Il Garante a Montacuto dopo l’aggressione di quattro agenti della Polizia penitenziaria da parte di un gruppo di detenuti dell’Alta sicurezza. La motivazione fornita in un primo momento è quella del timore per le recenti scosse di terremoto. Giulianelli ha avuto modo di effettuare diversi colloqui per avere una quadro preciso di quanto accaduto. ”Ora – precisa – la situazione appare rientrata nella normalità. Saranno da accertare compiutamente le circostanze che hanno portato alla protesta e quali erano le reali intenzioni dei detenuti. Nel frattempo non posso che complimentarmi con il Comandante Nicola Defilippis e con tutti gli agenti della polizia penitenziaria per come hanno affrontato la criticità venutasi a presentare. L’augurio di pronta guarigione per quelli che sono rimasti feriti. Ovviamente non mancheremo di proseguire la nostra azione di costante monitoraggio”.

La ararteko en funciones Inés Ibáñez de Maeztu ha participado hoy en el acto de clausura de las XVII Jornadas en homenaje al magistrado José María Lidón “La eutanasia a debate”.

En el encuentro, que se ha celebrado estos días en el Palacio de Justicia de Bilbao, expertos han debatido sobre sobre la eutanasia desde distintas perspectivas: ética, médica, jurídica…

En su intervención Ibáñez de Maeztu se ha referido al envejecimiento de la población y el aumento de pacientes necesitados de un tratamiento para el dolor crónico, en un contexto de constantes avances de la medicina y la tecnología, cuestiones a las que, cada vez más, se están enfrentando nuestras sociedades.

Ha constatado, también, la creciente sensibilización y concienciación social en torno a la necesidad de respetar la libertad y la dignidad de la persona y los derechos de los pacientes. En este sentido ha dicho que “esta cuestión se ha de situar siempre en el centro de cualquier decisión terapéutica y asistencial, preservando la autonomía de la voluntad de la persona enferma”

Some changes to our Code of Conduct complaints process and guidance

We are making some minor changes to our process for considering complaints about the Code of Conduct and to our Code of Conduct Guidance for Members of County Borough Councils, Fire and Rescue Authorities, National Park Authorities and Police and Crime Panels.

Michelle Morris, Public Services Ombudsman for Wales, said:

As political leaders and Standards Committees across Wales take forward their new duties to promote high standards of conduct under the Local Government & Elections (Wales) Act 2021, I have taken the opportunity to review my guidance for members. This will help my office support them in their work and help all members fully understand the requirements placed upon them when fulfilling their role.

To support the Standards Committees, we will be making some minor changes to our process. We will continue to share our decisions with Monitoring Officers, as required by legislation. However, we will now be sharing the complaint and our decision in a standalone decision notice to facilitate the Monitoring Officers in sharing complaint information with Standards Committees (when they consider it appropriate to do so).

Whenever possible, I would like to see any concerns about a member’s conduct resolved locally and at an early stage.  This can calm situations down and prevent the need for further escalation and formal investigation by my office. The guidance and the changes we have made to our process will assist Standards Committees by keeping them informed of current issues, so they can take steps to address any potential concerns.

Ensuring Standards Committees are adequately informed will also support them to draw up training plans. I, and members of the public, expect all members to take advantage of training which is available to them.

A study of how Social Services process cases relating to restricted access under the Care of Young Persons (Special Provisions) Act

Every year, the Parliamentary Ombudsman receives complaints concerning contact between children in care under the Care of Young Persons (Special Provisions) Act and their guardians. Against this background, the Parliamentary Ombudsman decided to carry out an investigation into how Social Services process cases relating to restricted access under the Care of Young Persons (Special Provisions) Act. As part of the investigation, the Parliamentary Ombudsman inspected six Social Welfare Boards and examined cases of restricted access. The key question of the Parliamentary Ombudsman’s investigation has involved how the boards take into account the principle of the best interests of the child.

The Parliamentary Ombudsman notes that all the boards stated that they worked actively with the principle of the best interests of the child, and that this underpins all decisions to restrict access. However, the Parliamentary Ombudsman’s review reveals a clear discrepancy between what the boards themselves have stated about the best interests of the child being taken into account in the processing and what has been documented and reported in the cases reviewed. The Parliamentary Ombudsman points out that the individual children were not highlighted at all in the cases where no assessment of the best interests of the child was expressed in either the decision or the decision guidance document, and the Parliamentary Ombudsman takes this very seriously.

The child’s right to participation consists of different elements: the right to information, the right to speak and be listened to, and the right to influence depending on their age and maturity. The child’s right to information is a prerequisite for allowing the child to be able to express their views on the issue of contact, for example. Speaking and being listened to are also an important prerequisite if the child is to feel that they have been given the influence that they are entitled to in a case. As regards the right to participation, the Parliamentary Ombudsman’s review shows shortcomings in all areas, which is worrying.

In the decision, the Parliamentary Ombudsman also states an opinion on certain formal issues in the handling of cases relating to restricted access and provides views on how these should be handled by the boards.

Le 8 novembre, le huitième Prix de thèse du Défenseur des droits a été remis par Claire Hédon à Léopold Vanbellingen pour sa thèse intitulée « La neutralité des entreprises face aux expression religieuses des travailleurs ».

Réalisée sous la direction de Louis-Léon Christians et soutenue le 26 mai 2021 à l’Université catholique de Louvain (Belgique), la thèse de Léopold Vanbellingen analyse l'invocation de la neutralité‌ religieuse au sein de l'entreprise privée pour restreindre les expressions religieuses sur le lieu de travail. La problématique de recherche porte sur la restriction des libertés sous l’effet de cette neutralité non prévue par la loi et sa compatibilité avec le droit européen de la liberté de religion et de la non-discrimination des travailleurs.

Le Prix de thèse du Défenseur des droits, créé en 2014 et doté d’une valeur de 10 000 €, part du constat que les recherches universitaires, quelle que soit la discipline juridique ou des sciences humaines et sociales concernée, sont une source particulièrement précieuse pour éclairer l’action publique et nourrir la réflexion sur les outils les plus pertinents pour mieux défendre les droits dans tous les domaines de compétences de l’institution : défense des droits des usagers des services publics ; défense et promotion des droits de l’enfant ; lutte contre les discriminations et promotion de l’égalité ; déontologie des professionnels de la sécurité ; orientation et protection des lanceurs d’alerte.
