ENNHRI statement on ensuring that humanitarian law and human rights are respected and protected in the context of the current armed attack on Ukraine

ENNHRI calls for an immediate cessation of the armed attack on Ukraine by the Russian Federation in accordance with the principles of international law, humanitarian law and human rights law, and urges the Russian government to implement the interim measures granted by the European Court of Human Rights.

According to initial reports, the conflict has led already to major casualties among civilian population, displacement of people, severe destruction of critical infrastructure and facilities, and deterioration of the overall humanitarian and human rights situation in Ukraine.

ENNHRI supports its member NHRI, the Office of the Ukrainian Parliament Commissioner for Human Rights, in its efforts to promote and protect human rights in Ukraine in an extremely challenging situation. ENNHRI expresses concern for the safety of the Ukrainian Parliament Commissioner for Human Rights, her staff, and all individuals impacted by the conflict. ENNHRI commends the measures taken by the NHRI to address the humanitarian and human rights crisis developing, and monitor the human rights situation.

ENNHRI is acting to facilitate cooperation between European NHRIs and with our international partners, in consultation with GANHRI, in support of the human rights situation in Ukraine, including through our work concerning situations of conflict, democracy and rule of law, and asylum and migration. ENNHRI welcomes negotiations for a ceasefire, as well as support offered by international bodies, such as the UN, OSCE, the Council of Europe and the EU. ENNHRI calls on all Council of Europe member states to stand in solidarity with Ukraine, to provide humanitarian aid, to provide refuge to individuals fleeing Ukraine, and to cooperate with European NHRIs in this respect.

The killing and suffering of people in Ukraine has to stop now

“For the sixth day now, Russia's military attack against Ukraine has continued to sow death and destruction in the heart of Europe. In just a few days, the war has led to the death or injury of hundreds of people, including many children. The latest shelling of the city of Kharkiv has laid bare the Russian forces’ blatant disregard for civilian life, with dozens of people killed and injured and many civilian targets, including apartment blocks and a kindergarten, struck by unguided missiles and suspected cluster munitions.

This war tramples on international law and human rights and obliterates humanitarian law. Millions of people fear for their lives under the indiscriminate shelling that has struck hospitals, schools and homes. Thousands have been cut off from basic facilities, and lack access to water, medication, food, electricity, sanitation and shelter. Hospital workers struggle to provide care, forced by frequent shelling to relocate their patients to bomb shelters or basements. Streams of refugees and displaced people desperately seek safety. 

This carnage must be ended immediately before even more innocent lives are lost and more damage is done. The Russian authorities can do this. They must immediately stop this nightmare.

El Síndic insta a Educación a pagar trienios y sexenios a los funcionarios docentes en prácticas

El síndic de Greuges de la Comunitat Valenciana, Ángel Luna, ha sugerido a la Conselleria de Educación que adopte sin más dilación las medidas necesarias para hacer efectivo el derecho reconocido al personal docente en prácticas a percibir los trienios que tuviera reconocidos hasta el momento de su nombramiento como funcionario en prácticas.

Así resuelve el defensor del pueblo valenciano la queja presentada por una profesora de secundaria que tras aprobar las oposiciones pasó a ser nombrada funcionaria en prácticas. Como consecuencia de la nueva situación administrativa, dejó de cobrar los trienios y sexenio que venía percibiendo como funcionaria interina.

La Conselleria de Educación justificaba ante el Síndic la denegación de estos complementos retributivos por la falta de desarrollo reglamentario de la norma vigente para funcionarios en prácticas. Un planteamiento que no es compartido por el defensor, quien además atribuye la actual situación a la inactividad de la administración autonómica a la hora de desarrollar dicho reglamento.

Asimismo, Luna destaca en su resolución la sentencia de un Juzgado de Alicante sobre un supuesto idéntico al analizado en la que se reconoce el derecho del interesado a percibir durante el periodo que ha sido funcionario en prácticas las retribuciones que venía recibiendo como funcionario interino.

Quo vadis institution of the Public Defender of Rights in Slovakia?

The Public Defender of Rights in the Slovak Republic is a type of ombudsman institutions. The diverse nature of the rights falling within the remit of these institutions depends on the constitutional and legislative frameworks under which they operate in a particular jurisdiction. The information and insights exchanged and shared at the meetings of the International Ombudsman Institute (IOI), the European Ombudsman Institute (EOI), the European Network of Ombudsmen (ENO) and the Visegrad Group countries evidence such diversity, as do the conclusions from various studies and surveys conducted in this regard.1 Protecting the fundamental rights and freedoms of natural and artificial persons against violations caused by actions, inaction or decision-making of public authorities is the core mission of the Public Defender of Rights in Slovakia as an element of open governance.
