Der Maßnahmenvollzug kommt nicht aus den Schlagzeilen. Österreich wurde bereits das dritte Mal vor dem Europäischen Gerichtshof für Menschenrechte verklagt. Psychisch kranke Rechtsbrecher sind von Strafgefangenen zu trennen, sie sind in eigenen Einrichtungen unterzubringen und haben dort einen Anspruch auf ehestmögliche individuelle Behandlung, so der Europäische Gerichtshof.

„Es muss genau kontrolliert werden, wer in den Maßnahmenvollzug gehört und wer nicht. Gedacht ist er für psychisch kranke Rechtsbrecher und nicht für Personen, die straffällig wurden, bei denen man schlicht und ergreifend nicht weiß, wo man sie sonst unterbringen soll. Der Maßnahmenvollzug darf keine Sammelstelle sein. Hier ist es dringend an der Zeit für eine Reform“, erklärt Volksanwalt Amon.

Die meisten im Maßnahmenvollzug Untergebrachten werden so lange angehalten, so lange sie als gefährlich eingestuft werden. Manchmal ist das im wahrsten Sinne des Wortes "lebenslänglich". Amon dazu: „Solange wie notwendig, so kurz wie erforderlich. Ohne ausreichende Therapieangebote wird das aber nicht möglich sein. Und diesbezüglich mangelt es an allen Ecken und Enden.“

Seit vielen Jahren weist die Volksanwaltschaft in ihren Berichten auf den Reformbedarf hin. Volksanwalt Amon dazu: „Im Rahmen unseres präventiven Menschenrechtsschutzes stellen wir jetzt gerade in einem Auswahlverfahren eine bundesweite Expertenkommission zusammen, mit der wir uns gemeinsam auch diesem Thema weiterhin widmen werden. Unumgänglich ist aber eine gesetzliche Reform des Maßnahmenvollzuges.“

The Protector of Citizens controls MOI and Ministry of Family Welfare and Demography

Based on media reports that a woman, who was killed in Valjevo, repeatedly reported violence and stalking by her ex-partner, the Protector of Citizens instigated own-initiative investigation to control work regularity and legality of the Ministry of the Interior and the Ministry of Family Welfare and Demography.

The Protector of Citizens has requested the Ministry of the Interior to submit a detailed report and documentation on the police activities in this case within 15 days, and particularly on whether the murdered woman reported to Valjevo Police Department violence by a former partner who, according to media information, had previously been reported for intimate partner violence.

In the response to the Protector of Citizens, the MOI should state as well whether the police officers informed the competent Prosecutor on duty about its reports, and if so, what instructions and guidelines they obtained from the Prosecutor's office.

The Ministry of the Interior should state as well whether the police had data about the movement and life of the perpetrator after his release from prison, whether it analyzed all risks regarding recurrence of intimate partner violence and whether it acted in accordance with these assessments. In addition, the Ministry of the Interior should state whether the Valjevo Police Department had information that the ex- partner had a permit to carry weapons and use of firearms, as well as whether supervision measures were imposed on him.

The Protector of Citizens asks the Ministry of Family Welfare and Demography to supervise the professional work of the Social Welfare Center in Valjevo within 15 days, considering that there is no information in the media whether the SWC knew what forms of violence the murdered woman was exposed to.

Covid-19. Ombudsman urges Social Security to pay extraordinary support to companies

The Ombudsman once again addressed the President of the Institute of Social Security (ISS) to request that he proceed with the payment to companies of requests for extraordinary support for the progressive resumption of activity, formulated since December, which are still pending confirmation by the Tax and Customs Authority (AT) of the requirement related to the drop in invoicing.

After having alerted the Government at the beginning of March to the delays that the difficulties in articulation between the two entities were causing in the attribution of support, the Ombudsman notes that the situation has still not been overcome, and there are companies that have been several months (some for more than five months) without receiving the expected support.

In this new communication, the Ombudsman expresses great concern with the situation of the companies and their workers, proposing to the ISS that it proceed with the payment of all the support relative to 2021, without prejudice to later confirmation of the drop in invoicing indicated, in order to avoid more serious consequences in terms of the solvency of the companies and the maintenance of the work contracts. "It is important that the consequences of a deficient administrative action do not have a more serious impact on the legal status of the applicants," he stressed.

The problem covers cases in which a disparity was identified, as recently as 2020, between the percentage of falling turnover indicated by the applicants and that recorded in the AT. Although the companies have been notified to return the support in question and have corrected the applications, they are still waiting for the decision of all subsequent applications, which are dependent on further validation by the AT.

The Parliamentary Ombudsman directs criticism towards Örgryte-Härlanda City District Board in Göteborg municipality as the board did not adhere to the statute-regulated requirements on objectivity pursuant to the Instrument of Government

The Reclaim Pride festival was held in August 2018 in venues provided by Örgryte-Härlanda City District Board within the framework of a youth initiative organised by Göteborg municipality. On the festival program was a screening of the film Burka Songs 2.0 and a subsequent panel discussion. Representatives of the board demanded, prior to the realisation of the event, that a woman who particiapted in the film should not be allowed to take part in the panel discussion, as planned by the organizers. The board justified this by stating that the board does not cooperate with activities or people that do not stand up for democracy and human rights. According to the board, the woman had connections to questionable movements.

The Parliamentary Ombudsman states that it is not compatible with the statute-regulated requirements on objectivity pursuant to chapter 1, section 9 of the Instrument of Government, that an authority justifies a decision solely on the opinions of an individual, or of opinions that an individual is expected to express.

The Parliamentary Ombudsman states that the investigation proves that the decisive reason for cancelling the women’s participation in the panel discussion was the opinions she perhaps would express. No objective reasons for the board’s actions have been discovered. The City District Board has therefore, in regard to the protection of the freedom of speech pursuant to chapter 2, section 1 of the Instrument of Government acted in violation to the statute-regulated requirement on objectivity pursuant to chapter 1, section 9 of the Instrument of Government. Örgryte-Härlanda City District Board in Göteborg municipality is criticised due to their actions.
