Il Difensore civico ha aderito alla proposta di svolgere una serie di incontri sul territorio nell'ambito delle iniziative organizzate dall’Università della terza età e del tempo disponibile, quali progetti di educazione degli adulti curati dalla Fondazione Franco Demarchi, quale ente strumentale della Provincia.

Giovedì 1 dicembre 2022 si è tenuto un incontro a Levico Terme presso la sala consiliare comunale - alla presenza di un cospicuo numero di persone - finalizzato a spiegare ruolo e attribuzioni del Difensore civico e relative modalità di svolgimento alla luce della legge provinciale istitutiva della difesa civica trentina (l.p. 28/1982).

L’incontro si è articolato in una premessa introduttiva di carattere generale, svolta dal Difensore civico, tesa ad evidenziare lo status di tale figura di garanzia, quale organo stragiudiziale di risoluzione delle controversie in funzione deflattiva del contenzioso,​ ​​svincolato da qualsiasi rapporto di soggezione gerarchica o funzionale, con spiccati compiti di mediazione, conciliazione, terzietà attiva al fine di addivenire ad una composizione consensuale delle questioni sottoposte alla sua attenzione.​​​

Puntuale attenzione è stata riservata al tema dell’accesso agli atti della Pubblica Amministrazione  (nelle varie tipologie) e alla facoltà dei cittadini di presentare un ricorso al Difensore civico avverso il diniego di accesso.

La dott.ssa Gloria Bertotti ha, poi, illustrato le modalità con cui presentare il ricorso avverso il diniego all’accesso agli atti, nonché alcuni casi pratici riguardanti ad es. il tema dell’accesso alle case di riposo nel periodo della pandemia da Covid-19 in relazione alle restrizioni varate, dell’applicazione dell’IMIS, quale imposta locale di natura immobiliare in vigore nei Comuni trentini dal 1 gennaio 2015, anche per quanto attiene la possibilità che due coniugi residenti in due immobili diversi possano fruire dell’esenzione IMU sull’abitazione principale per entrambi gli immobili. Sono stati, inoltre, illustrati alcuni casi trattati in materia di previdenza e aiuti sociali.

Nel corso dell’incontro è stata mostrata la pagina web del Difensore civico – costruita come sezione del sito del Consiglio provinciale – in cui è possibile reperire informazioni, studi e approfondimenti, nonché la modulistica per presentare i ricorsi.

Gli incontri sono stati apprezzati da parte dei numerosi cittadini presenti.​​​​

Saving Humanity: Important Debates on Our Rights in the Face of Crisis and War at the annually held National Human Rights Forum

On 9 December, the eve of the International Human Rights Day, the 5th National Forum on Human Rights (NFHR) will be held in Vilnius. This year it will be dedicated to human rights issues in the face of crises and military conflicts and to the 30th anniversary of the Constitution of the Republic of Lithuania.

Dr. Erika Leonaitė, the Head of the Seimas Ombudspersons’ Office – National Human Rights Institution – observes that it is always important to protect and nurture human rights, but in the face of war and crises, safeguarding of these rights becomes especially relevant.

“First of all, there is a significant increase in the number of vulnerable persons who are important to be treated in accordance with the principles of humanity. Moreover, in the face of unexpected challenges and threats, there is a risk that human rights will be relegated to the margins of state life, as a kind of quiet time luxury. The sense of confusion and insecurity in society means that even disproportionate restrictions on human rights can be accepted as inevitable. Therefore, precisely in the face of war and crises, it becomes clear how strong our constitutional identity as a democratic state is,” says E. Leonaitė, one of the organizers of the event.

The forum, which has become an annual tradition, invites the public to discuss the state of human rights in Lithuania and ways to ensure that our country is a good place to live for people of all nationalities, religions, genders, social positions, beliefs or views, i.e. for everyone. Dr. Edita Žiobienė, the Ombudsperson for Child’s Rights, points out that today the topic of safeguarding human rights is as relevant as ever – military actions in Ukraine, humanitarian and migration crises, the consequences of the pandemic and the related quarantine are still being felt. “Even 7.5 million Ukrainian children had to leave their native homes, societies are still dealing with the problems of deteriorating physical health, psychological condition, children’s achievements in learning and access to various services. And these are just a few challenges that need solutions right now. We see and appreciate the state’s efforts and progress in safeguarding human rights. On the other hand, there are always new challenges that require the constant search for effective measures to enable every person to exercise their rights”, expresses her thoughts about the topics of the upcoming forum Dr. E. Žiobiene.

The forum will once again bring under one roof the academic, state and non-governmental sector and international communities: human rights activists, representatives of non-governmental organizations, politicians, scientists, lawyers and other guests from Lithuania and abroad will participate and take part in the discussions of the event. In total, this year the National Human Rights Forum will welcome almost 100 participants from Lithuania, Ukraine, Belgium, the USA, Canada, Sweden, the Netherlands, Iceland and other countries. As usual, the program of the event includes discussions on the most diverse and relevant topics. On the occasion of the 30th anniversary of the Constitution, the participants of the forum will discuss the constitutional protection of human rights in the context of war, pandemic and other challenges. The discussions will also address disinformation campaigns, freedom of religion during wartime, Lithuania’s openness to refugees, protection of the most vulnerable groups in the face of threats, changes in family forms, the concept of citizenship, Roma integration, gender-based violence, rights of LGBTIQ persons, changes in the mental health system, maternity challenges, civic activity of teenagers and other issues. The program of events will be crowned by screening of the movie “Chaylla” and an excerpt from the story-performance “Aspen, Daughter of the Fir Tree”.

At the solemn opening of the event, the Speaker of the Seimas of the Republic of Lithuania Viktorija Čmilytė-Nielsen, the President of the Constitutional Court of the Republic of Lithuania dr. Danutė Jočienė and the Deputy Minister of Foreign Affairs of the Republic of Lithuania Mantas Adomėnas will welcome the participants of the forum. The National Human Rights Forum will be held on December 9, Friday, at Martynas Mažvydas National Library of Lithuania (Gedimino Ave. 51, Vilnius).

Matthias Crone: Leistungen müssen schnell und nicht nach Kassenlage erbracht werden

„Zwischenbilanzen zu den Rechten von Menschen mit Behinderung haben in diesem Jahr eine wichtige Rolle gespielt und waren zentrales Thema bei vielen Veranstaltungen. Dabei musste ich feststellen, dass der Übergang zur Inklusion in vielen Bereichen noch nicht vollzogen ist“, so Matthias Crone.

„Neue Gesetze kamen mit vielen Verheißungen daher. Ein freies selbstbestimmtes Leben für Menschen mit Behinderung. Leistungen wie aus einer Hand. Am Ende sollte für Menschen mit Behinderung die volle Teilhabe am Leben in der Gemeinschaft stehen. Von diesem Ziel sind wir in der Wirklichkeit an vielen Stellen noch weit entfernt“, sagte Matthias Crone         

Er verwies darauf, dass die Bedarfe von Menschen mit Behinderung festgestellt, genehmigt und dann auch umgesetzt werden müssten. 

Matthias Crone: „Schon bei dem ersten Schritt erreichen mich viele Eingaben, was die Durchführung der Feststellungsverfahren angeht. So kam es immer wieder zu Beschwerden über sehr lange Verfahrensdauern. Hier muss mehr Personal eingesetzt oder über die Vereinfachung von Verfahren nachgedacht werden. Lange Verfahrensdauern treffen Menschen mit Behinderung besonders hart“.

Bei den dann bewilligten Leistungen würde diese oft nicht individuell erbracht, sondern zusammengelegt, um Geld zu sparen. „Hilfeleistungen nur nach Kassenlage darf es nicht geben“, so Matthias Crone.

Der Bürgerbeauftrage sprach auch die bauliche Barrierefreiheit an. Sie zu verwirklichen sei wegen großer Widerstände immer noch schwer. Er verwies auf einen Fall, in dem ein dringend benötigter Fahrstuhl mit Verweis auf das Denkmalschutzgesetz nicht genehmigt wurde. Gerade im Bereich der Denkmalpflege erwarte er sich mehr Entgegenkommen: „Bei der anstehenden Novellierung des Denkmalschutzgesetzes M-V ist es zwingend geboten, die Barrierefreiheit festzuschreiben. Entsprechende Vorschläge haben wir erarbeitet und der Landesregierung übermittelt,“ so Matthias Crone abschließend.

Representatives of the Ombudsman Office were on a study trip to Spain

A study trip of representatives of the relevant state institutions of Azerbaijan was organized to Spain within the framework of the joint action "Increasing awareness of the Istanbul Convention and other gender equality standards in Azerbaijan"under the European Union and Council of Europe’s programme Partnership for Good Govermance II (PGG).The aim of the trip was to familiarize with the experience of Spain with regard to preventing and combating violence against women and domestic violence.

Representatives of the Office of the Commissionerfor Human Rights (Ombudsman) of the Republic of Azerbaijan Ayten Tarverdiyeva and Tahira Rahimova also participated in the study trip. As a part of the trip, the participants had meetings at the Ministry of Equality, the State Observatory on Domestic and Gender-based Violence, the specialized court on gender-based violence, the Family and Women's Center under the Ministry of the Interior, the Directorate General for Coordination and Research, the State Secretariat for Security, as well as the "Cometa" management and "016 call center".

During the meetings, authorized representatives of those institutions provided extensive information on the experience of Spain with regard to preventing and combating gender-based violence, as well as the activities of specialized courts, civil society organizations and call centers. 

During the interactive discussions, the members of the delegation spoke about the comprehensive measures implemented to prevent violence against women and domestic violence in Azerbaijan, including the experience of the Ombudsperson of Azerbaijan in this area.
