El Diputado del Común, Rafael Yanes, fue recibido en el Ayuntamiento de Fasnia, en Tenerife, por el alcalde, Luis Javier González y la primera teniente de alcalde, Silvia Tejera.

Yanes trasladó sus felicitaciones al alcalde dado que Fasnia ha sido el primer municipio en no tener quejas sin responder ante la Diputación del Común.

El Ararteko solicita información sobre el fallecimiento de dos presos la semana pasada en cárceles vascas

El Ararteko ha iniciado una actuación de oficio como consecuencia de la información recabada tanto de diferentes medios de comunicación como de las declaraciones ofrecidas por el portavoz del Gobierno Vasco y la consejera de Igualdad, Justicia y Políticas Sociales las dos personas fallecidas la pasada semana en dos de las prisiones competencia de la administración penitenciaria vasca.

El 28 de febrero fue hallado el primer fallecido, un joven de 22 años, en su celda de la cárcel de Zaballa (Araba) y el 1 de marzo el segundo, un hombre de 57 años, en la celda que ocupaba en la zona sanitaria de la prisión de Martutene (Gipuzkoa). En ambos casos las circunstancias de los fallecimientos apuntan a dos posibles suicidios.

Según se ha hecho público, el Gobierno Vasco ha iniciado los correspondientes expedientes para investigar lo sucedido en ambos casos y, como ha podido saber el Ararteko, continúa con las labores de investigación interna para el esclarecimiento de los hechos, así como de revisión del protocolo de prevención de suicidios en prisión.

Además del problema que suponen los suicidios, asunto que ya apuntábamos en el Informe anual al Parlamento Vasco del año 2019, todas las muertes en prisión nos interpelan como institución.

El Ararteko tiene entre sus principales objetivos la promoción, difusión y defensa de los derechos humanos, y el derecho a la vida es el primero que debe garantizar una institución pública como es la administración penitenciaria que, además, tiene una relación de sujeción especial con las personas presas, con jurisprudencia ampliamente consolidada del Tribunal Constitucional al respecto (STC 175/2000, de 26 de junio).

FRA will brief the group on the agency's recent activities and planned work related to victims of crime and criminal justice, in particular its second violence against women survey.

Participation of the Commissioner for Administration an protection of Human Rights in a Regional Project, funded by the EEA and Norway Grants, that aims to provide support to National Human Rights Institutions of member states of the European Union, in monitoring fundamental rights and the fundamental rights aspects of the rule of law.

Following an invitation from the European Union Agency of Fundamental Rights (FRA), the Commissioner for Administration and Human Rights submitted a successful proposal, to participate, as Cyprus’s National Human Rights Institution (NHRI), in a regional Project that aims to provide support to NHRIs of member states of the European Union, in monitoring fundamental rights and the fundamental rights aspects of the rule of law.

The participants to the Project, which is funded by the EEA and Norway Grants, are the FRA, as lead partner, and the NHRIs of Cyprus, Slovenia, Slovakia, Poland, Croatia, Bulgaria and Latvia, as beneficiary partners. Also, the European Network of National Human Rights Institutions (ENNHRI) participates in the Project as an expertise partner.


The Project, which is expected to be completed by February 29th 2024, covers the following three (3) Work Packages:

· Work Package 1: «Enhancing the use of the EU Charter of Fundamental Rights by NHRIs and strengthening their role in its enforcement at national level, including by building the capacity of NHRI staff in using EU fundamental rights law in their work».

· Work Package 2: «Strengthening NHRIs’ capacity in monitoring fundamental rights and the rule of law, by increasing their engagement with relevant EU mechanisms and by promoting national dialogues on fundamental rights and the rule of law».
· Work Package 3: «Developing the capacity of NHRIs to monitor fundamental rights compliance in the implementation of EU funds, as foreseen by newly applicable EU law».

For the purposes of the implementation of the Project, it is planned to carry out studies and draw up a number of Reports with relevant recommendations, in relation to the following topics:
  • - The present fundamental rights situation in Cyprus, and the potential for strengthening it through a stronger use of the EU Charter of Fundamental Rights.


       

    - An overview of the essential national human rights structures, their mandates and scope of action, including their interlinkages with EU frameworks and international human rights mechanisms.


       

    - The use of Charter in Cyprus and a collection of promising practices and examples on how the Cyprus NHRI has engaged with the Charter.


       

    - The strengthening of the NHRI’s capacity to report on the state of Rule of Law in Cyprus and the improvement of its methodology and national data collection on rule of law reporting, including monitoring over time.


       

    - Analysis and guidance on how the NHRI may exercise its role in monitoring fundamental rights compliance in the implementation of EU funds in Cyprus.

     


The Project also provides for the organization of educational/training seminars regarding the application of the EU’s human rights Law and, in particular, the EU Charter of Fundamental Rights. The seminars will be offered to both staff of the Office of the Commissioner for Administration and Human Rights, and, to other target groups that have been identified (such as legal practitioners and Officers of selected Public Authorities).

 

It is pointed out that FRA, as the lead partner, oversees the overall implementation of the project, promotes cooperation between the partners and provides advice and guidance to participating NHRIs on project activities and outputs.

Rencontre avec l'Ombudsman du Burundi

A l'occasion de sa visite officielle en Belgique, la nouvelle Ombudsman du Burundi, madame Aimée Laurentine KANYANA, accompagnée de SEM Thérence NATHIRIJA, Ambassadeur du Burundi en Belgique, a été reçue par le Médiateur, Marc BERTRAND.

Comme l'a rappelé Marc BERTRAND, les institutions du médiateur du Burundi et de Wallonie entretiennent des liens particuliers depuis de nombreuses années, notamment au travers des prédécesseurs de madame KANYANA, messieurs Mohamed RUKARA et Edouard NDUWIMANA.

Cette visite fut l'occasion de présenter les missions du Médiateur de la Wallonie et de la Fédération Wallonie-Bruxelles mais aussi le paysage de la médiation en Belgique en particulier Ombudsman.be, le réseau belge des Ombudsmans dont le médiateur wallon préside actuellement l'association.

Madame KANYANA a quant à elle fait part de sa vision pour l'institution dont elle a pris la charge, évoquant les enjeux et les ambitions en terme d'amélioration du service rendu, de développement de l'Etat de droit et de défense des Droits humains.

Le Médiateur, Marc BERTRAND a également présenté à son homologue Burundaise l'activité des réseaux internationaux de Médiateurs et Ombudsmans à s'avoir l'Institut International de l'Ombudsman (IOI) ou encore l'Association des Ombudsmans et Médiateurs de la Francophonie (AOMF). L'occasion de rappeler que ces réseaux sont des lieux d'échanges, de partage d'expérience mais aussi de formation, de réflexion et de soutien aux institutions, toujours dans un esprit de défense des droits fondamentaux et du respect des libertés.

Le Médiateur et l'Ombudsman ont profité de cette rencontre pour évoquer les pistes possibles de coopération bilatérale entre leurs institutions, notamment sur la formation du personnel aux techniques de médiation ou aux missions d'intégrité du Médiateur.

Une rencontre conviviale, fructueuse et enrichissante qui s'est clôturée par la remise de quelques souvenirs.
