Confronto tra la Difensora civica e la presidente e il direttore dell'Associazione residenze per Anziani sulla gestione delle strutture nei due anni di pandemia


La gestione delle residenze per anziani nei due anni di pandemia è stato il tema al centro del recente incontro tra la Difensora civica Gabriele Morandell, la presidente e il direttore dell'Associazione delle Residenze per Anziani dell'Alto Adige Martina Ladurner e Oswald Mair. Il colloquio ha avuto come focus principale le particolari sfide che residenti, parenti e personale delle residenze per anziani si sono trovati ad affrontare in quest'ultimi due anni: nello specifico, sono stati affrontati l'organizzazione delle cure per i residenti, i diritti di visita e le limitazioni dei contatti nelle strutture.


I rappresentanti dell'Associazione si sono detti consapevoli che all'inizio della pandemia, a causa della mancanza di conoscenze e saperi in merito al virus, il processo decisionale è stato reso più difficile, e quindi la comunicazione continua con i parenti è spesso stata relegata in secondo piano. Tuttavia, le residenze per anziani hanno imparato molto da queste esperienze, migliorando molte cose, e stanno elaborando strategie d'azione per il futuro. 


Rafforzata e piena d'energia, con nuovo slancio e molte nuove conoscenze, l'Associazione delle Residenze per anziani dell'Alto Adige intende ora guardare al futuro di nuovo con fiducia, affrontando con un buon management della crisi anche le situazioni difficili. Il benessere, la salute e i diritti dei residenti delle strutture saranno sempre al centro di ogni decisione!

Cuestiones urbanísticas y brecha digital, prioridades de la Valedora do Pobo y los ayuntamientos

Hoy se celebró una reunión en la sede de la Fegamp, iniciando así los encuentros programados en el convenio suscrito.  Los Ayuntamientos y la Valedora do Pobo ponen en común los procedimientos y condicionantes en el desarrollo de sus respectivas competencias y detectan los principales puntos de mejora en el servicio a la ciudadanía.


En el seno de un coloquio organizado por la Fegamp y el alta Comisionada para la defensa de los derechos de los gallegos y gallegas, se destacaron dificultades relacionadas con el campo urbanístico, como las viviendas vacías u ocupaciones del espacio público, la limpieza de hincas, las formas de relación de la ciudadanía con la administración y los problemas vinculados a las nuevas tecnologías como la falta de conectividad o redes sociales.


Este encuentro forma parte de las iniciativas acordadas en el convenio para estrechar la colaboración entre las administraciones locales y la Valedora del pueblo. Tanto el vicepresidente de la Federación, Alfonso Villares, como la valedora,  Dolores Fernández, destacan la participación y bidireccionalidad del encuentro, participado presencial o telemáticamente por medio centenar de alcaldes y alcaldesas y las técnicas de la institución autonómica.


Las conclusiones de esta primera reunión servirán para mejorar protocolos de actuación y abrir nuevas vías de trabajo.


Además de este tipo de acciones, el dicho convenio contempla el intercambio de información como resoluciones, memorias, etc y otra serie de actuaciones dirigidas a alcanzar para la ciudadanía a máxima efectividad y transparencia en la defensa de su bienestar e interés.

(CJEU) Advocate General Ćapeta: by failing to stop the use by Danish producers of the registered name ‘Feta’ for cheese intended for export to third countries, Denmark has failed to fulfil its obligations under EU law

‘Feta’ was registered as a protected designation of origin (‘PDO’) in 2002.1 Since then, the name ‘Feta’ can be used only for cheese originating in the specified geographical area in Greece and complying with the relevant product specification.

In these infringement proceedings, the Commission, supported by Greece and Cyprus, claims that Denmark has breached its obligations under Regulation No 1151/20122 by failing to prevent or stop the use of the name ‘Feta’ for cheese produced in Denmark but intended to be exported to third countries.

Denmark claims, however, that Regulation No 1151/2012 applies only to products sold in the EU, and does not cover exports to third countries. It, therefore, does not deny that it does not prevent or stop the producers on its territory from using the name ‘Feta’ if their products are intended to be exported to third countries where the EU has not yet concluded an international agreement guaranteeing the protection of that name.

In her Opinion delivered today, Advocate General Tamara Ćapeta considers that Regulation No 1151/2012 covers such exports to third countries. She offers several reasons responding to the parties’ arguments.

First, the Advocate General acknowledges that, from Denmark’s perspective, such a reading might represent an obstacle to trade. However, the prohibition of exports to third countries of cheese under the name ‘Feta’ produced on Danish territory can be justified by reasons based on the protection of intellectual property rights.

Second, the Advocate General considers that the intellectual property interpretive perspective, as advanced by the Commission and the interveners, adequately explains the legislative intent behind Regulation No 1151/2012. The purpose of PDOs as intellectual property rights is to enable fair competition to producers of PDO products in exchange for their efforts to maintain and guarantee the high quality of their products. That enables survival of traditional businesses and ensures the diversity of products in the market. While free trade is undoubtedly one of the values respected by the EU legal order, the proposed interpretation takes into consideration other interests besides economic interests, which are also part of EU citizens’ perceptions as to what is a good quality of life.

Wirral teen missed out on post-16 education because of council faults

Wirral MBC has been asked to pay a teenager more than £4,000 after it failed to put in place proper educational provision for him.


The Local Government and Social Care Ombudsman was asked to investigate by the teenager’s mother after the council took too long to review her son’s Education, Health and Care (EHC) Plan. This left him without a place when he left his specialist school at the end of Year 12.


The teen has autism. He had initially been offered a place at a mainstream college with a package of support, but before the start of the September term the college withdrew its offer. The council looked at further options.


The teen’s mum told the council she would prefer a residential school. The council issued a final EHC plan in May the following year, but this plan still did not name a school for the teenager to attend.


The Ombudsman’s investigation found the length of time it took the council to review the teenager’s plan was fault. It also criticised the council’s record keeping from that time. The investigation found the council did not meet the proper timescales and take decisions it should in reviewing the teenager’s EHC Plan. It therefore failed to identify he was out of education during the first national lockdown.


Michael King, Local Government and Social Care Ombudsman, said:

“Because of the faults I have identified, this teenager was left without an educational placement when he should have been starting the autumn term. The council did not follow the proper review process, so for a long time the boy’s mother was not even able to use her appeal rights to the tribunal to see if the situation could be improved.

“I’m pleased the council has accepted my findings, and hope the improvements it will now make will ensure other children and young people with Education, Health and Care Plans are not affected in the same way.”


The Local Government and Social Care Ombudsman’s role is to remedy injustice and share learning from investigations to help improve public, and adult social care, services. In this case the council has agreed to apologise and pay the teenager £4,400 to reflect the poor practice the Ombudsman has identified. It will also pay the mother £250 to reflect her avoidable distress.


The Ombudsman has the power to make recommendations to improve processes for the wider public. In this case the council will complete its review of the annual EHC Plan review process, which is already underway, and arrange training with relevant officers.
