Los jóvenes han conocido el funcionamiento del Defensor del Pueblo Autonómico, como garante de los derechos de los ciudadanos ante la Administración. Tomás Quintana ha explicado que cualquier ciudadano, incluso los jóvenes menores de edad, que entiendan que la Administración, sus Autoridades o empleados públicos, han lesionado sus derechos o legítimos intereses, pueden presentar su queja y el Procurador del Común actúa si deduce que ha habido alguna irregularidad en forma de advertencias, recomendaciones, sugerencias o recordatorios para que se corrijan las anomalías.

Avui s’ha fet el primer desplaçament conjunt per atendre les persones del barri d’Horta

El 2023 es faran tres desplaçaments conjunts més a diferents barris de la ciutat

Avui, 8 de febrer, la síndica de greuges de Catalunya i el síndic de greuges de Barcelona han fet la seva primera atenció presencial conjunta a la ciutat de Barcelona. Un equip de les dues institucions s'ha desplaçat a la Biblioteca Horta-Can Mariner i s'hi han recollit 20 queixes i consultes, la majoria per temes de consum (electricitat, llum i gas), mobilitat i urbanisme (circulació i superilla). A partir d’aquí, la Sindicatura de Greuges de Barcelona intervindrà en les queixes relacionades amb l’Administració municipal, i el Síndic de Greuges de Catalunya s'ocuparà de les queixes referides a altres administracions i a empreses de serveis d’interès general.

Aquest treball conjunt té la voluntat de fomentar la col·laboració entre les dues institucions i de facilitar l’accés, l’atenció i la garantia dels drets de les persones. A més, també suposa una millora en l’ús dels recursos públics. Per això, ja està previst repetir l’experiència en els mesos vinents als barris de Sagrada Família, Sant Martí i Sants.

Any 2022: primera resolució conjunta de les dues institucions

Amb aquest mateix esperit de col·laboració s'emetia, el març de 2022, la primera resolució conjunta del Síndic de Greuges de Catalunya i la Sindicatura de Greuges de Barcelona. En aquella ocasió es va tractar la ubicació, al costat d’una escola, d’un alberg d’acollida per a persones sense llar i amb addiccions, fet que preocupava el veïnat, l’Associació de Famílies d'Alumnat i la Direcció de l’escola. En aquella primera resolució conjunta es demanava a les administracions implicades que prenguessin mesures per evitar que la ubicació de l'alberg afectés les matriculacions de l'escola i per garantir la inversió necessària per consolidar el projecte educatiu del centre. Amb el temps s’ha constatat que s’han dut a terme accions per assegurar un entorn segur i que l’alberg no ha tingut conseqüències en la segregació escolar. 

Els desplaçaments al territori

30 anys després del primer desplaçament del Servei d’Atenció a les Persones, aquest gest per descentralitzar i apropar la institució a les persones de tot Catalunya s’ha convertit en una pràctica habitual. Al llarg de 2022 s’han fet 123 desplaçaments arreu del país i s’han atès 1.784 visites. Quatre d'aquests desplaçaments s'han fet dins la mateixa ciutat de Barcelona (Raval, Gràcia, les Corts i Bon Pastor) i han servit per iniciar més de 160 actuacions.

“Volem ser molt proactius en el diàleg amb les entitats del territori i altres actors, com les sindicatures i defensories locals, que estan a primera línia en la defensa de drets”, afirmava la síndica, Esther-Giménez Salinas, durant el desplaçament d'avui. Per aquest motiu, un dels objectius del seu mandat és que el personal de la institució trepitgi el territori i conegui de primera mà les qüestions que afecten les persones.

11 urgent issues for the Parliament to consider

The Ombudsman sent a letter to the Parliament (Saeima) drawing attention to the lack of the previous Parliament’s progress in the field of human rights and good governance. The letter mentions 11 urgent issues that should be taken into account when deciding on the national budget priorities for 2023. In particular, the Ombudsman has highlighted tasks related to social security and health care: children’s mental health care, minimum income levels, minimum social security contributions and the early retirement pension system.

The State must protect all families; the Ombudsman urges MPs to employ respectful rhetoric

The Ombudsman sent a letter to the Parliament (Saeima) urging the MPs to comply with the judgments of the Constitutional Court and to implement a policy that protects families of same-sex partners. He also asked members of the Parliament not to propagate statements that are untrue, promote intolerance or stigmatise certain representatives of society. Once again, the Ombudsman stresses – judgments of the Constitutional Court and the interpretation of the relevant legal norms provided therein are mandatory for all State and local government institutions (also courts) and officials, as well as for physical and legal persons. Human rights are not something that can be limited depending on the attitude of society. The legislator must be able to take decisions that are not supported by the majority of society, but the adoption of which is necessary to ensure the fundamental rights of every human being and the fulfilment of the international obligations of the country.

Good practice examples are welcome, but accessibility of banks needs to be improved

The Ombudsman has concluded his study “Accessibility of Banking Services”. In the study, he found that while examples of good practice do exist, the accessibility of banks for people with physical, sensory, and mental impairments must be improved. For the banking services to be fully accessible, it is necessary to ensure an accessible physical, information and digital environment. The Ombudsman emphasises the need for banks to consult with organisations of people with disabilities. It is important that mobile banking applications, internet banking and other digital tools also meet accessibility requirements. Educating bank staff also plays an important role.

Informational material on the risks of trafficking in human beings in the digital environment

The Ombudsman’s Office has developed an informational material on the risks of trafficking in human beings in the digital environment. The material summarises the campaign “Ne viss ir zelts, kas spīd!” (Eng.: All That Glitters is Not Gold!). The aim of the campaign is to draw attention to how vulnerable a person can really be, by way of examples. Although the stories are not based on real-life individuals’ experiences, they draw on the experience of Latvia and the world in general, in various areas of human trafficking. In the campaign, the Ombudsman paid particular attention to the digital environment, where people often see tempting job offers or dating ads, but are not careful enough, make mistakes and find themselves in terrible, life-threatening situations, or even disappear not to be heard from again. The informational material could be useful to anyone, especially people who use social media and various internet portals to communicate with others, including strangers.

The Ombudsman calls for a review of the amount of child maintenance paid by the State

The Ombudsman will request the Prime Minister to review the amount of child maintenance paid by the State by linking it to the minimum wage or by establishing regular indexation. The Maintenance Guarantee Fund is an integral part of the national social security system. Since maintenance is paid out of the State’s general budget resources, it is the State’s right to determine the amount that shall be paid. The State is not obliged to pay child maintenance to the same extent as it is done by parents, for the maintenance of their children. However, the social security system must be sustainable, effective, and fair. The Ombudsman stresses that, if a child is provided for by only one parent, it would be fair for the State to pay child maintenance in the place of the other parent – in the amount equivalent to minimum maintenance specified by the Cabinet.

Pre-scheduled in-person consultations and document reception in person will be available from Monday until Thursday. On Fridays, the office will be closed for visitors. These working hours will be in place until the end of the heating season (approx. May).

El Colectivo de Víctimas del Terrorismo COVITE solicitó la intervención del Ararteko para instar la eliminación de un monolito en homenaje a un miembro del grupo terrorista GRAPO que se encuentra en el término municipal de Abanto y Ciérvana-Abanto Zierbena.

Según COVITE, en la plaza de la Trinidad, en el barrio de Las Carreras de dicho municipio, hay una placa en un monolito dedicado a un miembro del GRAPO condenado por delitos de terrorismo, robos, atracos y por haber asaltado a dos policías nacionales, a los cuales hirió y necesitaron semanas para su recuperación según señalaba. Añadía que dicho miembro del GRAPO falleció en prisión por una bronconeumonía después de haber estado 97 días en huelga de hambre.

El Ararteko solicitó información al ayuntamiento en relación con un artículo de la Ley 4/2008, de 19 de junio, de Reconocimiento y Reparación a las Víctimas del Terrorismo que regula el derecho a la dignidad de las víctimas y establece que los poderes públicos vascos velarán para prevenir y evitar la realización de actos efectuados en público que entrañen descrédito, menosprecio o humillación de las víctimas o de sus familiares, exaltación del terrorismo, homenaje o concesión pública de distinciones a los terroristas.

En su respuesta, la alcaldesa en funciones de la localidad afirmó que, en ningún momento, el Ayuntamiento ha instalado el monolito citado ni organiza, ni secunda, ni patrocina ningún homenaje a ese miembro del GRAPO. 

Añadió que el monolito no está ubicado propiamente en la plaza de la Trinidad, sino en un parterre ajardinado adyacente, colindante con una urbanización privada. Agregó que el monolito fue instalado hace muchos años por particulares y que una consultados los archivos municipales, no han podido localizar ningún documento o antecedente que acredite que, en su momento, se solicitase o el ayuntamiento  concediese alguna autorización o permiso a tal efecto.

Aun así, el Ararteko considera que la existencia del monolito de homenaje en un sitio público vulnera la ley citada y supone, por sí misma, una afrenta y humillación a las víctimas del terrorismo en general y específicamente a las del GRAPO, así como a toda la sociedad.

La persistencia de pintadas, carteles y monolitos en los pueblos de Euskadi que atentan contra la dignidad de las víctimas sigue siendo objeto de preocupación del Ararteko, ya que va en contra de los derechos más elementales de las víctimas, por lo que supone de doble victimización y dolor para esas víctimas y sus familiares y nos retrotrae como sociedad a épocas pasadas de violencia que fractura la convivencia en Euskadi.

Por ello, el Ararteko recomendó al Ayuntamiento de Abanto Ciérvana-Abanto Zierbena que realizara los trámites necesarios para retirar el monolito. 

El Ayuntamiento ha respondido que ya ha iniciado los trámites para la retirada del monolito de homenaje al miembro del GRAPO, ubicado en un parterre ajardinado adyacente a la plaza de La Trinidad y que, con la mayor brevedad posible, procederá a su retirada.

Ombudsman Diana Kovacheva sent a recommendation to the Acting Minister of Health Dr. Asen Medzhidiev, to the Acting Director of the National Health Insurance Fund (NHIF) Dr. Yordanka Penkova and to the Chairman of the Bulgarian Medical Association Dr. Ivan Madjarov, recommending that annual fertility tests be included in the package of health activities covered by the Fund's budget – for women this means an ovarian reserve evaluation, and for men this involves a sperm analysis.

Ombudsman Diana Kovacheva sent a recommendation to the Acting Minister of Health Dr. Asen Medzhidiev, to the Acting Director of the National Health Insurance Fund (NHIF) Dr. Yordanka Penkova and to the Chairman of the Bulgarian Medical Association Dr. Ivan Madjarov, recommending that annual fertility tests be included in the package of health activities covered by the Fund's budget – for women this means an ovarian reserve evaluation, and for men this involves a sperm analysis.

The reason for this recommendation is a signal from Iskam Bebe (I want a baby) Foundation, which warns that more and more young people aged 25-35 in the country find themselves with a seriously impaired reproductive function.

According to the Foundation, this is due to the lack of conducting ovarian reserve tests at young age, and they point out that if the test was carried out annually on women aged over 18, it would give a clear picture of their reproductive status and would enable them to plan the birth of a child in accordance with their health status.

Therefore, Iskam Bebe Foundation suggests that in the package of health activities guaranteed by the NHIF budget, “every woman aged 18 to 35 should be subject to a hormone test for ovarian reserve evaluation (AMH)”, specifying that currently the average price of testing for this hormone is BGN 50, and for men of the same age the sperm analysis costs BGN 70.

“Regarding the issue raised, I would like to point out that the Ombudsman is committed to finding solutions to the problems related to reproductive health and assisted reproduction. In this regard, I believe that timely prevention and timely detection of reproductive problems for women and for men is important, so that they can have information about their health status at a much earlier stage and can take the necessary measures with a view to pregnancy planning and giving birth to a healthy child,” writes Prof. Kovacheva.  

She also drew attention to the fact that currently there is no data and no statistics is kept on how many women and men at young age have reproductive problems, since the ovarian reserve test is most often carried out only when applying for funding assisted reproduction activities. Thus women find out about them too late, with the resulting expenditure of public and personal funds, and sometimes even the impossibility of having children, and men also find themselves in the same situation of late detection of reproductive problems.

“I believe that in the current demographic crisis and the ageing population in the country, the public authorities must do more to find solutions and take measures aimed at promoting health and preventing fertility-related diseases”, said the Ombudsman.

In her recommendation, Diana Kovacheva also emphasized that the role of general practitioners was extremely important – they must inform citizens and refer them to perform reproductive health preventive tests.
