On January 10, 2023, CHR Marcin Wiącek received Rashed Mustafe Sarwar the UNICEF national coordinator in Poland. The Commissioner was accompanied by the main coordinator for scientific cooperation Maciej Grześkowiak and the head of the Family Law Department Michał Kubalski. The meeting was devoted to the exchange of experiences in the area of children's rights in Poland, in particular in connection with the presence of children from Ukraine and the humanitarian crisis on the Polish-Belarusian border. The meeting concerned issues such as the protection of children crossing both borders, pushbacks, detention of minors, or issues related to legal differences between Poland and Ukraine affecting the situation of children from Ukraine in Poland. The possibility of cooperation for the protection of children's rights was also discussed, in particular in connection with the presence of underage refugees in Poland. 
The UNICEF (Emergency Response) office was established in Poland after the outbreak of the war in Ukraine and primarily deals with helping children and youth of Ukrainian refugees residing in Poland. The programs relate to the sectors of education, protection of children's rights, health, etc.

Recommendation not implemented: investigation following a complaint alleging irregular acceptance of a development in St Julians

In accordance with Article 22(4) of the Ombudsman Act, the Ombudsman, Mr. Anthony C. Mifsud, and the Commissioner for Environment and Planning, Perit Alan Saliba, have submitted the Final Opinion to the House of Representatives concerning an investigation following a complaint alleging irregular acceptance of a development in St Julians.

Case summary

The Office of the Ombudsman received a complaint against the acceptance by the Planning Authority (PA) of a Development Notification Order for the erection of an ATM and booth in St Julians.

The Commissioner for Environment and Planning initiated an investigation by asking the PA whether the authority considered these constructions at road level would require any works below road level, mainly because the site is situated on the shore and elevated level with the promenade. Regarding the question about the subsidiary legislation, the PA stated that the Authority did not evaluate the proposal against Subsidiary Legislation 552.08 Class 4(iii) as the proposal did not fall under that development category but under Class 4(ii). In a later clarification, the PA clarified that the development was being considered for both Class 4(ii) and Class 4(iii), which contradicts the previous communication by the PA.

Conclusions and recommendations

Following the investigation, the Commissioner for Environment and Planning concluded that the allegations against the Planning Authority that it irregularly approved the development in St Julian’s are found to be justified as the approved booth is three times the size allowed in the Development Notification Order.

The Commissioner recommended that The PA invokes Article 80 of the Development Planning Act and revokes the permit in question due to errors on the face of the record and due to the submission of a plan (section) that does not reflect the situation on-site. It was also recommended that the PA take enforcement action against unpermitted constructions below street level and above the existing floor level.

Outcome

The Planning Authority did not react to the Final Opinion issued by the Office of the Ombudsman and did not implement the recommendations issued by the Commissioner for Environment and Planning. Therefore, the Commissioner informed the Prime Minister and the report was sent to the Parliament.

Ángel Gabilondo, ha asistido a la presentación del documental “M”

El Defensor del Pueblo, Ángel Gabilondo, ha asistido este lunes en el Palacio de la Prensa de Madrid a la presentación de “M”, un documental que pretende mostrar la realidad de los menores migrantes no acompañados y su lucha contra la estigmatización.

El documental, con guion del periodista Nicolás Castellano y producido por la Diputación de Cádiz, recoge el testimonio de 14 jóvenes que llegaron solos a España siendo menores. A través de sus historias en primera persona muestran los obstáculos a los que se han enfrentado hasta alcanzar la mayoría de edad.

La adjunta segunda del Defensor del Pueblo, Patricia Bárcena también ha asistido a la proyección.

Un futuro en positivo

El Defensor del Pueblo de Navarra se reunió el lunes, 9 de enero, con la Fundación IlundainHaritzBerri para conocer su trabajo y las necesidades de los jóvenes a los que acompañan

El encuentro con responsables de la Fundación, celebrado en centro de Ilundáin (Valle de Aranguren), se enmarca en la ronda de contactos que Patxi Vera está manteniendo con entidades del Tercer Sector navarro para conocer las necesidades de los colectivos más desfavorecidos.

La Fundación IlundainHaritzBerries una entidad social sin ánimo de lucro que, desde 1984, se dedica a acompañar a jóvenes en situación de vulnerabilidad, ofreciéndoles oportunidades que favorezcan su inclusión social, laboral y comunitaria. Para ello, desarrolla diferentes programas formativos, prelaborales, residenciales, de inclusión y de otro tipo, dirigidos a capacitar a estas personas y mejorar su situación.

Según explicaron los responsables de la Fundación en la reunión, la entidad se ha profesionalizado y actualmente cuenta con unos 300 trabajadores y trabajadoras. Entre ellos hay educadores, trabajadores sociales, psicólogos, pedagogos y la figura del mediador cultural.

En abril de 2019, Ilundain se convirtió en la primera entidad social reconocida dentro de la Asociación de Escuela de Segunda Oportunidad. Estas Escuelas de Segunda Oportunidad proponen, a través de diferentes programas educativos, prelaborales y de inclusión, un itinerario personalizado, basado en la confianza en el individuo, con el fin de que los jóvenes retornen al sistema educativo reglado o inicien su vida laboral.

En la reunión del lunes participaron, por parte de Fundación IlundainHaritzBerri, su presidente, Manolo Sanz, su director gerente, Patxi San Martín, y los responsables de Orientación Laboral, Miguel Pérez, Escuela de Segunda Oportunidad, Ángel Pardo, y Sistema de Protección, Alfonso Fernández. Por parte de la Institución, estuvieron presentes el Defensor del Pueblo, Patxi Vera, la jefa de Gabinete, Susana Galilea, y la asesora jurídica, Inés Monreal.
