(CoE) FRA and Council of Europe further strengthen ties

In a letter addressed to the Dutch Minister for Migration published today, Commissioner Mijatović expresses her concern about asylum reception conditions in the Netherlands. The Commissioner’s letter follows a further worsening of the situation, especially at the Ter Apel registration centre, endangering the right to health of the people involved. The conditions appear to fall short of even the minimum standards under Article 3 of the European Convention on Human Rights. The Commissioner urges the government to take all necessary measures to effectively protect the right to health of those involved. She also calls on the government to promptly identify vulnerable people and ensure that they are provided with appropriate accommodation as soon as possible.

The Commissioner notes that recent proposals to tackle the current challenge could impact on the right to seek asylum or the enjoyment of the right to family life, including through restrictions on family reunification. She stresses that any steps must be fully in line with the Netherlands’ international obligations. The Commissioner also encourages the authorities to work towards a more sustainable system of reception that is responsive to fluctuations in arrivals, ensures safe and dignified conditions for all, and can rely on the widest possible support in society.

Sopralluogo del Garante Giancarlo Giulianelli a Marino del Tronto per una verifica della situazione alla luce della protesta pacifica di alcuni detenuti dell’alta sicurezza, che terminata l’ora d’aria non hanno fatto rientro nelle celle decidendo di dormire sul pavimento. La stessa protesta ha preso le mosse in relazione ad una serie di richieste sullo svolgimento di specifiche attività all’interno dell’istituto penitenziario, a partire dai colloqui con i familiari. Nel corso della visita Giulianelli ha incontrato la direzione, il comandante della polizia penitenziaria e una delegazione di detenuti. “Al termine del confronto – sottolinea Giulianelli – la protesta è completamente rientrata. Non mancherà il mio personale impegno per cercare di trovare risposte adeguate ad alcuni problemi posti al centro dell’attenzione. C’è da dire che la struttura carceraria di Marino del Tronto è ancora sottoposta a limitazioni logistiche e presidi previsti dal 41 bis che, dopo in declassamento, non c’è più. In questa direzione è sicuramente necessario un intervento deciso che ristabilisca una situazione di normalità”.

Già alcune settimane fa, riferendosi proprio alla Casa circondariale di Ascoli Piceno, il Garante aveva parlato di “situazione ormai insostenibile”, evidenziando diverse problematiche.

Nueva decisión del Tribunal Europeo de Derechos Humanos sobre devoluciones en caliente en Ceuta

El pasado mes de julio, el Tribunal Europeo de Derechos Humanos dio a conocer una nueva decisión por la que no admitió a trámite una demanda de dos personas, procedentes de Camerún y Guinea, que denunciaban haber sido víctimas de una devolución en caliente en 2016. Tras haber cruzado la valla de Ceuta, fueron devueltos inmediatamente a Marruecos sin recibir tratamiento médico, sin ningún examen de su situación individual, ni de una posible necesidad de protección internacional.

Ante el Tribunal Europeo de Derechos Humanos, alegaron la vulneración de su derecho a no sufrir tratos inhumanos o degradantes y de la prohibición de expulsiones colectivas, recogidos en el Convenio Europeo de Derechos Humanos.

El Tribunal considera que no hay prueba de que los demandantes sufrieran malos tratos por parte de las fuerzas de seguridad españolas, y que la Cruz Roja, presente en el lugar, no consideró que las heridas de los demandantes, causadas por el trato de la policía marroquí o por las cuchillas de la valla, requiriese hospitalización en Ceuta. En cuanto a los riesgos de sufrir torturas o malos tratos en Marruecos tras la devolución, el Tribunal no encuentra razones fundadas para apreciar dicho riesgo. Considera que si los demandantes hubiesen hecho uso de los procedimientos legales de entrada en España, no hubieran corrido el riesgo de maltrato en Marruecos durante la tramitación de sus solicitudes de protección.

En cuanto a la prohibición de expulsiones colectivas, el Tribunal entiende que los demandantes se pusieron en peligro por sus propios actos al participar en un salto multitudinario de la valla de Ceuta, en lugar de recurrir a los procedimientos legales. La devolución inmediata a Marruecos sin un examen individual se puede atribuir a la manera en la que trataron de acceder al territorio español.

Por tanto, el Tribunal considera que la demanda no está suficientemente fundamentada y no la admite a trámite.
