Die FRA hat ihre aktualisierte Online-Datenbank zum Strafvollzug veröffentlicht. Zum ersten Mal werden dort die Haftbedingungen von Frauen und die Verpflegung in Haftanstalten erfasst. Die Datenbank beinhaltet die nationalen Standards und Rechtsvorschriften sowie Beobachtungsberichte zu Haftbedingungen aus der gesamten Europäischen Union und dem Vereinigten Königreich.

ACCESS THE DATABASE

In der Datenbank werden nationale Standards in verschiedenen Bereichen untersucht. Diese Standards umfassen: die Größe der Zellen, Hygienebedingungen, Einzelhaft, Zugang zu medizinischer Versorgung, Schutz vor Gewalt, junge Häftlinge sowie die Zeit, die Gefangene außerhalb ihrer Zellen verbringen.

Darüber hinaus haben Nutzer der Datenbank Zugriff auf die aktuelle Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte und des Gerichtshofs der EU.

Eine weitere Ergänzung ist die nationale Rechtsprechung aus über 110 Fällen in allen EU-Ländern.

Außerdem enthält die Datenbank die jüngsten Berichte der zuständigen Überwachungsstellen.

Die Datenbank wurde ursprünglich 2019 zusammen mit dem Bericht über die Haftbedingungen im Strafvollzug veröffentlicht. In diesem Bericht wurden bestehende Vorschriften und ihre Anwendung in der Praxis verglichen.

In a letter addressed to the Hungarian Minister of the Interior published today, Commissioner Mijatović expresses her appreciation for the country’s open border policy for those fleeing Ukraine but raises concerns about the longer-term protection perspective of third country nationals and stateless persons, who are excluded from the temporary protection scheme and have no possibility to apply for asylum in the country.

So far, third country nationals and stateless persons have been issued with humanitarian residence permits for 30 days, which are usually extendable but carry no benefits, while the Hungarian border police continues to report daily removals to Serbia of persons coming from war-torn countries such as Syria, Afghanistan, or Iraq. “The sustained rhetoric by government officials of differentiating Ukrainians as ‘real refugees’ and portraying those fleeing atrocities and war elsewhere as economic migrants is problematic and contradictory to the core principle that human rights exist to protect everyone, in the same way, whatever their national or ethnic origin, colour, or belief,” writes the Commissioner.

The Commissioner urges the Minister to pursue the establishment of an asylum system in line with Hungary’s international protection obligations, for the benefit of those fleeing Ukraine who do not fall under the temporary protection scheme and for everyone else who seeks the fair and thorough assessment of their eligibility for asylum in Hungary.

Naufragio del Prestige: el arbitraje entablado en el Reino Unido no puede bloquear el reconocimiento de la sentencia española que condena a la aseguradora a reparar los daños causados por la marea negra Una sentencia que confirma un laudo arbitral solamente puede impedir el reconocimiento de resoluciones judiciales de otros Estados miembros si el contenido de dicho laudo también habría podido ser objeto de una resolución judicial dictada con observancia de las disposiciones y de los objetivos fundamentales del Reglamento n.º 44/2001

En noviembre de 2002, el M/T Prestige, un petrolero que enarbolaba pabellón de las Bahamas, se partió en dos durante una fuerte tempestad y naufragó frente a las costas gallegas cuando transportaba 70 000 toneladas de fuelóleo pesado, que se derramaron y causaron importantes daños en playas, pueblos y ciudades del litoral norte de España y del litoral occidental de Francia. Comenzaba así una prolongada disputa jurídica entre la aseguradora del buque [The London Steam-Ship Owners’ Mutual Insurance Association Limited (en lo sucesivo, el «London P&I Club»)] y España planteada en dos procesos diferentes en dos Estados miembros.

Judgment of the Court in Case C-700/20 | London Steam-Ship Owners’ Mutual Insurance Association

The Prestige sinking: The arbitration proceedings initiated in the United Kingdom cannot block the recognition of the Spanish judgment ordering the insurer to pay compensation for the damage caused by the oil spill

A judgment confirming an arbitral award can prevent the recognition of judicial decisions from other Member States only if the content of that award could also have been the subject of a judicial decision adopted in compliance with the provisions and fundamental objectives of Regulation No 44/2001

In November 2002, the M/T Prestige, an oil tanker flying the flag of the Bahamas, split in two following a violent storm and sank off the coast of Galicia (Spain). It was transporting 70 000 tons of fuel oil, which spilled, causing significant damage to beaches, towns and villages along the north coast of Spain and the west coast of France. Thus began a lengthy legal dispute between the insurer of the vessel (The London Steam-Ship Owners’ Mutual Insurance Association Limited (‘the London P&I Club’)) and Spain in two different sets of proceedings initiated in two Member States.

FRA will present fresh findings from its new report on safeguards for children in criminal proceedings during the international ‘Humanising justice for all children’ conference.

VISIT EVENT SITE

FRA will speak on 21 June during discussions that will focus on making justice child-friendly.

The report will also come out on 21 June. It covers the treatment and experiences of children in criminal proceedings.

The event runs from 20 to 22 June. The Validity Foundation and their partners are hosting the event.
