Following the consideration of all the applications received from non-governmental organisations working in the field of human rights, Human Rights Ombudsman Peter Svetina decided to appoint Goran Forbici, the director of the umbrella network of the Slovenian non-governmental organisations CNVOS, as member of the RTVS Slovenija Council. The decision about his appointment was today, 17 February 2023, published in the Official Gazette of the Republic of Slovenia, no. 21/2023.

The Ombudsman published the public call to non-governmental organisations from the field of human rights and fundamental freedoms protection for the appointment of a Radiotelevizija Slovenija (RTVS) Council member on 13 January 2023 in the Official Gazette of the Republic of Slovenia, no. 4/2023. He considered all the proposals that came to the Ombudsman’s address with all required data and statements. The call was answered by eight non-governmental organisations, six of which nominated Goran Forbici; these NGOs were: Pravni center za varstvo človekovih pravic in okolja – PIC, Društvo SOS, Zavod Open, Zveza prijateljev mladine Slovenije, Mirovni inštitut, and Društvo za nenasilno komunikacijo. Human Rights Ombudsman Svetina talked with the candidate, who was the only one to submit the full application and meet all the requirements of the call, and thus decided to appoint him to the RTVSLO Council.

The term of the member from the ranks of non-governmental organisations working in the field of human rights lasts four years.

Goran Forbici has a degree in philosophy and history and has been working in the non-governmental sector for more than 20 years. He was an associate of the Peace Institute: between 2003 and 2007, he was a member of the Programme Committee, and in 2004 also a coordinator of the Delavsko-punkerska univerza (DPU) educational project. Within the DPU, he contributed through the organisation of lectures and reading seminars and editing collections of lectures to the development of the independent and critical thought and active education of students about the most contemporary theoretical and political topics overlooked in the main educational institutions. As the director of CNVOS, the umbrella organisation of the Slovenian non-governmental sector, which directly connects more than 1,500 non-governmental networks and organisations in Slovenia, he has been realising, advocating, and defending human rights and fundamental freedoms for more than a decade, especially the right to assembly and the right to participation in the management of public affairs. He is the author of several studies and publications about the inclusion of the public (citizens and organised civil society) in the creation of and decision-making on public policies and regulations.

Since 2015, he has been lecturing on these topics at the Administration Academy of the Ministry of Public Administration, and he also works with international organisations as a consultant and lecturer on the realisation of the right to participate in the management of public affairs (Council of Europe, OECD).

Ombudsman Rob Behrens comments on today's report from the Health and Social Care Committee's expert panel on the progress of the digitalisation of the NHS.

"We called for improvements to NHS digital infrastructure to be treated as an urgent issue of patient safety after analysis of our casework showed system-wide failings relating to scans and x-rays. In some cases, failings led to unnecessary loss of life. It is disappointing to hear the NHS’s digital transformation is not progressing as it needs to. Our work shows how essential digitalisation is and we welcome the expert panel’s scrutiny of this vital transformation.

El síndic de Greuges de la Comunitat Valenciana, Ángel Luna, ha recibido la contestación del Ayuntamiento de La Pobla de Vallbona en la que acepta la recomendación del defensor en relación con una queja sobre discriminación por maternidad en el acceso al empleo público. Finalmente, la interesada que presentó la queja ante el defensor del pueblo valenciano ha podido tomar posesión como funcionaria interina de la plaza vacante ofertada.

La actuación del Síndic se inició a mediados del pasado mes de diciembre cuando una ciudadana, integrante de una bolsa de trabajo del citado ayuntamiento, presentó queja ante esta institución al considerar que estaba siendo discriminada en el acceso a la función pública por razón de maternidad y que el consistorio no contestaba a sus escritos denunciando esta situación.

El relato se remonta a principios de noviembre, cuando desde el Ayuntamiento contactan telefónicamente con la afectada para proponerle el nombramiento de una vacante con incorporación el 1 de diciembre. Sin embargo, tras indicar su voluntad de ocupar la plaza e informar de su avanzado estado de gestación y de su próxima baja de maternidad, le negaron verbalmente el derecho a tomar posesión y le indicaron que debería presentar justificante para no perder su posición en la bolsa. La interesada, al no tener más noticias del puesto ofrecido, presentó por registro dos escritos a esta administración interesándose por su situación, a los que no recibió respuesta.

En su resolución, el Síndic censura la actuación del Ayuntamiento que, después de más de tres meses, no había contestado a los escritos presentados por la afectada. Un silencio que estaba generando claramente una situación de incertidumbre e indefensión a la interesada y poniendo en cuestión el principio de igualdad en el proceso de adjudicación de vacantes.

Luna subraya que la discriminación por embarazo o maternidad se considera discriminación directa por razón de sexo, puesto que se entiende como un trato desfavorable hacia las mujeres, tanto si están embarazadas como por cualquier situación relacionada o derivada del embarazo o la maternidad.

Por todo ello, el Síndic instó al Ayuntamiento que revisara el proceso de cobertura de los puestos ofertados y así descartar que se hubiera producido algún tipo de discriminación por maternidad en la adjudicación de vacantes. La respuesta de la administración no se hizo esperar. Un informe municipal confirmaba la aceptación de las recomendaciones y comunicaba que se había procedido al nombramiento de la interesada como funcionaria interina en la plaza vacante mencionada.

La Défenseure des droits a été alertée du retrait des équipes de l’association La Cimade des centres de rétention administrative du Mesnil-Amelot, à compter du 2 février 2023 et jusqu’à nouvel ordre.

Prenant acte avec inquiétude de ce retrait, elle décide ainsi de se saisir d’office en application de l’article 5 de la loi organique n°2011-333 du 29 mars 2011, afin de mener une instruction approfondie sur le traitement réservé aux personnes placées au sein des CRA, au regard de l’ensemble des griefs soulevés par l’association.

L’association, mandatée par l’État pour assurer l’accompagnement juridique des personnes étrangères retenues au sein des CRA, indique se trouver dans l’impossibilité de poursuivre sa mission en raison d’une recrudescence de violences et de graves dysfonctionnements. Elle fait notamment état :

• d’une multiplication des éloignements du territoire exécutés alors qu’une demande d’asile ou un recours juridictionnel étaient pendants ;
• d’une absence de prise en compte de l’état de santé ou de vulnérabilité des personnes placées en rétention ;
• d’une absence de prise en charge adéquate des troubles psychiatriques ;
• d’un recours de plus en plus fréquent à l’isolement, pour des durées indéterminées  et à des fins diverses ;
• d’une multiplication des situations de violences, entre l’administration et les personnes retenues de même qu’entre les personnes retenues. 

Régulièrement saisi par l’intermédiaire des associations intervenant en centres de rétention, de réclamations individuelles faisant état d’atteintes aux droits subies par les personnes retenues, le Défenseur des droits avait alerté, dès 2016, dans un rapport consacré aux droits fondamentaux des étrangers en France, sur les nombreux cas d’étrangers éloignés alors que la loi l’interdisait (parents d’enfants français, étrangers malades, etc.). Ses alertes portaient également sur l’exécution trop souvent expéditive des mesures d’éloignement, au mépris, parfois, des recours exercés.

Dans un rapport « Personnes malades étrangères : des droits fragilisés, des protections à renforcer » publié en 2019, le Défenseur des droits a en outre relevé les défaillances de l’administration dans la prise en charge sanitaire des personnes placées en centre de rétention et formulé plusieurs recommandations afin d’assurer le respect de leur droit à la protection de la santé.

Au terme d’une année 2022 marquée par une recrudescence des saisines faisant état d’atteintes aux droits des personnes étrangères, le retrait de La Cimade des centres de rétention du Mesnil-Amelot confirme une forte dégradation de l’accès aux droits des personnes étrangères.

La Défenseure des droits rappelle que toute personne, quelle que soit sa situation au regard du droit au séjour, doit voir pleinement garantis ses droits les plus fondamentaux, notamment le droit au recours effectif, le droit de mener une vie privée et familiale normale, d’accéder à des soins appropriés et de ne pas subir de traitements inhumains ou dégradants.
