Rafael Yanes abre una queja de oficio acerca de las razones por las que estas personas permanecen ingresadas en el Hospital General de La Palma, a pesar de tener el alta médica desde hace meses

 

El Diputado del Común, Rafael Yanes, ha iniciado una investigación de oficio en el área funcional de Mayores de la Institución, tras tener constancia por los medios de comunicación del ingreso de 30 personas mayores en el Hospital General de La Palma que disponen del alta médica desde hace meses, algunos de ellos incluso desde hace más de un año.

Los motivos de la permanencia de estos ancianos en el Hospital General de La Palma se refieren a la negación de los familiares a recogerlos o, en otros casos, a la imposibilidad de llevárselos. De esta forma, se está ocupando casi una planta completa del hospital para acogerlos, mientras esperan por una plaza en un centro sociosanitario.

Esta situación está afectando al funcionamiento del centro, que se está viendo obligado a cancelar intervenciones quirúrgicas que requieren de ingresos hospitalarios al no tener dónde derivar a estas personas.

Ante esta problemática, la Diputación del Común ha abierto esta queja de oficio dirigida a la Consejería de Sanidad y al Hospital General de La Palma acerca de las razones por las que estos 30 ancianos siguen hospitalizados hoy en día.

Pupils have the right to receive special needs education regardless of the place of education or the teaching group

Deputy-Ombudsman Pasi Pölönen has today issued a decision on a complaint by the Trade Union of Education in Finland (OAJ) requesting the Deputy-Ombudsman to investigate the Finnish National Agency for Education’s regulations and instructions on special support in basic education. The Deputy-Ombudsman does not consider the Finnish National Agency for Education's instructions correct in all respects. 

The Deputy-Ombudsman emphasised that, regardless of the place of education or the teaching group, the pupil has the right to receive the special needs education provided as part of special support under the Basic Education Act in those subjects in which the pupil has been found to need special needs education. The special needs education included in special support is provided by a special needs teacher who meets the statutory qualification requirements. 

Support for learning, the related special needs education and the form of providing the special needs education play a central role in the implementation of children’s cultural rights and educational equity. Support for learning contributes to ensuring that the right of all children to basic education is effectively realised. The provisions on support for learning also implement some of the obligations laid down in the UN Convention on the Rights of the Child and the Convention on the Rights of Persons with Disabilities.

In his decision, the Deputy-Ombudsman noted that there were unclarities in how the provisions and regulations on teacher qualifications and support for pupils were applied. In his decision, the Deputy-Ombudsman also addressed the question of the prerequisites for the individualisation of the syllabus for a subject and its relationship with special support.

The Deputy-Ombudsman proposes that the Ministry of Education and Culture assess whether the provisions on support for learning and schoolgoing and the provisions on teaching qualifications should be clarified. He also proposes that the Finnish National Agency for Education assess whether the National core curriculum for basic education should be specified in more detail.  

The Deputy-Ombudsman requests that the Ministry of Education and Culture and the Finnish National Agency for Education report their measures in this matter by 28 February 2023.

Annual Report: Performance Report 2021-22

We have laid our Annual Report for the year 2021-22 before the Scottish Parliament.  

Highlights include:

  • 3,665 public service complaints received and 3,492 closed
  • 63% of all investigated public service complaints upheld
  • 511 recommendations made to public bodies, 51% being about learning and improvement
  • 36.7% increase in Scottish Welfare Fund independent review applications received from the previous year
  • 107 whistleblowing enquiries and cases considered, completing the first year of service for our Independent National Whistleblowing Officer function
  • successful launch of three project work streams to review our own organisational learning and recommend improvements on future working arrangementsintelligence and learning from casework and internal communications.

Rosemary Agnew, Scottish Public Services Ombudsman, said:

"Since I took up office in 2017, my team has, year on year, taken on new functions and duties and had to cope with unprecedented change and challenges. We would have faced many of these irrespective of COVID-19.

We started 2021-22 in the knowledge we had high workloads and faced capacity and resourcing challenges. Despite uncertainty about lockdown and the ongoing impact of COVID-19, on ourselves and Scottish public services, we were, and remain, optimistic. We set ourselves an ambitious business plan, driven by our values and strategic aims and were successful in delivering many of these objectives.

We are committed to delivering the best service we can with the resources we have. Reducing the number of unallocated public service complaints, shortening the time taken to decide complaints, and increasing stakeholder engagement are top priorities for 2022-23. We also look forward to supporting the development of child friendly complaints procedures in anticipation of the incorporation of the United Nations Conference on the Rights of the Child (the UNCRC) developments."
