The Síndic de Greuges de Catalunya (Catalan Ombudsman) has a new incumbent, Ms. Esther Giménez-Salinas i Colomer. Ms. Giménez-Salinas was elected by the Catalan Parliament on 30 June and took office on 14 July 2022.

Elected by a majority vote of the Catalan Parliament, the Catalan Ombudsman is politically independent. She has been president of the University Ramon Llull (2002-2012), member of the Spanish General Council of the Judiciary (1996-2001), head of Institutional Relations at the Catalan Ministry of Justice (1995-1996), deputy director of the UB Institute of Criminology (1993-1996), member of the Council of Europe's Scientific Committee on Criminal Policy (1993-1997) and Director General of the Centre for Legal Studies and Specialised Training of the Catalan Ministry of Justice (1983-1993).

Vulnerable South London woman failed by organisations that should have helped

A vulnerable young woman trying to overcome severe mental health problems has been put at significant risk of self-harm, after the organisations which should have looked after her failed multiple times to provide specialist aftercare services.

The Local Government and Social Care Ombudsman (LGSCO), and Parliamentary and Health Service Ombudsman (PHSO) investigated the woman and her family’s complaints and found serious concerns with the way her situation was handled.

The woman, who lives in the Croydon area, had spent a long time in the care system before she was adopted. As a young teenager her mental health deteriorated to such an extent she was sectioned under the Mental Health Act.

She should have left hospital with a package of aftercare agreed between the London Borough of Croydon, South London and Maudsley NHS Trust and the former NHS South West London Clinical Commissioning Group (now the NHS South West London Integrated Care Board). However this did not happen. This ‘Section 117 aftercare’ package is a legal entitlement, which should have helped to ensure she was not readmitted to hospital.

The young woman’s mental health repeatedly deteriorated. Her specific conditions meant she struggled to maintain relationships and led to behaviour which put her at risk of harm or accidental death.

Her family struggled to get her the help and support she needed, and the woman has admitted without their support she might not be alive today. At one point the Trust insisted the only place the young woman could access treatment was at the hospital in which she witnessed her best friend’s suicide.

In addition to the lack of support, the woman has not been able to access the enhanced Personal Independence Payment (PIP) benefits she is entitled to claim, and this has had a major impact on both her and her family’s finances.

She was also unable to access supported living accommodation away from her parents, as Croydon council insisted her parents needed to formally make her homeless before this would be offered. Her parents refused to do this understanding the impact it would have on her fragile mental health.

The investigation by the two Ombudsman services also found the parents’ need for support as carers was not met, and there were times when information about their daughter’s health should have been shared with them but was not.

Michael King, Local Government and Social Care Ombudsman, said:

“The young woman in this case tells me she feels she has been cast adrift by the organisations who should have helped her, over many years.

“Despite it having been a legal obligation for nearly 40 years, these organisations are still not getting it right when it comes to working together to provide Section 117 aftercare.

“I am concerned the situation in this case is not unique, and is likely to be happening to other people in the area. Indeed, the ICB still has yet to make direct payments available to people to choose their own aftercare services – something which should have been in place from December 2019.

“I hope by publishing this report, that the organisations involved, and those across the country, can revisit their policies and procedures and learn from what has gone wrong.”

Rob Behrens, Parliamentary and Health Service Ombudsman, said:

“This young woman underwent a traumatic experience and the failures outlined in this case had a devastating impact on her and on her family. All three organisations failed in their duty of care by not providing the support to which she was entitled. They risked her long-term recovery and placed undue pressure on her parents as her carers.

“I want to see the organisations involved learning from their mistakes and using complaints like this as a driver to improve services in mental health aftercare.”

The role of the Local Government and Social Care Ombudsman and Parliamentary and Health Service Ombudsman is to remedy injustice and share learning from investigations to improve public services. They also have the power to make recommendations to improve processes for the wider public

In this case the three organisations have agreed to apologise to the young woman.

Between them, the organisations under investigation have agreed to pay the woman a total of £12,750 in recognition of avoidable stress, frustration, increased risk of harm and outrage, as well as missed opportunities to claim PIP benefits. They will also pay each parent a total of £1,500 in recognition of the injustice they too have faced.

The council will also carry out carers’ assessments for the parents. Together, all three organisations will ensure the young woman has a plan that clearly sets out her section 117 aftercare, and an explanation on how she can request a personal health budget.

The council will review its processes for ensuring carers can have their needs assessed.

The Trust and council will also ensure relevant staff properly understand the law relating to supported accommodation. The Trust will also review a number of its practices, including those around record keeping, working collaboratively and addressing patients’ disclosures of risks to others.

The Trust, council and ICB will work together to ensure the proper processes and record keeping are in place and that everyone to whom they owe a section 117 duty has a care plan in place.

The ICB will take urgent action to ensure its processes around Personal Health Budgets comply with relevant law and guidance.

New Public Interest Report: Failings in management of support for a vulnerable adult who died whilst receiving care services commissioned by Wrexham County Borough Council

The Public Services Ombudsman for Wales has issued today a public interest report regarding Wrexham County Borough Council. She has concluded that the Council did not adequately support a vulnerable adult with learning disabilities, who later died.

The Ombudsman launched an investigation after receiving a complaint from Mrs X about support provided to her sister, Ms Y, by Wrexham County Borough Council.

Ms Y, an adult with learning disabilities and history of alcohol dependence, had been moved by the Council into supported living accommodation, managed for the Council by a contracted provider. Mrs X was unhappy that the provider delayed in telling the Council of increasing concerns about Ms Y’s behaviour, and that when the provider finally contacted the Council they were unable to access support for Ms Y.  Ms Y sadly died in April 2020.

The Ombudsman upheld the complaint. She found that the provider did not escalate matters to the Council quickly enough and that the Council did not appropriately manage Ms Y’s care when matters were eventually escalated. She also found that the Council did not explore the opportunities to share with Mrs X information about her sister’s condition. Finally, the Ombudsman also found failings in how the Council handled Mrs X’s complaint about her sister’s care, with conclusions of an independent investigator not fully included in the investigation findings, nor shared with Mrs X.

Commenting on the report, Public Services Ombudsman for Wales, Michelle Morris, said:

“This is a sad case of grave injustice and we extend our sympathy to the family.

We acknowledge that when Ms Y died, the COVID-19 pandemic had already placed severe pressure on the Council’s services.

Nevertheless, we decided that, given that Ms Y was a vulnerable adult with a history of known alcohol dependence, concerns about her condition should have been escalated sooner, and the Council should have offered support when matters were finally escalated.

Our report is clear that we cannot know whether earlier interventions by the Council would have altered the sad outcome for Ms Y. However, we are also clear that several opportunities to intervene were lost.

One of those opportunities was to ensure that Ms Y had all the chances to receive support from her family. Sadly, we found that because the Council did not seek Ms Y’s consent about sharing information with her family, her sister was unaware of Ms Y’s condition and unable to extend that support.

We were also concerned about how Mrs X’s complaint to the Council was considered and managed. The failings that we identified in that process call into question the robustness of the investigation and its findings.

Although the Council was not directly providing day to day care for Ms Y, as the body with overall responsibility for the delivery of its social care functions, the Council was responsible for the failings.

We welcome that Wrexham County Borough Council has now accepted these findings and conclusions and has agreed to implement the recommendations in full.”

The Ombudsman recommended that Wrexham County Borough Council issues a meaningful apology to Mrs X for the shortcomings identified in the Report and

  • implements all the actions identified during the Council’s investigation of the original complaint by Mrs X
  • reminds those it contracts to undertake independent investigations on its behalf to ensure that any findings or critique of the service provided to a client are reflected in their report and findings and not shared separately with the authority
  • reminds relevant staff of the importance of regular contract monitoring in relation to the delivery of social care services by third party providers, to ensure appropriate intervention if there are concerns about the provision of service or a change in a client’s needs.

Madrid, 22 de julio de 2022. La institución Defensor del Pueblo ha iniciado una actuación de oficio ante la Inspección de Trabajo y Seguridad Social con el objetivo de que se le facilite información sobre las actuaciones inspectoras realizadas para combatir los riesgos en aquellos sectores expuestos a condiciones ambientales extremas que pongan en peligro la seguridad y la salud de las personas en el ejercicio de su actividad laboral.

 

El Defensor del Pueblo solicita que la información requerida especifique las actuaciones que se hayan podido realizar en supuestos siniestros laborales, a causa de este factor de riesgo, sufridos por empleados en el ámbito del sector público, con independencia de que se trate de la prestación de servicio público en régimen de gestión directa o de contratación administrativa, con la finalidad de valorar el inicio de actuaciones pertinentes ante las administraciones responsables.

 

Además, la institución se interesa por conocer el criterio de la Inspección de Trabajo y Seguridad Social acerca de la suficiencia de la normativa para garantizar un marco adecuado de protección de los trabajadores que desarrollan su trabajo al aire libre.

 

 

En los últimos meses se han registrados varias muertes y accidentes graves por golpes de calor en actividades que se realizan a la intemperie. Según datos hechos públicos por el Instituto de Salud Carlos III, dependiente del Ministerio de Sanidad, entre el 10 y 16 de julio y debido a la ola de calor, en España fallecieron 510 personas. Ayer mismo, jueves 21 de julio, un trabajador de 56 años, repartidor de propaganda, falleció en Paracuellos del Jarama (Madrid) al sufrir un golpe de calor mientras trabajaba.
