The report focuses on the fields of education and employment, reflects the positive developments in ensuring the right to accessibility for persons with disabilities, but also identifies problems in the certification of disability as well as in the tax, social insurance and welfare treatment of persons with disabilities. Special reference is made to the problems encountered by children with disabilities, as well as the impact of the pandemic -and the administrative measures that were taken to contain it- on the rights of persons with disabilities.

El Diputado del Común, Rafael Yanes, participó en la inauguración del I Congreso Internacional sobre Cuidados “Derecho a una vida digna: corresponsabilidad y sostenibilidad”, organizado por la Asociación de Cuidadoras, Familiares y Amistades de Personas con Dependencia, Alzheimer y otras Demencias (ACUFADE).

A través de este congreso, se promueve el primer encuentro de intercambio académico, profesional, institucional y político en el que se analizarán y aunarán soluciones para mejorar la calidad de vida de las personas, en el marco de la conmemoración del Día Internacional de las Personas que Cuidan; y se tomará conciencia acerca del rol del cuidado en la sociedad, la evolución de los marcos normativos, los sistemas y recursos de cuidados existentes a nivel nacional e internacional, así como las mejoras necesarias para construir una sociedad corresponsable que proteja el derecho a una vida digna.

El síndic de Greuges, Ángel Luna, ha abierto una investigación de oficio a laConsellería de Igualdad y Políticas Inclusivas al considerar que su actuación al denegar la renta valenciana de inclusión (RVI) a personas que, durante un corto periodo de tiempo, han estado trabajando no solo es una “injusticia” sino que puede “vulnerar sus derechos”.  

La decisión del Luna se debe a las reiteradas y numerosas quejas de personas que han acudido a esta institución denunciandoquehabían solicitado la RVI cumpliendo todos los requisitos para que se la concedieran, pero se les denegaba porque en el momento de la resolución -emitida fuera del plazo máximo previsto-  habían estado empleadas por un corto espacio de tiempo.  

Ni la ley ni el decreto que la desarrolla hacen ninguna referencia a la denegación de esta ayuda económica cuando en el momento de su resolución la persona interesada se encuentre percibiendo ingresos si durante los meses anteriores, desde que se realizó la solicitud, no disponía de los mismos.  

Al denegar esta prestación económica, la Conselleria de Igualdad y Políticas Inclusivas ignora el derecho que la persona tenía a la renta valenciana de inclusión durante los meses en los que no percibía ingreso alguno; es más, si  la Conselleria hubiera resuelto la ayuda en el plazo máximo legal fijado de 6 meses, la persona solicitante la hubiera cobrado. 

La administración no puede ignorar el periodo de tiempo en el que una familia ha sufrido, especialmente, meses en los que ha dejado de pagar facturas o ha contraído préstamos que ha de devolver posteriormente. Además, como el defensor valenciano viene señalando: “Nos preocupa el efecto desmotivador en la consecución de empleo por parte de solicitantes de esta ayuda, en especial cuando intuyen que la resolución de la RVI puede estar próxima”. 

Por todo ello, el Síndic ha solicitado a la Conselleria que le remita, en el plazo máximo de un mes, un informe en el que responda, entre otras, a las siguientes cuestiones:  

• ¿Qué apartado legislativo determina que las solicitudes de RVI realizadas cuando la persona interesada cumple todos los requisitos para ser beneficiaria se denieguen, más de seis meses después, cuando en el momento de la resolución la persona está trabajando?  
• ¿Valora la Conselleria que con dichas resoluciones está negando una ayuda a la que tenía derecho la persona solicitante? 
• ¿Comprende que si hubieran resuelto en el plazo fijado legislativamente dicha persona hubiera percibido la ayuda solicitada?  
• ¿Por qué no cumple el mandato legal y aprueba resoluciones favorables, con una suspensión posterior de la ayuda y reactivándola cuando sea el caso?

A disabled Slough woman has been forced to sleep, eat and wash in her downstairs living room because the council took too long to decide whether she can have a stairlift.

The Local Government and Social Care Ombudsman heard that the woman, who relies on care workers for personal care, has been unable to access her bedroom and bathroom unaided.

The woman applied for a disabled facilities grant (DFG) to install a stairlift to allow her to access her upstairs in May 2021. It took almost a year for Slough Borough Council to approve instead of the maximum of six months statutory guidance says it should take.

The Ombudsman’s investigation into the woman’s complaint found the council operated a points-based waiting list for adaptations, which was at odds with statutory guidance. The investigation found the waiting list appeared to be an attempt to manage a backlog and circumvent the requirement to assess applications within the six-month time limit.

Michael King, Local Government and Social Care Ombudsman, said:

“Disabled Facilities Grants are there to provide adaptations so people can live in their own homes with dignity. Sadly in this case, the council’s delays have had a direct impact on the woman’s mental wellbeing – she has had to wash and toilet in a room that directly opens onto the street and has told me she ‘dreams of having a hot bath in privacy before bed and being able to use the toilet like a human being’.

“I’m pleased the council is now minded to accept my report’s recommendations. I hope this will ensure other people in Slough who have need of adaptations to their homes will not be faced with undue delay.”

The Local Government and Social Care Ombudsman remedies injustice and shares learning from investigations to help improve public, and adult social care, services. In this case the council should apologise and pay the woman £250 for her time and trouble in pursuing the matter. It should also pay her £3,300 to recognise the distress she experienced because of the delay.

The Ombudsman has the power to make recommendations to improve processes for the wider public. In this case the council should immediately end its DFG minor works waiting list and process applications in line with statutory timeframes.

It should also complete its review of the DFG policy considering new non-statutory guidance and review its arrangements with local housing associations to ensure that works undertaken are done so in a cost effective and timely manner.

The Ombudsman, Maria Lúcia Amaral, received a delegation from the Ministry of Justice of the Bavarian State Government, headed by Minister Georg Eisenreich and accompanied by the Ambassador of the Federal Republic of Germany, Julia Monar, in an audience on 3 November. During the meeting, several aspects related to the history and the national and international activity of the Ombudsman in Portugal – an institution that has no direct correspondent in the German political system – were addressed.
