Dissemination of allegedly disparaging remarks on the internet: compensation for the resulting damage in a Member State may be sought before the courts of that Member State

Anlässlich des Österreichbesuchs von Dunja Mijatović, Menschenrechtskommissarin des in Straßburg ansässigen Europarats, empfingen die Volksanwälte am 15.12.2021, eine Delegation des Büros der Kommissarin in Wien.

Volksanwalt und Generalsekretär des International Ombudsman Institute (IOI) Werner Amon berichtete über den geplanten Ausbau der multilateralen Kooperation des IOI, insbesondere auf Ebene der Vereinten Nationen. Anschließend folgte ein Austausch zu den Schwerpunktthemen des Österreichbesuchs von Frau Mijatović, „Frauenrechte und Gleichstellungsfragen“ und „Aufnahme und Integration von Flüchtlingen, Asylsuchenden und Migrantinnen und Migranten“. Hierzu erläuterten Volksanwalt Walter Rosenkranz, Volksanwalt Bernhard Achitz und Geschäftsbereichsleiterin Heidi Pacher aktuelle Missstände in den genannten Themenbereichen. Abschließend wurden die Herausforderungen im Bereich Migration auf europäischer Ebene besprochen.

Die Volksanwaltschaft empfängt in regelmäßigen Abständen die aktuellen Amtsträger des Menschenrechtskommissars und kooperiert eng mit unterschiedlichen Ausschüssen des Europarats, die mit menschenrechtlichen Fragestellungen befasst sind, wie beispielsweise dem Europäischen Komitee zur Verhütung von Folter und unmenschlicher oder erniedrigender Behandlung oder Strafe (CPT).

In terms of Article 22(4) of the Ombudsman Act, the Ombudsman Mr Anthony C. Mifsud and the Commissioner for Environment and Planning, Perit Alan Saliba, have sent to the House of Representatives the Final Opinion in relation to a complaint on car damages suffered due to sea water flooding at Birżebbuġa.

Case Summary

The Commissioner for Environment and Planning was asked to investigate that the area of St George’s Bay experienced flooding of sea water for more than a decade due to high tides and that the authorities have not taken any measures and advise alternative routes.

The investigation did delve into whether Transport Malta or any other entity is responsible for the material damages sustained by private parties but only on the issue whether Transport Malta, or any other entity, is responsible to reply to this claim and not acting by simply referring the complainant to another entity.

The Commissioner recommended that Transport Malta should recognise its responsibilities in connection with the claim put forward by the complainant; and that Transport Malta should reply to such claims and not abdicate its responsibilities by simply referring the claimant to another entity.

Outcome

Since Transport Malta did not accept the Commissioner’s recommendations, the Case was referred to the Prime Minister in November 2021. Since no action has been taken, the Ombudsman and the Commissioner sent the report to the attention of the House of Representatives.

Según pública el portal web del Gobierno de Navarra (www.navarra.es), el Gobierno de Navarra ha entregado al Ayuntamiento de Pamplona/Iruña el busto de Julián Gayarre, obra de Mariano Benlliure. La entrega ha tenido lugar en el Palacio de Navarra, en un acto que ha contado con la presencia de la Consejera de Cultura y Deporte y de la concejala delegada de Cultura e Igualdad del Ayuntamiento de Pamplona/Iruña.

Hay que recordar que el Defensor del Pueblo de Navarra recomendó al Departamento de Cultura y Deporte que realizara las actuaciones necesarias para devolver el busto de Julián Gayarre, obra de Benlliure, al Ayuntamiento de Pamplona/Iruña, a quien fue donado por el sobrino de Julián Gayarre. (Expediente Q20/1297)

La entrega de la obra se ha realizado conforme al protocolo establecido por los técnicos de Bienes Muebles del Servicio de Patrimonio Histórico para la entrega de obras de arte. Previamente, una restauradora, ha realizado una revisión tanto de la escultura como de la peana que sirve de soporte para comprobar su estado de conservación, y ha efectuado el correspondiente informe técnico.
