Walter S. hat alle offenen Beiträge nachgezahlt, bekommt aber trotzdem lebenslang nur eine gekürzte Pension: Der burgenländische Winzer Walter S. war einst ein Weinbaupionier in Kanada. Nach seiner Rückkehr nach Österreich war er als Weinhändler tätig. Leider liefen die Geschäfte nicht wie gewünscht, und er konnte seine Pensionsbeiträge nicht immer bezahlen. Es kamen Rückstände von mehr als 11.000 Euro zusammen. Einen Kredit hätte ihm dafür wohl keine Bank gegeben. Mit 66 Jahren ging er schließlich trotzdem in Pension, auch wenn diese wegen der Rückstände niedriger ausfiel.
 

Diese Kürzung sah S. durchaus ein: weniger Beiträge, weniger Leistung. Auch dafür, dass ihm zusätzlich die Rückstände in Raten von der Pension abgezogen wurde, hatte er Verständnis. Als er schließlich all seine Beitragsschulden abgezahlt hatte, aber die Pension trotzdem nicht erhöht wurde, war es mit seinem Verständnis vorbei. Er wandte sich beim Sprechtag in Oberpullendorf an Volksanwalt Bernhard Achitz.

Der konnte leider nicht helfen, denn die Rechtslage ist eindeutig: Zu spät, nämlich nach dem Pensionsstichtag bezahlte Beiträge werden nicht auf die Pension angerechnet. Achitz: „Die gesetzliche Situation ist nicht zufriedenstellend und muss geändert werden. Entweder, man erhält wegen nicht bezahlter Beiträge weniger Pension – und muss dann auch die offenen Summen nicht nachzahlen. Oder man zahlt alles ab, kauft damit die Beitragszeiten nach – und bekommt dafür dann auch die entsprechend höhere Pension.“
 

Sozialminister kündigt Überprüfung an

Auf Anfrage der Volksanwaltschaft teilte Sozialminister Wolfgang Mückstein mit, dass man sich die Situation anschauen, entsprechende Überlegungen anstellen und mit der Pensionsversicherung besprechen werde. Volksanwalt Achitz sagte in der ORF-Sendung „Bürgeranwalt“: „Im Ministerium hat man erfreulicherweise das Problem erkannt, jetzt sollte es rasch zu einer Lösung kommen. Den bezahlten Beiträgen muss auch eine entsprechende Leistung gegenüberstehen.“

Le Médiateur du Faso madame Fatimata SANOU/ TOURE a reçu en audience dans la matinée du 11 janvier 2022, madame Victoria OUEDRAOGO/ KIBORA, Ministre de la Justice, des Droits Humains et de la Promotion Civique, Garde des sceaux.
 

Au cours de cette audience, les deux personnalités ont échangé sur de sujets d’intérêt commun notamment les droits humains, la justice et la bonne gouvernance, mais aussi sur la nécessité du renforcement des liens de collaboration entre les deux institutions pour mieux répondre aux besoins des citoyens.
 

Au sortir de cette audience, le Garde des sceaux a traduit ses félicitations au Médiateur du Faso pour sa nomination et ses encouragements dans la poursuite de sa mission.
 

Son département et le Médiateur du Faso entretiennent d’excellentes relations de collaboration a ajouté madame Victoria OUEDRAOGO/KIBORA et à ce propos, elle a réitéré sa disponibilité pour une fructueuse collaboration avec madame Fatimata SANOU/TOURE.
 

Elle a du reste rassuré le Médiateur du Faso, de l’entière disponibilité de ses services à travailler avec l’Institution pour un traitement diligent des dossiers de réclamations en rapport avec son département ministériel.

Upon the Recommendation by the Protector of Citizens, the National Health Insurance Fund (RFZO) has included on the list of medicines dispensed at the expense of compulsory health insurance the medicines for increasing the level of estrogen necessary to preserve the health of trans women and other women who have low level of estradiol, after 10 years that these were not in circulation.
 

After learning that the medicine for maintaining hormonal status of these three categories of women has not been in circulation since 2012, the Protector of Citizens, upon his own-initiative, requested the RFZO in July 2019 to provide conditions to include the medicines for increasing the level of estrogen estradiol amp. 10 mg и estradiol valerat tbl. 2 mg on the list of medicines dispensed at the expense of compulsory health insurance.
 

In late December 2021, the Central Committee for Medicines notified the Protector of Citizens that the competent authorities completely acted upon the issued opinion with recommendations i.e. that the Commission adopted the Decision to put on List D of the List of Medicines estradiol amp. 10 mg and estradiol valerat tbl. 2 mg for indication suggested by National Expert Committee for Transgender Conditions.
 

The Managing Board of RFZO has adopted an Act with the Decision on including the medicines estradiol amp 10 mg and estradiol valerat tbl. 2 mg on the List D of the medicines, i.e. it adopted the Rulebook on Amendments to the Rulebook on the List of Medicines that are prescribed and dispensed at the expense of compulsory health insurance which, apart from other medicines, puts this medicine as well on the list D of the List of Medicines, stated the Central Committee for Medicines.
 

On 24 November 2021, RFZO submitted to the Ministry of Health the mentioned Rulebook in order to conduct procedure of obtaining the consent of the Government of the Republic of Serbia, added the Central Committee for Medicines.

On 26 January, FRA gave a presentation on measuring non-discrimination and equality through surveys at a meeting of the Praia Group Task Team on Non-Discrimination and Equality.
 

FRA spoke about the agency’s general population Fundamental Rights Survey, which collects data on non-discrimination and equality. It also talked about its extensive experience in surveys focusing on various minority populations.
 

The Praia Group on Governance Statistics is one of the city groups established by the UN Statistical Commission.
 

The team provides advice to UN member states on measuring non-discrimination and equality. This is based on the Group’s Handbook on Governance Statistics, which was endorsed by the UN Statistical Commission in 2020.

Il Garante Giancarlo Giulianelli si confronta con il Presidente dell’Erap per verificare le possibilità attualmente in campo. Previsti anche incontri con associazioni imprenditoriali e di categoria per quanto riguarda il versante occupazionale

Parallelamente all’azione di monitoraggio negli istituti penitenziari, il Garante Giancarlo Giulianelli sta attivando una serie di incontri per affrontare anche altre problematiche legate alla realtà carceraria. Uno dei temi al centro dell’attenzione è quello del futuro che saranno chiamati ad affrontare i detenuti dimittendi, in termini di soluzioni abitative e di lavoro.

“Al 31 ottobre di quest’anno – evidenzia Giulianelli – nelle Marche sono stati registrati 148 dimittendi, con un’età media compresa tra i 30 ed i 35 anni. Una volta fuori dal carcere per molti non c’è un tetto su cui poter fare affidamento, ma poterglielo garantire vuol dire rendere possibili misure alternative, arginare le possibilità di recidiva, permettere il mantenimento di legami affettivi e parentali. Nella buona sostanza, guidare con oculatezza il reinserimento nella società. Ovviamente il tutto in stretta connessione con il supporto occupazionale”.

Proprio in quest’ottica il Garante ha effettuato un primo incontro a remoto con il Presidente di Erap (Ente regionale per l’abitazione pubblica) Marche, Massimiliano Sport Bianchini, al quale ha partecipato anche il segretario dell’ente Maurizio Urbinati. “Un confronto interlocutorio – come lo definisce Giulianelli – che si è dimostrato molto positivo ed ha permesso di avere un quadro generale della situazione per quanto riguarda sistemazioni abitative adatte allo scopo. Intenzione comune è quella di approfondire ulteriormente tutte le possibilità”.

Sul fronte del lavoro, Giulianelli ha in animo di concretizzare degli incontri con alcune associazioni imprenditoriali e di categoria. “Il discorso – sottolinea – poggia sulle stesse basi. Ridare dignità e certezze per un rientro positivo nella società. In questa direzione assumono una significativa valenza anche le attività trattamentali, soprattutto quelle di carattere formativo, che permettono di fornire un primo profilo ad una futura occupazione”.

L’auspicio è che le stesse attività possano riprendere adeguatamente, anche con nuove proposte che il Garante intende avanzare, una volta superata l’emergenza pandemica.
