IOI | Support for Parliamentary and Health Service Ombudsman UK

The UK Government has introduced new legislation, which would seriously impact on the powers of the Parliamentary and Health Service Ombudsman (PHSO).  On 18 October 2021, the Venice Commission issued an opinion on the possible exclusion of the PHSO as provided for by the Health and Care Bill. The International Ombudsman Institute strongly endorses the Venice Commission’s findings and also issues a statement or support for the UK colleague.

Tomás Quintana ha participado en el Congreso Internacional ‘Rural Renaissance II: Acción, Promoción y Resiliencia’, que se  ha celebrado en Salamanca, organizado por el Área de Derecho Administrativo y por el Grupo de Investigación Reconocido ‘Next Generation UE - Derecho Administrativo’.

Durante el acto de inauguración oficial, el defensor del pueblo de Castilla y León ha manifestado “el deber todos los poderes públicos, cada uno en el ejercicio de sus competencias, pero de forma coordinada, de hacer todos los esfuerzos que sean necesarios para conseguir el resurgimiento y revitalización del extenso medio rural de la Comunidad”. Ya en la segunda sesión del Congreso, acompañado de los presidentes del resto de Instituciones Propias de la Comunidad  se ha referido a los problemas y posibles vías de solución que hay que abordar para enfrentarse a la despoblación de los municipios rurales, basándose para ello en la actividad desarrollada por la Institución del Procurador del Común a partir de las quejas que los ciudadanos presentan y de las actuaciones de oficio que se promueven desde la propia Defensoría. Así, ha considerado la importancia de mejorar la prestación de los servicios públicos, el desarrollo del empleo, la promoción de la disponibilidad de vivienda o la conectividad, temas pendientes que deben abordarse para intentar revertir la creciente despoblación del medio rural.

The Parliamentary Ombudsman directs criticism towards Östergötland County Administrative Board for the processing of a matter on a conflict of interest

A beekeeper handed in a complaint against a county administrative board for deficient processing of a conflict of interest regarding a bee-supervisor. The conflict of interest was founded upon the bee-supervisor also being a beekeeper who was an active salesman on the same markets where the complainant sold his honey. The Parliamentary Ombudsman asked the board and the Board of Agriculture to hand in a referral response on the matter. The authorities both responded that a bee-supervisor should be considered a separate authority.

The Parliamentary Ombudsman considers that the regulations state that bee-supervisors are hired by and subordinated to the county adminstrative board and can be revoked at any given time and the renumeration should be handed out according to a certain rate. The Parliamentary Ombudsman states that the bee-supervisor in question had commercial interests and conducted business activities in addition to the supervisory assignment. According to the Parliamentary Ombudsman’s understanding, the basic organizational conditions mainly go against a bee-supervisor being regarded as a separate authority pursuant to the Instrument of Government. The Parliamentary Ombudsman states that bee-supervisors should be considered individuals to whom administrative tasks have been transferred pursuant to what is specified in chapter 12, section 4 of the Instrument of Government. The Parliamentary Ombudsman hold that statutory regulations on objectivity apply in their supervisory activities.

The county administrative board recieves criticism for not having taken a position on the complainant’s questions regarding the conflict of interest or forwarding it to the bee-supervisor for management.

Venti gli istituti che si sono resi disponili ad accogliere l’iniziativa con un calendario che dall’inizio di novembre si snoderà fino all’aprile 2022. Previsti laboratori che riporteranno l’attenzione sul più ampio concetto di educazione civica e convivenza civile. In primavera l’evento conclusivo con la presentazione dei migliori lavori realizzati dai ragazzi

Cultura del rispetto e della parità, contrasto ad ogni forma di discriminazione. Sono questi gli assi portanti del progetto che nasce dalla collaborazione diretta tra Commissione pari opportunità e Garante regionale dei diritti e che ha l’obiettivo di coinvolgere gli studenti delle scuole secondarie di secondo grado delle cinque province marchigiane.

Venti gli istituti che si sono resi disponili ad accogliere l’iniziativa con un calendario che dall’inizio di novembre si snoderà fino all’aprile 2022. Il primo appuntamento è stato ospitato al “Bramante Genga” di Pesaro, mentre altri sono in agenda per l’8 al “Giuseppe Celli” di Piobbico, per il 17 al “Carducci – Galilei” e per il 22 all’”Ostilio Ricci” di Fermo.

Come evidenziano la Presidente della Cpo, Maria Lina Vitturini, e il Garante regionale, Giancarlo Giulianelli, “i fenomeni di violenza, gli atti discriminatori e la mancanza di rispetto negli ambiti delle relazioni interpersonali risultano in aumento esponenziale. Poggia su queste basi l’esigenza di fornire un supporto concreto ai nostri ragazzi, anche alla luce della situazione determinata dall’emergenza sanitaria”.

Il progetto prevede l’attivazione dei laboratori “Lezione di storie – Non c’è io senza tu” che riporteranno l’attenzione sul più ampio concetto di educazione civica e convivenza civile. I ragazzi saranno chiamati a confrontarsi con storie di discriminazione, rinascita ed emancipazione, attraverso il supporto di personale specializzato, e al termine sarà loro affidato il compito di realizzare dei video ispirati a tutti quei valori emersi e analizzati nel corso del laboratorio.

I lavori troveranno spazio in un’apposita sezione dei siti web istituzionali di Commissione pari opportunità e Garante, mentre quelli più significativi saranno presentati nel corso dell’evento conclusivo previsto indicativamente per il mese di maggio.

The Ombudsman advocates greater accessibility of the case law of the European Court of Human Rights in Slovenian

On the occasion of the 71st anniversary of the adoption of the European Convention for the Protection of Human Rights and Fundamental Freedoms (Convention), Human Rights Ombudsman Peter Svetina highlights the importance of the observance of human rights under the Convention, which is one of the most important international legal acts for the development of human rights law. "Although human rights protection is a fundamental value in modern society, the awareness increased during the pandemic that most human rights are not absolute. We commend the fact that these challenges were recognised by the Committee of Ministers of the Council of Europe, which will re-examine the issue of the restriction of human rights or their temporary revocation during emergency situations. The Convention, which serves as the foundation for the protection of human rights in Europe, is a living instrument adjusting to time and circumstances, which is also reflected in the judgments of the European Court of Human Rights (ECHR)," believes Ombudsman Svetina.

For almost 30 years, the Convention has been part of the Slovenian legal order and has bound state authorities in their work. Violations or observance of rights under the Convention are often pointed out by the institution of the Human Rights Ombudsman. The Ombudsman thus particularly supports the new Recommendation of the Committee of Ministers to member states
on the publication and dissemination of the European Convention on Human Rights, the case law of the European Court of Human Rights and other relevant texts
, which was adopted at the end of September 2021. Among other things, the Recommendation proposes that member states translate into their official languages relevant ECHR judgments against other countries or at least their key sections. "We find that the authorities translate only judgments against Slovenia in an exemplary manner, but not the important judgments against other countries. I call on the responsible authorities to provide translations of important ECHR case law into Slovenian, as these will also be of benefit to state authorities in their work. They should further ensure that action reports and plans on the enforcement of judgments by Slovenia are also accessible in Slovenian so that people will be able to learn how the established violations were eliminated," stresses Svetina.

The Human Rights Ombudsman regularly forwards recommendations to state authorities regarding the elimination of established violations. In recent years, the number of ECHR judgments against Slovenia has reduced; however, the Ombudsman believes that the standard of respect for human rights must be improved in numerous fields. "With a more consistent implementation of our recommendations and decisions of the Constitutional Court, a higher level of human rights protection in the country could benefit every person, irrespective of their social status," asserts Ombudsman Svetina. Although, the Convention defines for the most part only the first generation of human rights, i.e. civil and political, the Ombudsman emphasises a greater need for the observance of other generations of human rights as well. He particularly highlights the importance of social, economic and cultural rights, environmental rights, rights of minorities and digital rights.

Within the Council of Europe, the Human Rights Ombudsman has also been actively pursuing the highest possible standards of compliance with the Convention because, as the representative of the European Network of National Human Rights Institutions (ENNHRI), this institution has been participating in the Drafting Group on enhancing the national implementation of the system of the European Convention on Human Rights (DH-SYSC-V) and the Working Group on the EU accession to the Convention.
