Mañana sábado se reunirá en el Centro Cívico Salburua de Vitoria-Gasteiz el Consejo de Adolescentes del Ararteko. 25 chicos y chicas de distintos municipios de Euskadi van a dedicar todo el día a recapitular sobre lo trabajado en los últimos meses sobre las instituciones de defensa y promoción de derechos de infancia y sus propuestas sobre cómo mejorar la institución del Ararteko para hacer una mejor defensa de los derechos de niñas, niños y adolescentes. 

Tendremos ocasión de conocer el resultado de nuestra participación en el proyecto ENYA (European Network of Young Advisors), iniciativa que impulsa la participación de niños, niñas y adolescentes en la actividad de ENOC- Red Europea de Defensorías de Infancia. Dos representantes del Consejo del Ararteko, Maite y Xabier, llevaron las conclusiones y aportaciones de todo el grupo a dos encuentros europeos celebrados en los últimos meses en Malta y Bruselas. 

También los integrantes del Consejo que participaron en el Encuentro Nuestra Voz -Arene, Eneko y Nahia- darán cuenta de su experiencia. Este encuentro, organizado por el Ararteko, acogió a finales de junio en Bilbao a un grupo de chicos y chicas de edades comprendidas entre 14 y 17 años, procedentes de siete comunidades del Estado. En esta reunión, se abordó el tema de la infancia y la adolescencia en riesgo de desprotección y su objetivo fue propiciar un espacio de participación significativa, recoger su voz y sus opiniones para integrarlas en el proceso general de reflexión y deliberación de las XXXVI Jornadas de Coordinación de Defensorías.

Por último, Lander y Lorea, compartirán su experiencia en el Athens Democracy Forum 2023 celebrado en Grecia recientemente. Un encuentro en el que han aportado sus reflexiones sobre los retos actuales de la democracia y la participación en asuntos que les atañen como niños niñas y adolescentes.

Como todos los años, acabaremos el día despidiendo a los chicos y chicas que, tras tres cursos escolares, finalizan su andadura en nuestro consejo. Eskerrik asko, Eneko, Jaime, Lander, Lorea, Patricia, Peio, Teo eta Xabier, bihotz-bihotzez!

Los próximos días 21 y 22 de noviembre, las tres capitales de Euskadi acogerán encuentros restaurativos internacionales de la mano de la iniciativa “Encuentro de Encuentros – Encounter of the Encounters”, organizado por la Universidad del País Vasco y del Instituto Vasco de Criminología, y en colaboración con el Ararteko y varias organizaciones de nivel europeo e internacional. Este evento se enmarca dentro de la Semana Internacional de la Justicia Restaurativa, impulsada por el Foro Europeo de Justicia Restaurativa.

La iniciativa “Encuentro de Encuentros” consiste en la facilitación de diálogos restaurativos transfronterizos con un grupo de personas que comparten el haber experimentado acontecimientos vitales “radicales” y “extremos” en contextos de violencia política y extremismo violento. Desde que se iniciara en Donostia/San Sebastián en 2019, y a lo largo de cinco ediciones, la iniciativa ha reunido a personas de Euskadi, Bélgica, Alemania, Israel y Palestina, Italia, Irlanda del Norte, Escocia y Ucrania. Los diálogos reúnen a participantes que han jugado y juegan papeles diferentes en estos contextos tras la violencia: el de testigos reales (víctimas, supervivientes y victimarios, a veces con sus familiares, como parejas e hijas e hijos); el de personas jóvenes en representación de las generaciones futuras y el de la ciudadanía interesada; las personas facilitadoras de justicia restaurativa; y las personas garantes con diferentes experiencias en justicia restaurativa y justicia penal.

Esta nueva edición del “Encuentro de Encuentros” vuelve a Euskadi para seguir expandiendo e intensificando las experiencias restaurativas internacionales. Tras un primer día dedicado a encuentros confidenciales, el evento recorrerá las tres capitales de Euskadi, bajo el título la “Justicia restaurativa intergeneracional: Ampliando el diálogo del Encuentro de Encuentros restaurativos”, para abrir los diálogos restaurativos a toda la ciudadanía: el día 21 de noviembre en Donostia/San Sebastián (Centro Carlos Santamaría, Auditorio Antonio Beristain), y el día 22 de noviembre en Vitoria (Aula Magna Araba campus) y en Bilbao (Bilbao Bizkaia Aretoa, Sala Baroja). Las personas interesadas tienen hasta el 17 de noviembre para inscribirse.   

El Ararteko, como entidad colaboradora y facilitadora de esta iniciativa desde sus inicios, anima a la ciudadanía de Euskadi a unirse a estos diálogos restaurativos. 

The Parliamentary Ombudsman of Malta, Judge Emeritus Joseph Zammit McKeon, and the Chief Ombudsman of Türkiye, Mr. Şeref Malkoç, visited the Civil Protection Department Fire Station in Hal Far. The Ambassador of Türkiye to Malta, H.E. Erdeniz Şen, was also present.

The purpose of the visit was to convey gratitude and appreciation to the Civil Protection Officers who provided invaluable support following the earthquake, assisting in subsequent relief operations. The officers’ efforts reflected the deep-seated solidarity of the Maltese people, demonstrated further by the generous provision of goods to support the affected individuals.

At an Ombudsman Conference in Kosovo last May, the Parliamentary Ombudsman of Malta recalled how the Chief Ombudsman of Türkiye acknowledged countries that lent a helping hand to Türkiye, including Malta. He subsequently invited Mr Malkoç to the CPD during his visit to Malta as a gesture of personal gratitude. The Chief Ombudsman of Türkiye, grateful for the invitation, immediately accepted it. The Ombudsman of Malta thanked the CPD for arranging the meeting.

The ceremony came to a touching close with the Chief Ombudsman of Türkiye thanking all officers for their courage and commitment. He also extended his gratitude to the Maltese people for their overwhelming support. Emphasising Türkiye’s enduring appreciation, he assured that the country will forever remember the compassion and assistance of Malta and its citizens.

El Defensor del Pueblo, Ángel Gabilondo, ha entregado este jueves al presidente del Gobierno en funciones, Pedro Sánchez el “Informe sobre abusos sexuales en el ámbito de la Iglesia católica y el papel de los poderes públicos”, Una respuesta necesaria, dando cumplimiento a la encomienda recibida del Congreso de los Diputados tras la aprobación de una Proposición no de Ley (PNL), el 10 de marzo de 2022, que contó con el voto a favor de la mayoría de los grupos políticos de la Cámara Baja.

La citada encomienda establecía que el informe debería ser presentado a las Cortes Generales y al Gobierno de España. Así, el pasado viernes, Ángel Gabilondo entregó el informe a la presidenta de las Cortes Generales, Francina Armengol.

El Informe cuenta con 777 páginas en las que se recoge una presentación del titular de la institución y una introducción general, los ámbitos de actuación, objetivos, metodología y fuentes empleadas, detalles de una encuesta encargada a GAD3, marco jurídico, y conclusiones-recomendaciones que el Defensor del Pueblo ha elevado a las Cortes Generales y al Gobierno de España para “la adopción de las medidas necesarias en orden a cumplir con el objetivo de la encomienda”, según se explicita en la mencionada PNL.

The complaint

The Ombudsman launched an investigation after Mr L complained about the care and treatment he received from Betsi Cadwaladr University Health Board in 2018.

Mr L complained that between January and September the Health Board failed to promptly and appropriately identify, investigate and treat a blockage of blood vessels in his neck (a condition called carotid artery stenosis, where the blockage restrict the blood flow to the middle of the brain, face and head).

Mr L also complained that the Health Board did not provide him with timely care once the blockage had been identified in September, up to his surgery in November 2018.

What the Ombudsman found

The Ombudsman found that when Mr L attended the Emergency Department in January 2018, the Health Board missed opportunities to consider the possibility that he suffered a watershed stroke (which occurs when the blood supply to an area is compromised within 2 major vessel systems at the same time). Had Mr L undergone an appropriate scan in January, he would have likely been offered surgery as a matter of urgency.  Mr L was seen at hospital again in March, and there was a further failure then to properly investigate the cause of his ongoing symptoms.

It was not until September 2018 that an appropriate scan was arranged, revealing the issue.

The Ombudsman also found that the Health Board delayed treating the blockage following the diagnosis. This was even though Mr L suffered small temporary strokes during the scan , and in the weeks that followed.  Damage to the eye and loss of vision because of reduced blood flow were identified from the scan in September, which called for urgent surgical treatment.

Mr L eventually underwent surgery on 8 November.He has been left with permanent sight loss and life-long treatment to try to manage his ongoing pain, inflammation, and increased pressure because of the damage caused to his eye.

Commenting on the report, Public Services Ombudsman for Wales, Michelle Morris, said:

“As a result of the repeated missed opportunities to identify and treat his vascular condition, Mr L suffered multiple strokes, ongoing discomfort, and blurred vision. Despite the irreversible nature of the condition affecting his eyesight, there still appeared to be no sense of urgency to offer treatment.”

“These missed opportunities amount to significant service failures – they caused significant and ongoing injustice to Mr L because he continues to experience debilitating symptoms.”

“Clearly, there was a complete failure to follow the relevant guidelines and the Health Board’s own policy.”

“In addition, I cannot fail to be shocked by the fact that although Mr L first complained to the Health Board in June 2019, it took until February 2023 for it to recognise any failings – and that only after reviewing a draft of the professional advice informing our investigation. We have recently published a strategic report ‘Groundhog Day 2’ highlighting that we continue to see these kinds of failings across the Health Boards in Wales.”

“We had noted similar failings in a previous case we investigated against the Health Board. Since that investigation, 2 reports were published that were extremely critical of vascular care and treatment at the Health Board. However, I am aware that recent review of these services by Health Inspectorate Wales pointed to notable improvements. This gives us hope that that events such as in this case might in future be avoided.”

The Ombudsman’s recommendations

The Ombudsman recommended that Betsi Cadwaladr University Health Board should apologise to Mr L and pay him £4750 for the failings she identified and the impact upon him.

In addition, the Ombudsman recommended that the Health Board should:

• remind all relevant staff that all patients who may be appropriate for surgery should undergo scans of the major arteries in the neck (carotid arteries).
• remind all relevant staff of the clinical indications of the types of strokes that affected Mr L and of the importance of considering this possibility when reviewing patients.
• ensure that the treating Consultant reflects on how they can improve their future practice in light of the Ombudsman’s findings.
• review its policy about treatment to ensure that it is compliant with current guidance and share the revised policy with staff.
