topical issues, one of which was the experience of the Covid-19 pandemic, which affected almost all areas of public life. Riga Stradiņš University Science Week covers world trends in medicine, healthcare and social sciences.

The topic of the Ombudsman's presentation at this conference was"Human Rights during pandemic".

Die Bedeutung freier Medien den Bürgern nahebringen - Bürgerbeauftragter Herzberg in der Thüringer Landesmedienanstalt

Petitionen, Anfragen und Kritik an Medieninhalten sowie Ärger über die Pflicht zum Rundfunkbeitragt sind nicht selten Themen, mit denen sich auch der Bürgerbeauftragte des Freistaats Thüringen, Dr. Kurt Herzberg, konfrontiert sieht. Auf Einladung der Thüringer Landesmedienanstalt (TLM) informierte er sich vor diesem Hintergrund über die Arbeit dieser staatlich unabhängigen Regulierungseinrichtung im Freistaat.

Dr. Herzberg berichtete beim Besuch über seine Tätigkeitsfelder und wie wichtig es ihm sei, auch in seiner Funktion die Bedeutung eines freien, unabhängigen Mediensystems herauszustellen. Gerade die Debatten um die Akzeptanz des Rundfunkbeitrags machten bei diesem Thema einen großen Teil der Bürgerkritik aus, mit denen er in den Sprechstunden im ganzen Land ange-sprochen wird. „Auch diejenigen, die nicht auf der Autobahn unterwegs sind, haben einen Nutzen, weil z. B. ihr Gemüse über diese Wege in den Laden um die Ecke kommt“, verglich er das Argument, keine Rundfunkgebühren zahlen zu wollen, nur weil man die Inhalte nicht konsumiere. Genau wie die Ver-kehrsinfrastruktur brauche die Demokratie verlässliche und belastbare Wege des Austauschs und Zueinanderfindens.

Bei dem Gespräch des Bürgerbeauftragten mit dem TLM-Direktor Jochen Fas-co ging es um die Aufgaben der staatlich unabhängigen Regulierungseinrichtung. Neben der Lizenzierung und Aufsicht von Rundfunkanbietern und Telemedien im Internet, insbesondere im Bereich des Jugendmedienschutzes, ging auch um aktuelle Fragen um die Regulierung von Medienintermediäre wie Google und Facebook und ihrer Algorithmen-basierten Entscheidungen. Wachsende Bedeutung hat darüber hinaus der Schutz und Erhalt lokal-regionaler Vielfalt, insbesondere der Bürgermedien. Ziel der Arbeit der Landesmedienanstalten ist es, die Meinungsfreiheit zu sichern, rechtswidrige Inhalte zu verfolgen und den immer wichtiger werdenden Nutzer- und Verbraucherschutz zu gewährleisten.

Moderne Medienbildung als Kernkompetenz in der digitalen Welt war eben-falls Thema beim Besuch des Bürgerbeauftragten in der TLM. Dr. Herzberg zeigte sich nach dem Gespräch mit Medienpädagoginnen und -pädagogen im Thüringer Medienbildungszentrum der TLM beeindruckt von den vielfältigen digitalen Angeboten für verschiedene Altersgruppen und deren große Resonanz.

Bürgerbeauftragter Herzberg und Direktor Fasco vereinbarten mit Blick auf neue Aufgaben- und Themenstellungen konkrete Handlungsfelder zu benennen, in denen die konstruktive Zusammenarbeit vertieft werden soll.

Dr. Herzberg übergab am Rande des Gesprächs ein Exemplar seines druckfrischen Jahresberichts 2020.
