Every year, the EU Agency for Fundamental Rights (FRA) updates its overview of national forced return monitoring systems across the EU. The overview for 2022 is now available.

The overview looks at the developments in the 27 EU Member States. It covers staffing, training, reporting and the monitoring of return operations.

FRA notes that Bulgaria, Croatia, Hungary, Latvia, Poland and Spain did not monitor any national forced return operation in 2022.

The overview also points to persistent challenges. These include some countries monitoring very few operations or not covering all steps in the process. In some countries, monitoring is temporary or depends on project funding and stops when the funding dries up.

Independence is another issue. To be effective, an entity that is sufficiently independent from the authority in charge of returns should carry out the monitoring. But this is not always the case.

Another challenge is transparency. Most monitoring bodies publish at least a summary of their observations and recommendations. But several EU countries have not issued recent public reports on the findings of forced return monitoring activities.

Operational issues also pose challenges. These include lack of capacity of national monitors in terms of human resources and funding. Returnees may also lack access to information and interpreters. Despite positive developments, issues concerning the identification of vulnerabilities or the handling of families with children continued to be reported.

A Rabat, in Marocco, nel corso della Conferenza di formazione dedicata agli uffici dell’Ombudsman, Marino Fardelli in qualità di Presidente del Coordinamento Nazional dei Difensori Civici italiani, ha condiviso riflessioni cruciali sull’importanza del ruolo e della responsabilità degli Ombudsman nella promozione di un meccanismo integrale di denuncia delle irregolarità, complementare alle altre istituzioni.

Il Difensore Civico ha sottolineato la missione centrata sulla tutela dei diritti dei cittadini e sulla promozione di una governance trasparente e responsabile. “La prospettiva privilegiata e indipendente degli Ombudsman  – ha dichiarato Marino Fardelli – agisce come ponte tra i cittadini e le istituzioni, facilitando la comunicazione e risolvendo controversie in modo equo ed imparziale. L’attenzione è stata posta sulla capacità di rilevare e affrontare le irregolarità in modo tempestivo ed efficiente, contribuendo a garantire che nessuna scorrettezza resti inosservata o impunita”.

Tuttavia, il Difensore Civico ha evidenziato le sfide legate alla collaborazione, con riferimento a resistenze forti in alcuni contesti, in particolare con una Pubblica Amministrazione che sembra mancare di rispetto nei confronti del cittadino-utente e del ruolo degli Ombudsman.

La questione di cultura e dignità è emersa come centrale: il Difensore Civico ha sottolineato che senza un impegno concreto verso la dignità dei cittadini, il pieno svolgimento del ruolo degli Ombudsman risulta limitato. La collaborazione auspicata, spesso non lineare, si basa sulla volontà delle persone coinvolte nel stabilire connessioni.

Il Difensore Civico ha concluso l’intervento con un appello alla collaborazione interna, sottolineando che la prima collaborazione dovrebbe avvenire all’interno degli uffici degli Ombudsman, coinvolgendo tutti coloro che lavorano per dare lustro e sostanza alla funzione dell’Ombudsman.

“Desidero ringraziare il mio collega Mr. Mohamed Benalilou, Mediatore del Regno del Marocco, per aver reso possibile la <piattaforma di Rabat>, presentata come esempio di cooperazione internazionale e di successi ottenuti dagli uffici degli Ombudsman”.

L’evento è stato organizzato dall’Ufficio del Mediatore del Regno del Marocco, dall’AOM (Association of Mediterranean Ombudsmen) e dall’AOMF (Association des Ombudsmans et des Médiateurs de la Francophonie).

The Deputy Ombudsman, Ravi Afonso Pereira, took part in the Annual Conference of the European Network of Ombudsmen (ENO) “Protection of human rights: approaches to migration and artificial intelligence”, held in Brussels, Belgium, on 9 and 10 November 2023.

The ENO comprises more than 95 ombudsmen in 36 European countries. The Network includes the national and regional ombudsmen and similar institutions of the Member States of the European Union, the candidate countries for accession to the EU and other countries of the European Economic Area, as well as the European Ombudsman and the Committee on Petitions of the European Parliament.

The Network was set up in 1996 and is an important mechanism for sharing experiences and good practices between the various national and regional ombudsmen and between them and the European Ombudsman. It organises various seminars and meetings, a regular newsletter, an interactive internet forum and a daily electronic news service.

María Dolores Fernández Galiño participó esta mañana en una Mesa de Trabajo sobre edadismo organizada por la Asociación Miradas Mujeres + 60, con una charla titulada “Edad y Género”.

La jornada fue presentada por Maria Antonia Rilo, presidenta de la asociación, y participaron 17  asociaciones más, además de las intervenciones de José María Faílde, Presidente de la Sociedad Gallega de Gerontología y Geriatría, y profesor en la Universidad de Vigo y en la UNED,  y  de  Xaime Fandiño, uno de los responsables  de la Cátedra de Edadismo de la Universidad de Vigo.

El Defensor de la Infancia y Adolescencia de Andalucía, Jesús Maeztu, ha alentado a trabajar por los niños y niñas cuyas madres fueron asesinadas por la violencia de género.

"La lacra de la violencia de género ha destruido el presente de los niños y niñas huérfanos, no podemos permitir que condicione también su futuro", ha afirmado Maeztu hoy en Málaga en el II Encuentro Estatal de Familias de víctimas mortales de la Violencia de Género, un encuentro organizado por la Fundación Mujeres y el Fondo de Becas Soledad Cazorla.

Jesús Maeztu ha expuesto los múltiples retos y desafíos a los que se enfrentan los niños y las familias encargados de su crianza y ha descrito las actuaciones demandadas a la Administración por la Defensoría para mejorar la vida de estas personas.
