Judgment of the Court in Case C-43/21 | FCC Česká republika

The mere extension of the duration of the operation of waste disposal at a landfill does not constitute a substantial change to the operating permit

Such an extension does not require the landfill operator to apply for a new permit. In such a situation, the directive on industrial emissions does not oblige Member States to enable the public concerned to participate in the decision-making process or to guarantee them a right to judicial redress in order to challenge the legality of that process.

FCC Česká republika operates a landfill site in the borough Praha-Ďáblice (Czech Republic), on the basis of a permit issued in 2007. At the end of 2015, FCC Česká republika applied to the Prague city administration to postpone the planned end date of operation of the landfill, fixed at 31 December 2015. The Prague city administration granted that request and postponed the date of discontinuation of waste disposal at the landfill to 31 December 2017. (...)

Judgment of the Court in Case C-122/21 | Get Fresh Cosmetics

Effervescent bath bombs: Member States may, under certain conditions, restrict the distribution of cosmetic products which, because they have the appearance of foodstuffs, may be mistaken for foodstuffs and cause health risks

The interest in protecting the health and safety of consumers may, in certain cases, prevail over the right to market certain cosmetic products

Get Fresh Cosmetics Limited markets certain cosmetic products in Lithuania via a website. The Lithuanian authorities carried out an inspection and found that some of those products, namely several types of bath bombs, had the appearance of foodstuffs, posed a risk of poisoning to consumers, in particular children, and compromised consumer safety. The Lithuanian authorities ordered Get Fresh Cosmetics to withdraw them from the market.

Participants discussed how to ensure separated and unaccompanied children are assigned a guardian, how to recognise existing guardians from Ukraine for children evacuated from institutions, and what type of support they might require.

The European Commission will follow up on the good practices and recommendations from the discussion. This is part of the implementation of the European Commission’s 10-point plan: For stronger European coordination on welcoming people fleeing the war from Ukraine.

Over 30 experts from Member States, civil society, and international and European organisations attended the meeting on 30 May.

Lesung in Volksanwaltschaft: „Wenn einmal die Saat aufgegangen, …“ so lautet der Titel des Buches von Heimo Halbrainer, aus dem Kammerschauspieler August Schmölzer in sehr berührender Art und Weise ausgewählte Text vorlas.

Volksanwalt Amon in seiner Eröffnungsrede: „Dieser heutige Leseabend mag etwas ver-steirert anmuten. Ein Steirer als Volksanwalt lädt zu einem Leseabend mit einem steirischen Kammerschauspieler, der aus dem Buch eines steirischen Historikers über steirische Widerstandskämpfer liest. Und das in einem Palais, das nach einem steirischen Adelsgeschlecht benannt ist. So ist dieses Thema allerdings, sind diese Briefe in trauriger Weise, kein regionales Ereignis. Sie stehen vielmehr exemplarisch als traumatisches Symbol, als Ausfluss eines Unrechtsstaates, einer menschenverachtenden, kriegslüsternen Diktatur und einer diesem System dienenden Justiz. Gerade deshalb gibt es viele Gründe, um sich an diesem Ort, also hier in der Volksanwaltschaft, mit diesem Thema auseinander zu setzen. Im Haus der Menschenrechte.“

Vor der Lesung im Festsaal der österreichischen Volksanwaltschaft, stellte der Historiker Heimo Halbrainer als Herausgeber das umfangreiche Werk vor, das neben den Briefen der zum Tode Verurteilten, den Widerstand und die Opposition in der Steiermark 1938-1945 im Überblick beschreibt. In dieser Zeit wurden in der Steiermark über 20.000 Menschen aus politischen Gründen von der Gestapo verhaftet. Tausende kamen in Konzentrationslager oder wurden vor ein nationalsozialistisches Gericht gestellt. Hunderte von ihnen wurden zum Tode verurteilt und hingerichtet. Bevor sie hingerichtet wurden, durften sie noch letzte Briefe schreiben.

Historiker Heimo Halbrainer: „Was ich in vielen der Briefe der zum Tode Verurteilten gefunden habe, war deren Gewissheit, angesichts des Todes, dass dieses System, der Nationalsozialismus, untergehen werde und die Gerechtigkeit siegen wird.“
