Upon learning from the media that a mother and son suffered injuries after domestic violence, and that father committed suicide following the attack in Zablaće, a village near Čačak, the Protector of Citizens launched own-initiative investigation to control work legality and regularity of the Ministry of Family Welfare and Demography and the Ministry of the Interior of the Republic of Serbia.

The Protector of Citizens has requested both Ministries to notify the Institution within 15 days on the pertinent facts related to the media allegations, particularly those relating to information that domestic violence has been present in that family before.

The competent Ministries are to notify the Protector of Citizens whether they had been previously informed about the violence in the family and, if so, what measures and activities they have been taken in this regard.

Finally, it is necessary to inform the Protector of Citizens whether, in order to protect women and children, the cooperation among bodies (police, social welfare institutions and judicial bodies), i.e. measures to prevent domestic violence have been put in place in compliance with General and Special Protocols for protection of women from domestic and intimate partner violence.

Summary

A person who was believed to be suicidal had disappeared from an adults housing for inidivudal´s under care pursuant to the Support and Service for Person with Certain Functional Impairments Act. The Police Authority searched through another person’s apartment as part of the general search of the surrounding area.

The Parliamentary Ombudsman states that a house search entailed a search of the premises that must be authorised by law.

Section 21 of the Police Act states that legal support for searching an individual’s home rests on the necessity to search for someone who has gone missing, if it is assumed that this person needs help. According to the Parliamentary Ombudsman, there were no indications that the missing person was located in the apartment in question and that the police asked the occupant of the apartment any questions about the missing person before a search was conducted. It appears that one did not consider whether the search was even necessary at all. The Parliamentary Ombudsman finds that according to the investigation there was no basis for the assessment that there was a need for a house search and that the purpose could not have been achieved in a less invasive way. This action was therefore not necessary pursuant to section 21 of the Police Act. Nor was there any other legal basis for the action.

The Parliamentary Ombudsman directs criticism towards the Police Authority for carrying out the search of the home and for shortcomings in the documentation.

El Síndic de Greuges envió una consulta al Defensor del Pueblo Europeo sobre las obligaciones de España en lo relativo a la protección de los hábitats y la biodiversidad, en concreto en el Delta del Ebro tras los daños que sufrió la región durante el temporal «Gloria (enero de 2020). La consulta se presentó tras una investigación por iniciativa propia del Síndic de Greuges, que se centró en el hecho de que las autoridades españolas no actuaran a tiempo a la hora de planificar adecuadamente las medidas de protección del río y el Delta del Ebro.

Consulta

El 24 de febrero de 2021, la oficina del Defensor del Pueblo Europeo pidió a la Comisión que respondiera a las siguientes cuestiones:

(i) El Delta del Ebro está designado como Zona Especial de Conservación (ZEC) según la Directiva de Hábitats (92/4 /CEE), y como Zona de Protección Especial (ZPE) según la Directiva de Aves (2009/147/CE). ¿Exigen las disposiciones de estas directivas que los Estados miembros adopten y apliquen medidas eficaces para dichas zonas designadas destinadas a proteger los hábitats naturales y las especies animales y vegetales que las habitan?

(ii) La UE ha adoptado recientemente una serie de compromisos en materia de medio ambiente y cambio climático, como se establece, por ejemplo, en la Estrategia de la UE sobre biodiversidad para 2030; en la Comunicación «Intensificar la ambición climática de Europa para 2030: Invertir en un futuro climáticamente neutro en beneficio de nuestros ciudadanos»; o en el Pacto Verde Europeo. ¿Hacen estos compromisos más urgente la adopción y aplicación de tales medidas?

(iii) ¿Obliga el artículo 7 de la Directiva sobre inundaciones (2007/60/CE) a los Estados miembros a desarrollar y poner en práctica planes de gestión de riesgos de inundaciones para las zonas que han sufrido inundaciones de forma repetitiva anteriormente? En estas zonas, ¿están los Estados miembros obligados a aplicar medidas destinadas a mitigar el riesgo que suponen las inundaciones para la salud humana, el medio ambiente, el patrimonio cultural y la actividad económica y, si procede, reducir la probabilidad de futuras inundaciones?

Respuesta de la Comisión

El 31 de marzo de 2021, la Comisión respondió que la Directiva de Hábitats y la Directiva de Aves exigen a los Estados miembros establecer objetivos y medidas de conservación específicas para las áreas designadas. La Comisión afirmó que se está llevando a cabo un procedimiento de infracción contra España por incumplimiento de la Directiva de Hábitats, en la que se incluye el caso del Delta del Ebro.

La Comisión también manifestó que los Estados miembros tienen la obligación de establecer planes de gestión de riesgos de inundaciones que incluyan medidas para lograr los objetivos principales (reducir las posibles consecuencias adversas de las inundaciones para la salud humana, el medio ambiente, el patrimonio cultural y la actividad económica). La Comisión también señaló que el Plan de Gestión del Riesgo de Inundación de España [1] designa toda la zona del Delta del Ebro como propensa a inundaciones. Del mismo modo, la Comisión puso de manifiesto que el plan incluye medidas como «proyectos de restauración costera, que tienen como objetivo aumentar la capacidad del sistema para amortiguar el impacto de las inundaciones, y restaurar dunas en la zona del Delta para reducir los problemas de erosión».
